There's no need to create a new government when a perfectly good and lawful one — the Hawaiian Kingdom — continues to exist.

Although it has been greatly impaired by unlawful suppression and layers of fraud, the sovereignty of the Hawaiian Kingdom was never lawfully extinguished.

Therefore, there is no justification to contrive a new government to replace the Hawaiian Kingdom unless the people, the lawful subjects/citizens, called Hawaiian Nationals, decide they want to alter or change their government.

No one other than Hawaiian Nationals can make that determination — not the US government or foreign US citizens residing in Hawai`i, or the fake State of Hawai`i, the Office of Hawaiian Affairs, or the Akaka Bill’s proposed phony Native Hawaiian Governing Entity.

Because the Hawaiian Kingdom is in continuity, there is no lawful way to alter or replace that existing government except through the processes provided in the existing lawful constitution of the Hawaiian Kingdom.

Prior to the Hawaiian Kingdom being taken over by insurgents during the illegal US invasion in 1893, Hawai`i had already been functioning for decades as a nation-state under one of the best constitutions in the world.

The United States’ prolonged occupation does not change the fact that the constitutional government of the Hawaiian Kingdom, the one in place from 1840 to 1893, is still the one and only lawful and indisputable government for the Hawaiian Islands.

The United States is a usurper, and has no lawful jurisdiction in Hawai`i.

WERE HAWAIIANS THE ONLY ONES WRONGED?













The forceful takeover of the Hawaiian Kingdom in 1893 adversely affected a country’s government, its lands and its citizens, not only the members of a single ethnic group.

It was the Hawaiian Kingdom — a nation — that was taken, not the aboriginal people — the Kanaka Maoli (what the US and the State of Hawai`i insist on calling, “Native Hawaiians.”)

Yes, Kanaka Maoli were harmed by the loss of their nation, but so were many non-aboriginal subject/citizens of the Hawaiian Kingdom - Asians, Caucasian, Polynesians and so forth.

This is a crucial point. When a nation is stolen, all the citizens of that nation are deprived of their country, not only the aboriginal people.


Both occupying governments, the US Federal and its puppet, the fake state of Hawai`i either assert or presume in their laws and policies, that the takeover of 1893 affected only “Native Hawaiians.”

By purposefully limiting their culpability to “Native Hawaiians,” the US carefully conceals the true scope of the problem, presenting it as a domestic, localized, racially defined problem, rather than the violation of the unalienable rights of the citizens of a recognized sovereign foreign nation.

WAS THE HAWAIIAN KINGDOM HIJACKED?

Of the 40,000 non Kingdom subjects in Hawai`i at the time of the illegal 1898 overthrow, only 1,928 or so were U.S. nationals as documented by the 1900 census.

They represented less than 3% of the entire population.

The rest of the non U.S. aliens were not supportive of the illegal annexation of Hawai`i by the US.

This means that less than 3% of the population, all of them US aliens, hijacked the Hawaiian Nation against the wishes of almost everybody else.

ABERCROMBIE SUPPORTER OPPOSES PLDC

Dear Governor Abercrombie,


I am writing to voice my strong support for repeal of Act 55 for establishment of the Public Land Development Corporation. I am not remotely hysterical, and I most definitely not one of the “usual suspects,” as you characterize opponents of the PLDC. 

I have never been overtly involved in an issue like this. I have been subtly involved in some issues, for instance, I wrote and recorded the music for the “Town Hall” campaign ads in your gubernatorial race, and I wrote a series of articles for the Honolulu Weekly regarding Act 221 related legislation a number of years ago. I have never, however, been an activist by any stretch of the imagination. This issue has moved me to become actively involved.


This legislation is dangerously written and could affect life in the islands in perpetuity. The PLDC is being handed carte blanche control to develop some of the most treasured lands in Hawai`i with no mechanism of accountability and only weak, toothless avenues for public input. 

The only responsibility of the PLDC is to generate revenue, which is a tragically short-sighted purview for a group tasked to steward public resources. In reading the law, I actually find no mention of accountability regarding even how lucrative revenue generation might be. There is certainly no provision for competitive bidding or planning review. At its core, Act 55 grants absolute authority to the PLDC to streamline any activity by any developer who can convince three of five appointed officials that they have a good idea, however they want to define “good idea.”


It is this massive scope of powers over a million acres of land that is most disturbing. The authority is absolute, and the law eliminates previous checks and controls, especially for neighbor islanders who lose any real mechanism for control of their lands and resources. 

Wording of the legislation is so vague that there is no onus on the PLDC to provide anything more than cursory notifications, and there is no recourse if the PLDC acts entirely against community interests. This sets several dangerous precedents, and there is no assurance that future governors will appoint boards with any interest at heart but that of developers. Indeed, the only beneficiaries of this act seem to be developers who are given a fast-tracked route to have their way with the land.


This measure passed quickly and was drastically rewritten without public input. I do not believe that even you or the legislators have thought this through thoroughly. Hawaiian Homesteads land is included, as well as many culturally and ecologically sensitive areas. 

The 1993 apology the 103rd Congress, Joint Resolution 19 regarding the overthrow of the Hawaiian Monarchy actually casts the entire issue of state control over these lands into some question, and irresponsible decisions will provide impetus and opportunity for litigation. These are federal issues that will supersede State legislation. An interminable string of legal challenges on many fronts will be your legacy if you allow this law to stand.


I am not an alarmist. I am, however, able to read and evaluate evidence, and what I see in this Act is not in the interest of the people or `aina of Hawai`i. 

We are asked to trust that the rules, when established, will protect us, but the PLDC is already in practical negotiation with developers and has an established track record for ignoring public input. The entire law was passed with an unusual disregard for public process. My distrust is so strong that I am now reluctantly moved to become involved.


Governor Abercrombie, I have been a quiet supporter of you for many years. I now must be vocal, and it pains me that I must find my voice in opposition to you on this issue. I and many like me who have had your back and given you our votes will not stand for this abuse of public resources and trust. 

I fear that this will be your Waterloo, because it is important enough that we will not forgive or forget if you let the law go into effect. I hope you will change your position on this quickly, before too much damage is done across your constituency. This is my first letter to a public official, but it will not be my last.

HAWAI`I - THE HIDDEN HISTORY OF A NATION

If you have visited Hawai`i in the past year, you are one of the approximated seven million tourists who have enjoyed the tropical paradise of Hawaii.

This land, where tourists attend “luaus,” learn to surf and tan on beautiful beaches, is so much more than a destination for vacationing and escaping from the scrutiny and activity of the world. Hawai`i is a region profound in culture and history, a history that is unfortunately often one of deceit and disrespect.

Hawai`i became a territory of America in 1898, and although it has been immersed into the US political system as a state, this annexation was blatantly illegal. Hawai`i continues to exist as a sovereign nation under international law, and deserves recognition and respect for this exact reason.

​ The history of Hawai`i’s independence goes back to Kalani Kauikeauoli, also known as King Kamehameha III, the third king of Hawai`i, who sought out sovereignty for his country.

To attain sovereignty at that time, as Hawaiian historian Keanu Sai remarks, other sovereign, or independent states had to be recognized. “This system came to be called the ‘Family of Nations,’” he said. “[This] is the international system still in place today.”

By understanding this system, Kauikeauoli sent three envoys on Apr. 8, 1842 to Europe and the US to gain formal recognition from the U.S., France and Great Britain. 

The three envoys consisted of William Richards, Timeoteo Ha’alilo and Sir George Simpson who were the advisors of the king. 

These envoys soon achieved their goal in Europe when both Britain and France jointly granted Hawai`i formal recognition and pledged never to take possession of Hawai`i in the Anglo-Franco proclamation of Nov. 28, 1843.

The same goal was achieved with the US President Tyler assuring the envoy that the US would recognize Hawai`i but needed Congress to approve, which eventually occurred in 1849 with this recognition put into writing. Thus, the Hawaiian Kingdom joined the “family of nations,” becoming a sovereign country under international law.

​ The Kingdom of Hawai`i would soon be stripped from Hawaii 50 years after it’s recognition because of the economic interests of white businessmen who slowly took over the islands’ government. 

These sugar industry businessmen were part of a secret group called the Hawaiian League, who pledged to keep secret its existence and whose purpose of the league was to protect the white community of this Kingdom.

This new Hawaiian League would come into effect in 1887 during the reign of King Kalakaua, the seventh king of Hawai`i, who was violently forced to sign the Bayonet constitution by the Hawaiian League. 

This new constitution diminished the powers of the monarch and gave the right to Europeans and Americans to vote. 

Through the Bayonet constitution, the Hawaiian League foreshadowed its hidden goal to annex Hawai`i to the US. This would occur soon after the death of King Kalakaua in 1891 and the ascent of his sister Queen Lili`uokalani, the last monarch of Hawai`i, to the throne.

Lili`uokalani was a queen with a strong character and knew that she had to form a new constitution that would restore some of her power back to her and her people. 

The queen had finally drafted a new constitution, but on Jan. 16, 1893, the day that Queen Lili`uoklani was to instate this new constitution, the Hawaiian League had the sailors and marines of the USS Boston take up quarters in the yard across from the royal Hawaiian palace. 

These sailors and marines acted at the request of John L. Stevens, US Minister to the Kingdom of Hawaii and member of the Hawaiian League, but without the knowledge or authorization of the Congress or the President.

The next day, Jan. 17, 1893, the conspirators read a proclamation declaring that the Hawaiian monarchy government was abrogated and replaced by a de facto provisional government.

​ The overthrow of the Hawaiian Kingdom led to a US investigation known as the James Blount report, a 1,400 page report that described the overthrow as illegal and demanded the reinstatement of Lili`uokalani. 

This failed to happen because Congress and the rest of the US were proponents of Hawaiian annexation. Eventually, the US would pass the Newlands Resolution to annex Hawai`i in 1898 because it was seen as necessary for military purposes in the Spanish-American War.

The Newlands resolution was a joint resolution internal to the US and did not apply to a foreign country like a treaty of annexation would do. 

According to international law, the encapsulation of any foreign country requires a treaty of annexation, proving that the existence of a Hawaiian kingdom exists under current international law.

​ So the next time you take a visit to Hawai`i all I ask is that you become aware of the nation that stands under your feet and be respectful of the culture and struggle that continues to exist.

In the Kingdom of Hawai`i, November 28 was an official holiday called Lā Kū`oko`a, or Independence Day. This was the day in 1843 when England and France formally recognized Hawai`i's independence.

Faced with the problem of foreign encroachment of Hawaiian territory, His Majesty King Kamehameha III deemed it prudent and necessary to dispatch a Hawaiian delegation to the United States and then to Europe, with the power to negotiate treaties and to ultimately secure the recognition of Hawaiian Independence by the major powers of the world.

In accordance with this view, Timoteo Ha`alilio, William Richards and Sir George Simpson were commissioned as joint Ministers Plenipotentiary on April 8, 1842.

Sir George Simpson, shortly thereafter, left for England, via Alaska and Siberia, while Mr. Ha`alilio and Mr. Richards departed for the United States, via Mexico and the US on July 8, 1842.


The Hawaiian delegation, while in the United States of America, secured the assurance of US President Tyler on December 19, 1842 of its recognition of Hawaiian independence, and then proceeded to meet Sir George Simpson in Europe and secure formal recognition by Great Britain and France.

On March 17, 1843, King Louis-Phillipe of France recognized Hawaiian independence at the urging of King Leopold of Belgium, and on April 1, 1843, Lord Aberdeen on behalf of Her Britannic Majesty Queen Victoria, assured the Hawaiian delegation that:


"Her Majesty's Government was willing and had determined to recognize the independence of the Sandwich Islands under their present sovereign."

Formal Agreement of Recognition -

On November 28, 1843, at the Court of London, the British and French Governments entered into a formal agreement of the recognition of Hawaiian independence, with what is called the Anglo-Franco Proclamation.

To wit-


"Her Majesty the Queen of the United Kingdom of Great Britain and Ireland, and His Majesty the King of the French, taking into consideration the existence in the Sandwich Islands (Hawaiian Islands) of a government capable of providing for the regularity of its relations with foreign nations, have thought it right to engage, reciprocally, to consider the Sandwich Islands as an Independent State, and never to take possession, neither directly or under the title of Protectorate, or under any other form, of any part of the territory of which they are composed.

The undersigned, Her Majesty's Principal Secretary of State of Foreign Affairs, and the Ambassador Extraordinary of His Majesty the King of the French, at the Court of London, being furnished with the necessary powers, hereby declare, in consequence, that their said Majesties take reciprocally that engagement.

In witness whereof the undersigned have signed the present declaration, and have affixed thereto the seal of their arms.

Done in duplicate at London, the 28th day of November, in the year of our Lord, 1843.

The Fake Revolution -

Fifty years later, in 1893, an illegal intervention by the U.S. military resulted in a "fake revolution" against the legitimate Hawaiian government, and a puppet oligarchy set itself up with its main purpose of annexing Hawai`i to the United States.

After a failed armed attempt by Hawaiians to retake their Kingdom in 1895, the usurpers announced that Lā Kū`oko`a would no longer be celebrated, and the American holiday Thanksgiving Day would be the official national holiday instead.

Removing a holiday like Hawai`i Independence Day was a way to cover up and try to destroy the history and identity of the Hawaiian Kingdom and its people.

At first Hawaiians protested and celebrated Lā Kū`oko`a anyway, telling the story of the national heroes who had traveled to Europe to secure Hawaii's recognition.

But over time, this history — knowledge of the holiday and how it was replaced — faded and was almost lost, until recently, when Hawaiian language scholars started translating Hawaiian language newspapers and rediscovered the story.


Tomorrow’s celebration of Lā Kū`oko`a asserts that Hawai`i is still an independent nation, even under prolonged illegal occupation.

DOES THE HAWAIIAN KINGDOM STILL EXIST?

 










Yes, the lawful, sovereign entity, the Hawaiian Kingdom, does still exist.
 

At no time did the Hawaiian Kingdom or Hawaiian nationals surrender their sovereignty or consent to a merger with the US.
 

There are only two ways a nation can be extinguished - conquest involving the military defeat and subjugation of its people, along with the physical seizure of its territory by the victor or the un-coerced, free-will choice of its people to surrender and merge their nation’s sovereignty to another.

Even the unconditional surrender of Japan and Germany after World War II, did not extinguish their sovereignty. They became occupied states but still retained their national identity.

They were still Japan and Germany and the occupying forces administered and enforced the laws of Japan and Germany respectively.
Despite the incorporation of the Eastern European states into the Soviet Union after World War II those countries did not extinguish their sovereignty.

And despite complete domination by the USSR during the “cold war,” when the Soviet Union collapsed in the early 1990s states like Lithuania, Estonia, Latvia, Czechoslovakia reemerged as sovereign and independent countries in continuity.


In the case of Hawai`i, after the illegal seizure and takeover, the status of Hawaiian Kingdom citizens remain inviolate.

Neither a vote or plebiscite was ever conducted to gain the consent of the Hawaiian people to dissolve their country, the Hawaiian Kingdom.

On the contrary, there was fierce opposition to the initial seizure and efforts at annexation, as evidenced by the massive petitions and protests in the press.


The Hawaiian Kingdom continues to exist. It did not expire. It survives even having been buried alive for over a century under the layers of US deception and fraud.

The state Office of Hawaiian Affairs is questioning the age of human burials — to date, more than 600 sets of remains — removed by Kawaiaha‘o Church in preparation for building a $17.5 million multipurpose center.


The state agency advocating for Native Hawaiians sent a letter this week to the state Department of Land and Natural Resources requesting detailed information about the burials to show whether they are all Christian burials, as the church contends, or whether some predate the church and should be protected by Hawaii’s historic burial law.


Kawaiaha‘o was established in 1842 to become Hawaii’s first church, and it has been allowed to disinter an unlimited number of human remains, or iwi kupuna, under an exemption to the burial law that gives special protections to traditional Hawaiian burials.


The exemption applies to known and actively maintained cemeteries, and was approved by DLNR and upheld by a Circuit Court judge.


But OHA questions whether the church is digging up burials that predate Kawaiaha‘o’s existence, especially given the “exceedingly large” number of remains, which includes 605 burials and thousands of individual bones as of Sept. 9.


“Since the historical record indicates that the area contained burial sites prior to the establishment of Kawaiaha‘o Church, questions of this nature are warranted,” OHA said in its letter dated Sept. 17.


OHA  is asking DLNR to obtain details about the burials such as their depth, position, orientation, whether they are in a coffin and whether artifacts are present. Other details that could help date burials such as the presence of remains of animals, plants and ref­use in proximity to burials are also being sought.


Kawaiaha‘o is required to notify DLNR’s State Historic Preservation Division of burial findings weekly, but the reports typically state only when and how many burials were removed.

In covering up the hoax, Congress passed the Newlands Resolution falsly declaring the majority wished for the annexation of Hawai`i without a lawful treaty.

That's how Hawai`i became unlawfully annexed even according to US laws.

IS HAWAI`I REALLY PART OF THE US?











The United States claims it possesses the Hawaiian Islands.

But the facts show that at no time did lawful title to the Hawaiian Islands actually transfer from the Hawaiian Kingdom to the US either directly or indirectly.


The thieves who stole the Hawaiian Kingdom fenced it to the US, who has been claiming it as its own - the 50th US state.


The takeover of the Hawaiian Kingdom violated the Hawaiian Constitution, the US Constitution and the Law of Nations.

According to the governing principles embodied in those documents, the only lawful means to peacefully change a government is by the consent of the people.

There was no consent of the people for the 1893 takeover, nor for the 1893 Provisional Government for Hawai`i, nor for the 1894 formation of the Republic of Hawai`i, nor for the 1898 Annexation to the US, which was not even legitimate according to US law.

And finally, the 1959 vote conferring “statehood” to Hawai`i was based upon the previous illegitimate acts and did not conform to the criteria or procedures required by international law under the United Nations Charter.

The “statehood” plebiscite constituted fraud and thus, “the state of Hawai`i” is an unlawful entity - a fake state.
