Senate Bill 1520 intended to facilitate Akaka Bill

 

HONOLULU—Next week, Gov. Neil Abercrombie will be holding a bill signing ceremony for Senate Bill 1520, which the governor says will significantly improve protection of cultural rights, “ceded lands” and other entitlements, advance self-governance, and heal the “kaumaha”—the heaviness or sorrow.

Specifically, the bill establishes a five-member Native Hawaiian roll commission in the Office of Hawaiian affairs for administrative purposes to prepare and maintain a roll of qualified Native Hawaiians. The commission will publish the roll to facilitate commencement of a convention for the purpose of organization. The governor of Hawaii is required to dissolve the commission after publication of the roll.

The bill signing ceremony will occur at Washington Place, former home of Queen Liliuokalani, on Wednesday, July 6 at 2:00 p.m. 

The governor said the bill is intended to move in concert with the efforts by Senator Daniel Akaka and Hawaii‘s Congressional Delegation to achieve federal recognition of Native Hawaiians via the Akaka Bill.

The bill, which passed with only one “No” vote (from Republican Sen. Sam Slom) out of 76 legislators on May 3, 2011, is seen as an act of “reciprocal healing recognizing Hawaiians as equal partners, rather than a conquered people,” said Sen. Malama Solomon, who was the bill’s chief negotiator in securing passage. She worked closely with Sen. Donovan Dela Cruz and members of the joint conference committee to finalize the measure. Members of the joint conference committee on Hawaiian Affairs included:  Senate Chair Brickwood Galuteria, co-chairs Sen. Clayton Hee and Sen. David Y. Ige, Sen. Gil Kahele, Sen. Malama Solomon, House co-chairs Rep. Faye Hanohano and Rep. Gilbert Keith-Agaran, Rep. Chris Lee and Rep. Blake Oshiro.

“Every generation of Native Hawaiians since the overthrow of the Hawaiian Kingdom in 1893 has struggled with not legally being recognized as equals,” Solomon said in a statement. “So many have given so much; many have fought in World War I, World War II, Korea and Vietnam—some losing their lives—for a country that doesn’t recognize them. ... While much has been done including the creation of the Hawaiian Homes Commission Act in 1921, formation of the Office of Hawaiian Affairs in 1978, and the signing of the ‘Apology Resolution’ by President William Clinton in 1993, we are still not equals in our own land.”

When signed into law, the measure adds a new chapter to the Hawaii Revised Statutes, which would establish a process for Native Hawaiians to organize themselves.

“Hawaiians are very different from the American tribes; we had a kingdom that was recognized by the United States and many other nations around the world before the overthrow,” Solomon said. “Many of us today are directly connected to this history and heritage through our parents, grandparents, and great grandparents. This new law will begin the healing.”

The bill specifies how individuals shall be nominated for consideration for the commission, and requires that each of the four counties be represented, with the fifth individual serving at-large. Funding to facilitate the activities of the Native Hawaiian Roll Commission will be provided by the Office of Hawaiian Affairs.

Hawaiians have suffered since the first western contact in 1778.

Western diseases, to which they had no immunity, decimated their numbers.


At the time of western contact, some 800,000 people inhabited the Hawaiian Islands.


By 1805 that number had been halved.


By 1853 there were only 71,000 Hawaiian or part-Hawaiian people in the islands.


Within 100 years of western contact, the Hawaiian population had been reduced by nearly 90 percent.


According to the 2000 census, the numbers of people who claim some native Hawaiian ancestry have increased to over 400,000.


But only 239,000 live in Hawai`i and they are the poorest, most locked-up population in the state.


Although they only make up about 20 percent of the state's population, they make up 39 percent of the state's prison population, according to the state Department of Public Safety.


And they are 37 percent of the state's homeless population.


Ending The US Occupation & Restoring Independence To The Hawaiian Kingdom Is The Only Right To Correct These Wrongs.

Of the 40,000 non Kingdom subjects in Hawai`i at the time of the illegal 1898 overthrow, only 1,928 or so were US nationals as documented by the 1900 census.

They represented less than 3% of the entire population.


The rest of the non US aliens were not supportive of the illegal annexation of Hawai`i by the US.


The resulting illegal "Republic of Hawai`i" had less than 2,000 citizens.


This means that less than 3% of the population, US aliens, hijacked the Hawaiian Nation against the wishes of almost everybody else.

Getting a traffic ticket in Hawai`i and forgetting to pay it can get complicated, harassing, and expensive.

Not only will you find a stopper on your drivers license making it impossible to renew your license, not only will you not be able to just pay your ticket at the court, but you will have to send your money to Texas, pay up to 50% in additional fees to a Texas-based collection agency, and add another US$10.00 credit card handling fee for immediate service.


This can easily double the cost of your ticket.


The Hawai`i court system, like many other jurisdictions, has contracted with the Texas-based Municipal Service Bureau to collect on Hawai`i-issued traffic tickets.


Once the collection agency is involved, they will be provided with your social security number, your date of birth, your drivers license number, all your phone numbers, including unlisted numbers.

You can expect to receive two phone calls a day and every day until you pay your ticket including the handling fees the agency adds to the ticket amount.

Privacy concerns? Not for Hawai`i courts. All information is provided by the Honolulu District Court to this privately owned collection agency in Texas.


And don't try to send a check to the Hawai`i courts. Payments for Hawai`i traffic tickets is only accepted in Texas.

The Lightning and Rolling Thunder came from Pacific depths to Hawaii to wake up Kanaka Maoli.  What was the Lightning & Thunder about?  It was to awaken us to our bowl of light; the memories and knowledge we carry within us of Akua.
 
It is Akua’s way of bringing us back to HIS PRESENCE.  This is also for all mankind.  The color of our skin is a figment of our imagination.  We are all human beings and we all belong to Akua (God). 
 
We’ve come full circle; mankind now returns to the presence of the Creator.
No more darkness for the people -- Kanaka Maoli & Mankind.  We are moved by Spirit, not by Logic.  In order to know the truth of things, we must be in Spirit -- not in Logic.
 
It is time for the Kanaka to awaken the memory of who they are.  To get the record straight, they need to gather their thoughts and speak from the heart.
 
Akua will guide but they need to be Spiritual.  The Ancestors will guide them in what they have to do.  The Ancestors have been gathering and now it is time for the Kanaka to gather as well.
 
 
KU’E MAU                                                                           PROTEST FOREVER
 
In 1893, Hawaii’s Queen expected justice from the U.S. in a short period of time.  For half of the life of the nation of America, 118 of 235 years, the U.S. has been at war with Hawaii.  This is not an internal conflict, it is a full blown international incident.  Three modes used to conquer a nation are war, religion and economy.
 
The Protest of Her Majesty the Queen Lili’uokalani is a wartime convention.
 
Wartime Treaty:
 
I, Lili’uokalani, by the grace of God and under the constitution of the Hawaiian kingdom Queen, do hereby solemnly protest against any and all acts done against myself and the constitutional government of the Hawaiian kingdom by certain persons claiming to have established a Provisional Government of and for this kingdom.
 
That I yield to the superior force of the United States of America, whose Minister Plenipotentiary, His Excellency John L. Stevens, has caused United States troops to be landed at Honolulu, and declared that he would support the said Provisional Government.
 
Now, to avoid any collision of armed forces, and perhaps the loss of life, I do, under this protest and impelled by said forces, yield my authority until such time as the Government of the United States shall, upon the facts being presented to it, undo the action of its representative, and reinstate me in the authority which I claim as the constitutional sovereign of the Hawaiian Islands. 
 
Done at Honolulu this seventeeth day of January, A.D., 1893.
 
The Kue Petition, Palapala Hoopii Ku‘e Hui ‘Aina, of 1897-98 supported the Queen’s Protest.  The Queen’s Protest was the effort of the Sovereign to maintain the independence of the Hawaiian Kingdom.  The Ku’e Petition was the effort of the subjects to support the independence of the Hawaiian Kingdom.
 
The Queen, as the Sovereign, issued the protest.  The people, as subjects, supported her protest by the petition.  The petition became the collective effort of 93% of the entire nation to maintain the independence of the Hawaiian Kingdom.  The presentation of the original Ku’e Petition list REMAINS the effort of the people in 2011 to maintain the independence of the Hawaiian Kingdom.
 
Here is an open invitation to everyone of the world to be enlightened on the truth concerning Hawaii and the subjects of the Hawaiian kingdom.

The Hawaiian Kingdom is the Principal Entity.  Any Principal Entity has agencies.  The agencies carry out the work for the Principal Entity.  The government is an agency of the Principal Entity.  What was overthrown was the agency.  The Principal Entity or Hawaiian Kingdom still exists.
 
What does it mean when we say the Hawaiian Kingdom still exists?  It means that its constitution and all laws proceeding from the constitution REMAIN in full force.
 
What’s been the problem?  The problem has been the loss of the proper administration of Hawaiian Kingdom laws.  Why?  At the passing of Queen Lili’uokalani on November 11, 1917, the seat of authority, or the Throne, became vacant.
 
Because the Hawaiian Kingdom and its constitution remain intact, this determines now, HOW the vacancy is to be filled.  The government gains its agency through the constitution itself.  If the government was overthrown, was the constitution overthrown?  The answer is NO.
 
The Principal Entity, or Hawaiian Kingdom, progresses from the unification of the Hawaiian Islands in 1810 by Kamehameha the Great.  Several constitutions and world treaties created over time are evidence to support this fact.
 
Hawaii’s form of government has always been defined as a monarchy.  When American businessmen led an overthrow of the government, it was the overthrow of the monarchy NOT the Hawaiian Kingdom.  In our cultural heritage, Kanaka Maoli have always looked to their Alii.  For Kanaka Maoli, the Sovereign has been leader and the people’s representative vested by Akua.  Only Ke Akua (God) can give any of us the ‘ike (guidance) necessary for life.  If we abide by the direction and guidance of Spirit, we will survive.

 In May, 2011 documents written by Queen Lili'uokalani in the days following the overthrow were discovered held in a secured vault in Maryland.  The documents are for the sole disposition of the Hawaiian Kingdom and not the United States of America, the State of Hawaii nor any and all of its agencies and representatives, governmental and non governmental, public and private, including the Office of Hawaiian Affairs. 

 Kanaka Maoli demand immediate access to insure the safety and preservation of these documents.

Kanaka Maoli ~ Trust Akua (God).  Seek the Ancestors who stand on all the Hawaii mountaintops now while the Waka 'Ehiku (Seven Canoes) are here.  As they are here, the bowl of light is here in Hawaii.  When the canoes travel the Pacific to California -- there too, Ancestors will line the mountaintops for Kanaka Maoli on the U.S. continent.

Spirit is always with us.  It tells us what to say or do.  When we do not listen, we are thinking with our minds instead of feeling with  our hearts.  How can we connect to Akua?  We must be IN SPIRIT in order for Akua to guide us and for the Ancestors to speak to us.  Many things are possible in this world, but only through Spirit.
 
 
Kanaka Maoli are SPIRITUAL PEOPLE.  When SPIRIT moves you ~ you know that you know that you know.  Our Na'au (true heart for 'Oiwi) houses our bowl of light and is also the place we feel the connection to our Ancestors, our Kupuna.  In order for us to be this way, we must be PONO.

As we come into the presence of the Creator, we KNOW  what our Gifts are and what our Kuleana is.

We are PONO and able to STAND in the presence of the CREATOR when:

 
I.    We release all our anger
II.   We release all our fear
III.  We forgive OURSELVES
IV.  We forgive those who have wronged us
V.   We practice unconditional love
                   VI.  We practice living in the NOW; the present moment

Akua makes things simple; it is man that makes things complicated.  Logic is a game of darkness into which we expend all our good energy of the light.  The light expands out to the darkness but if there are no reserves, the light flickers out.  If we are in SPIRIT we’re constantly receiving the light. 
 
The River of Life is with the Ancestors and Akua (Divine Creator). 
 
THE MIND IS THE CONFINED DIMENSION ~ THE SPIRIT IS LIMITLESS.

Privatization & Development Of Public Lands To Ignore Zoning & Land Use Laws

DBEDT director Richard Lim’s recent speech at a meeting of the Hawaii Economic Association spelled out his view that public lands represent a significant resource and opportunity for private development.

Now a bill signed into law by Governor Abercrombie provides muscle to move Lim’s vision towards reality.


Here’s what Lim had to say about development of public land.


"The State has vast land resources which currently represent a drain on the State’s coffers due to heavy maintenance costs. We cannot afford to pay for adequate upkeep so facilities are in disrepair and, consequently, become underutilized. Most residents don’t use them which often results in them attracting undesirable elements.


By engaging in public-private partnerships, we hope to turn this situation around. We will find private sector partners who are willing to make the requisite investments to renovate and revitalize our underutilized lands.


There are a number projects that can improve our infrastructure and provide improved facilities for the enjoyment of locals and tourists. And, partnering with the private sector minimizes the need for State funding or additional personnel.


Of course, there will always be the vocal minority that will object. Think of the Superferry. And, there have been other projects that have been derailed by well heeled NIMBY’s and special interests.

While I am all for protecting the environment, we need to strike a balance. We can do responsible and sustainable development."


SB1555 CD1, quietly signed into law by the governor on May 20 as Act 55, will create a potentially very powerful Public Land Development Corporation to implement Lim’s strategy for privatizing public resources.


Lim will sit on the 5-member board along with the director of Finance and the Land Board chairman.

Two additional members will be appointed by the House Speaker and Senate President, and those members must have “sufficient knowledge, experience, and proven expertise in small and large businesses within the development or recreation industries, banking, real estate, finance, promotion, marketing, or management.”


Conservation? Environment? Public interests? No seat at the table.


The new PLDC is charged with selecting land from the state inventory and promoting private development for projects that but are not “limited to office space; vehicular parking; commercial uses; hotel, residential, and timeshare uses; fueling facilities; storage and repair facilities; and seawater air conditioning plants.”


The PLDC is broadly empowered to guarantee loans for developers, issue bonds to finance projects, and take other steps to push for development. It looks like a piggy bank for private investors and developers.

The US Federal Maritime Administration has put up for public sale the two high-speed vessels formerly owned by the bankrupt Hawai`i Superferry LLC.

 

The 321-foot Alakai and 338-foot Huakai are being sold "as is" but free and clear of all liens.

 

The Maritime Administration bought both vessels for $25 million each and was owed more than $135.7 million.

 

The vessels, built by Austal USA in Mobile, Ala., are now berthed at Lambert's Point Dock in Norfolk, Va.

 

The Superferry was shut down on March 16, 2009, after the Hawai`i Supreme Court struck down a law, ruling it was intended to benefit a specific party, in violation of the state Constitution.

General Wiercinski's Big Lie (PA)‏

The Big Lie!

Lt. General Francis J. Wiercinski, Commanding General U.S. Army Pacific, was quoted in an Associated Press news story on June 19, 2011 as saying:
"... I don't think anybody does it better than us when it comes to protecting the environment and being cognizant and protective of cultural sites."


Adolf Hitler coined the phrase "The Big Lie" in 1925 for a lie so "colossal" that no one would believe that someone "could have the impudence to distort the truth so infamously."  Sixteen years later, on Jan. 12, 1941 Hitler's propaganda minister Joseph Goebbels,  wrote: "When one lies, one should lie big, and stick to it ... even at the risk of looking ridiculous."

Someone needs to tell General Wiercinski that he looks ridiculous. A few examples:
1.  In Hawaii, the Army secretively tested chemical and biological weapons, including deadly Sarin nerve gas) in Hilo's watershed, and other sites in Hawaii.  The Army did this on State land in the Waiakea Forest Reserve, with a lease to do "weather" testing.  The Army Lied.
2.  The Army secretly used Depleted Uranium (DU) weapons in Hawaii and contaminated the land with radiation.  For years the Army denied using such weapons in Hawaii.  How much DU was used, and the extent of radiation contamination in Hawaii, is still in question.  The Army has been stonewalling community concerns on DU.
3.  More than 14 million live-rounds are fired annually at the Pohakuloa Training Area  (PTA) according to an Army EIS report of several years ago.  The live rounds include everything from small arms fire, to cannons, fighter jets, bombers, etc. And recent news reports talk of doubling the training at PTA. How many live rounds fired annually are planned for PTA?  Where is the bonding of funds for clean-up when the base is shut down? And General, please explain how bombing the land and waging wars for oil is protecting the environment.

General Wiercinski, if you want to be taken seriously, our organization challenges you to support and fund comprehensive, independent testing and monitoring with citizen oversight lead by Dr. Lorrin Pang, MD (retired Army Medical Corps) to determine the full extent of radiation contamination at PTA, Makua Valley, and Schofield Barracks.

Finally, our organization does not appreciate your attempt to pit one island's opposition against another.  We are opposed to pushing U.S. desecration and contamination from one site to another in Hawaii or anywhere.  We want an end to U.S. occupation in Hawaii and the restoration of the Hawaii nation.  We want the U.S. to stop bombing Hawaii and clean up its opala.  We want to put an end to U.S. desecration and contamination of all sacred cultural sites.  We do not want the U.S. training anywhere to do to others what the U.S. has already done to Hawaii: overthrow and occupy its government and nation, desecrate its sacred sites, and contaminate its air, land, water, people, plants, and animals with military toxins.

The truth is the U.S. military, (Army included) is the world's largest polluter and destroyer (not protector) of the environment and culture the world has ever seen.

Greed, selfishness and simply using these islands to allow foreigners to make millions of dollars off our people are western concepts and have no place in Hawai`i.

Unless we immediately find a way to preserve and help Hawaiians, the tourism industry will soon find aloha even harder to sell.


With the cost of living and thousands of Hawaiian families still being forced to move to the US every year, we are depleting our greatest natural resource for aloha.


As Hawaiians lose their young to hopelessness and despair and moving away, aloha is in trouble.
