HAWAIIAN ANCESTRAL LAW VERSUS PARK RULES

 

Can one Hawaiian woman stand up against the entire State of Hawaii's laws criminalizing homelessness?

 

Laulani Teale is a Hawaiian woman, a mother and educator, and her political activism is motivated by her spiritual and cultural knowledge, experience and inheritance. The spiritual context of heraction is in her estimation as important as the act itself. "I am here," she says," for cultural survival, for the houseless people and because of APEC."

 

Teale is standing for human rights and Hawaiian rights during this week of APEC. While nearly every political group in Hawaii is staging some form of public protest, panel or conference type of gathering in the shadow of the APEC events, Teale sits quietly with her daughter, Li'a, playing nearby, and anyone who cares to stop by and talk-story beneath her bamboo canopy near the end Kalakaua Avenue in Waikiki in front of the Honolulu Zoo and the statue of Ghandi is welcome. And she's been there since Monday afternoon, despite the fact that every "homeless"

or "houseless" person in Waikiki has been swept out and away by law enforcement.

 

"This is a pu'u honua (refuge) until Sunday," she says, as Li'a rolls by on her scooter. When asked about the police she says, "Most police have been helpful. But the larger picture is that

the police work for the system which is doing hewa with APEC, perpetuating hewa." Hewa is the Hawaiian word for "wrong." "The higher law is our ancestral law," she says." “They are trying to enforce park rules, that conflict with their own constitutional laws and values.” But King Kamehameha the Great decreed 'Moe i Ke'ala,' meaning people can sleep on the road without threat of harm."

 

What Teale is putting to the test is called "Kanawai Mamalahoe," which translates to mean "The Law of the Splintered Paddle." It dates back to the days of Kamehameha, but it was adopted as part of the Hawaii State Constitution in 1978, Article 9, section 10. In part, it reads: "The law of the splintered paddle, mamala-hoe kanawai, decreed by Kamehameha I – “Let every elderly person, woman and child lie by the roadside in safety-- shall be a unique and living symbol of the

State's concern for public safety."

 

In fact, the symbol of The Law of Splintered Paddle appears as two crossed paddles and a triangular flag on every badge worn by a Honolulu police officer.

 

"It is the law of the land and it has never been repealed," says Teale. "The law of our land is human rights or bust. If a government cannot respect that, it has to come down."

 

When asked what the difference is between what she is doing and what homeless people do in Waikiki and other places in Hawaii every day, she answers, "There is very little difference. I don't want to get arrested, but I won't give up my rights."

 

So far, Teale has been able to stand her ground without being arrested and physically removed by law enforcement from her encampment by the statue of Ghandi, a man whose life was devoted to peaceful resistance against a foreign power in his homeland. "I respect people who have stood for pono (righteousness), taken a risk and worked at a level of a higher law."

HAWAIIAN PATRIOTS ARRESTED AT `IOLANI PALACE

Honolulu Star-Advertiser - November 7, 2011

State law enforcement officers arrested 22 people last night after they refused to leave the ‘Iolani Palace grounds.


Members of the sovereignty group Hawaiian Kingdom Government claim the state of Hawaii is a “puppet government” and the Hawaiian monarchy was overthrown illegally.


The arrests went peacefully and took about 35 minutes in the parking lot near the State Archives. The lights of the palace shined in the background.


“We’ve always done things peacefully,” group spokesperson Donna Willard said.


The 22 people were charged with criminal trespass II, a petty misdemeanor, and planned to stay overnight at a jail in Kapolei before being transported for arraignment to a District Court.


State land Director William Aila said he was disappointed that the members chose to be arrested and thought they had made their point.


The arrests, close to 7 PM, came several hours after Aila announced a decision to close `Iolani Palace and the surrounding grounds to the public from 5 PM yesterday through November 15 at 6 AM, saying he wanted to protect the area and ensure public safety during the Asia-Pacific Economic Cooperation meetings on O`ahu.

HOW HEALTHY ARE HAWAIIANS TODAY?

Hawaiians suffer the worst health profile in Hawai`i.

While rates of death from heart disease, cancer, stroke and diabetes have decreased for non-Hawaiians, they have increased, sometimes dramatically, for Hawaiians.

Below 1 year of age, the Hawaiian death rate is more than double the overall official average.


Between 1 and 4 years of age, it is triple the official figure, and so on into adulthood.


Just under 20 percent of the population, Hawaiians suffer 75 percent of the deaths for persons less than 18 years of age
.

FAMILY BEING EVICTED FROM ANCESTRAL LANDS

Keoki
“Kaloman” Fukimitsu, traditional taro farmer and his family have been living at
49-077 Johnson Road, for nine generations. Their
“Kuleana Land” was established by the first land commission created by
Kamehameha I in 1832. The family has been planting taro, fishing and taking
care of the land. This Kuleana Land was to allow them to keep to their native
diet and take care of their family in perpetuity.

His
father’s non-Hawaiian partner, Gloria Siu, married him just before he passed
away. Gloria convinced Marvin
Fukumitsu to take his own family off the deed and put her and her family on it.
Today, she wants $1.8 million plus other cost retributions.

When John
Morgan of Kualoa Ranch stepped up to help Kaloman, Gloria refused to sell it
for the agreed Settlement amount because she wanted more money from the Ranch.

Now she
wants the family that has lived there all their lives to be evicted so she can
make her money and leave. Never mind that her deceased husband’s family has no
assets or other place to live.

This is a
blatant case of extreme injustice that
· A
Hawaiian family that has lived on the land since the 1700’s passed down through
Royal Patents from Queen Kalama, wife of Kamehameha III is being evicted
because of greed.
· A
resource of cultural significance provided by a family that has been part of
the cultural fabric in the traditional farming of taro for 9 generations will
be taken from the community through wrongful eviction.
· As
descendants from Chiefly and Kahuna clans “Kaloman” Fukumitsu and his family
are being denied their Native Rights, Hawaiian Rights, Kuleana Land Rights,
Water Rights and Konohiki Rights due to misuse of legal land grabbing.

It is
“Hewa” for a non-family member to evict children whose birthright is to live on
that land, farm it and have it sustain them. The eviction is scheduled within
the next 48 hours.

Our community and our family PROTEST this wrongful act of
eviction and want everyone to know the truth, see the truth and support
“Kaloman” to save Ancestral Rights and Traditional Kalo Farmlands. Call Keoki “Kaloman” Fukumitsu at

By their own laws the US cannot simply walk in and take Hawaiian land titles and erase the word "Royal" and replace it with "United States" Patent.

They and the fake state of Hawai`i have never had "Clear Title" since Jan 17, 1893.
They have all known this for a long time.

The only way the United States will ever be able to get clear title to the Hawaiian Islands is if Hawaiians give it to them through the fake state Akaka bill.


How Will They Do That?

They're going to register a majority of Hawaiians to sign onto the Office of Hawaiian Affairs Kau Inoa roll.


Then through the Akaka bill a "Native Hawaiian Governing Entity" will be created.


Then theyʻre going to get Hawaiians to elect officers to that government.


They are going to make sure those governing documents give the officers of the government the authority to give away title in negotiations.


They are going to get the majority of Hawaiians on the Kau Inoa roll to vote for the new governing documents to reorganize the Hawaiian government.


That government authorized and approved by the majority of Hawaiians is going to sit down at the negotiating table with the United States and trade land title for cash and benefits.


But only the Kingdom of Hawai`i is authorized to give a way title to the Hawaiian Islands, but only as long as the kingdom remains intact.


If the majority of its subjects revolt by forming a new government, the kingdom no longer exists.


So the Akaka bill is only the bait. The hook is the formation of a new government and the negotiations between the US and the new government.


The Akaka bill does not tell Hawaiians, but asks them to form a government that can and will extinguish Hawaiians claims.


As long as Hawaiians don't bite on the bait, the hook is harmless.

Donʻt fall for the fake state Akaka bill.

3.     Demand a Traditional Cultural Place Study be done.
4.     Ask that  Burial council be allowed to approve, recomend, view the real preservation plan  Take back the illegal plan SHPD.
 
Iwikupuna are important
No plan for community input in Preserv. plan, no plan for upkeep.  Currently,  broken fences, no tarp, no skip, faded markers, exposed iwi  have been noted for 5 years.   A&B says that they monitor the sites regularly

Show Up to Stop the Purple Spot

Farming is Wai`anae's heritage. Since forever, this land has fed our people, engaged our youth, and sustained a strong community.

Yet, developers are still trying to force their industrial park on this land through the community planning process at the City level.  

If they get this farm designated with a purple spot on Wai`anae's community planning map, then they will be one step closer to re-zoning this farm for urban use and pocketing millions on this 200-acre land-flip. 

We know that urban sprawl like this industrial park is the death knell for farming communities. If ever there was a time Wai`anae farmers needed your kokua to defend their farming traditions, this is it. 

Each City Council member needs to hear from *their* constituents that we support keeping Wai`anae country. So show up!

This is the crucial vote in the decision whether to allow the ill-advised purple-colored industrial spot in the middle of the Lualualei agricultural district. Please show up to demonstrate your support for local farmers. 

Sign up to testify, click here.  The Council enforces a 3-minute limit on testimony.  This means we need lots of people to patch together a coherent message about why Wai`anae's agricultural heritage must be protected.  And your presence in the audience is as valuable as your speech. The Wai`anae Sustainable Community Plan is before the City Council for second reading.  It currently includes a 200-acre purple spot on the land that once supported the productive `Ainalani Farm in Lualualei and that the community has designated for farming, not development.
