SECRET TALKS DOOMED AKAKA BILL

USSenator Daniel Akaka was a sorry sight standing nearly alone on theSenate floor in the final hours of the 111th Congress, giving a speechblaming Republican obstruction for the failure yet again of his Akaka Bill for native Hawaiian political recognition.


Thistime, it was nobody's fault but his own; Akaka simply blew his bestchance ever to win Hawaiians sovereign rights similar to those ofAmerican Indians and Alaskan natives.


Aftereight years of being unable to overcome Bush administration oppositionand procedural delays by Senate Republicans, Akaka began this Congresswith a supportive Democratic president and Democratic majorities in theHouse and Senate, including a filibuster-proof 60 votes in the SenateDemocratic caucus.


Evenwhen the loss of the late Sen. Edward Kennedy's seat prevented Democratsfrom killing filibusters on their own, it wasn't a problem becauseHawaii's Republican Governor Linda Lingle supported the Akaka Bill andbrought along enough GOP votes to overcome procedural delays.


ThenAkaka snatched defeat from the jaws of victory. Instead of getting itdone while everything was in his favor, he wasted a year in secret talks with the White House and a narrow group of Hawaiian interests to drastically amend the bill from the version supporters had previously agreed to.


Inexplicably, Akaka kept Lingle in the dark on the changes, and she withdrew her support because of a significant weakening of the state's rights.


Then-USRepepresentative Neil Abercrombie shepherded the bill through the Housebefore he quit to run for governor, but the measure stalled in theSenate when its Republican backers pulled their support followingLingle's reversal.


Akakawasted more months before finally making the compromises necessary toget Lingle back on board. By then it was summer, and there was no wayhis relatively manini bill would get precious floor time in the heat ofthe election campaign or in the poisonous lame-duck session thatfollowed.


Akaka is againsinging his tired wait till next year tune, but the Akaka Bill is dead.If he couldn't get it passed in this favorable Congress, he has nochance next year when Republicans take over the House and gain eightseats in the Senate....

CHEERS WHEN AKAKA BILL DISAPPEARS

Opponentsof the Akaka Bill were happy the measure died when the Senate adjournedlast week, but supporters remain hopeful Congress will eventually pass ameasure that grants federal recognition for native Hawaiians...


...Leon Siu, minister of foreign affairs for an entity calling itself the Hawaiian Kingdom, said he is pleased the bill died.


"Itis a totally inadequate remedy for the wrongs committed against theHawaiian people and taking of the Hawaiian nation. ... If the bill hadpassed, it would have immersed us further in the U.S. system."


Hesaid the real remedy is to "extricate ourselves from the U.S. systemand to restore the sovereignty and independence of the Hawaiian nation."

From time to time we hear the comment, “If it weren’t for the US being here, Hawai`i would be vulnerable and likely taken over by another country anyway.”

Hau'oli La Ho'omaika'i ia kakou!

 

Today the Hawaiian Kingdom celebrates its national holiday, La Ho'omaika'i, Thanksgiving Day.  This is during the Makahiki season whereby we emphasize a period of peace, joy, love and happiness as opposed to war and strigent kapu.  Our kupuna knew we needed a "circuit-breaker" and what better time to do it than during the season of Lono. 
 
Christmas coincides with the Polynesian practice; so whether we celebrate Thanksgiving proclaimed by Kamehameha IV or the
Christians' traditional Christmas, all is in order of the day.  Peace on earth to men of good will!
 
Have a happy holiday season one and all!  Don't for get our next national holiday is Memorial Day on 30 December; a time to reflect on our loved ones who have departed from this world.

HOW DID HAWAIIANS BECOME OUTCASTS IN THEIR OWN LAND?

Here's What The History Books Won't Tell You -

Western diseases, to which Hawaiians had no immunity, decimated their numbers.
At the time of western contact, well over 500,000 people inhabited the
Hawaiian Islands.


By 1805 that number had been more than halved.


By 1853 there were only 71,000 Hawaiian or part-Hawaiian people in the islands.


Within 100 years of western contact, the Hawaiian population had been reduced by nearly 90 percent.


Accordingto the 2000 census, the numbers of people who claim some native
Hawaiian ancestry have increased to over 400,000. But only 239,000 live
in Hawai`i and they are the poorest, most locked-up population in the
state.


Although they onlymake up about 20 percent of the state's population, in June 2001 they
made up 39 percent of the state's prison population, according to the
state Department of Public Safety.


Sadly, today they make up 37 percent of the state's homeless population.

THEFT & FRAUD IN HAWAI`I

Maui News - November 23, 2010

Whenit comes to Hawai`i Kingdom sovereignty issues, the courts are like a mule with blinders. They are only allowed to see as far as what is legal under the state and federal constitutions. What is blocked from view is the "lawfulness" of the state of Hawai`i and its constitution.


Anyactions (the Organic Act and Statehood Act) which are subsequent to an act of fraud (the Newlands Resolution) have no more lawful authority then the initial act of fraud.

For instance, if your car isstolen, the theft isn't made legal by altering the title and doing a paint job before selling it. The fact remains, the car is stolen.


Congressoverstepped its lawful authority when it attempted to annex the Hawaiian Kingdom against the will of its people and government through the Newlands Resolution.

The theft of the Hawaiian Kingdom and alteration of the title was violation of international law.


The Organic Act (a new paint job coloring the title) was as unlawful as the initial theft. The Statehood Act(selling the car with unlawful title to the "state" of Hawai`i) did not make the initial theft lawful. It was simply one act of fraud piled upon two others.


As the Akaka Billattempts to gain forgiveness for the previous piles of fraud, the pile from the mule just gets deeper. It doesn't change the nature of the pile.


How does one force the mule to remove the blinders and see that the emperor has no clothes?

Demise of Akaka Bill‏ by Leon Siu

PhotobucketBelow are two recent commentaries I wrote pertaining to the demise of the Akaka bill.For those unfamiliar with this matter, the “Akaka Bill” was nicknamed after its chief sponsor Daniel K. Akaka, a US Senator from the “State of Hawaii.” The actual measure was titled, “The Native Hawaiian Government Reorganization Act of (insert year).” It was first introduced in 2000. The bill proposes to establish a process for indigenous Native Hawaiians to gain federal recognition similar to an (American) Indian tribe. Its purpose is to retroactively fix the legal faults inherent in the US claims of sovereign jurisdiction over the Hawaiian Islands.The major proponents of the Akaka Bill were: the State of Hawaii with all of its officials and agencies (including the Office of Hawaiian Affairs, the Department of Hawaiian Homes, etc.); US Congressional delegation; the US government; US President Barack Obama; the ethnic Hawaiian civic clubs; and Hawaiian-Americans (Hawaiians who consider themselves US citizens).The chief opponents have been: the Hawaiian independence movement (Hawaiian Nationals and sympathizers); progressive Americans; and conservative Americans. An odd, but effective combination. Motives? Hawaiian Nationals want their country back. Progressives want social justice and to embarrass the US establishment. Ironically, the fatal blow was struck a year ago by the impatient meddling of its main sponsors: Sen. Akaka, Sen. Inouye and Rep. Abercrombie. But it took 12 months for the bill to die. Here’s what happened. By mid-December, 2009, with the looming “health care reform act” as a smokescreen, Inouye had maneuvered the Akaka Bill into position for final passage by the US Congress before it adjourned for the Christmas holidays.  But in a classic case of jumping the gun, Akaka suddenly amended his bill, inadvertently revealing its sinister side — immediate assignment of Native Hawaiians into a limited-status racial group, to be governed like American Indian tribes.  This confirmed some of the worst fears opponents and proponents had about the Akaka tribal scheme. The Hawaiian Independence Action Alliance immediately mobilized a downtown rush-hour demonstration to sound the alarm: “Akaka Bill Sneak Attack!”  Exposure of the last minute tinkering took the State of Hawaii’s Governor and Attorney General by surprise, causing them to withdraw the State’s support of the bill. It also caught the Office of Hawaiian Affairs (OHA) off guard, causing their support for the bill to waver.  Without these two crucial supporters, the bill stalled.  It took two months to get OHA back on board so that Rep. Neal Abercrombie could get his version passed in the US House, claim victory, resign his US House seat and run for state governor. And it took an additional four months to get the State of Hawaii back on board. By then the US Congress was in a tumultuous, deadlocked summer session. Then came the Democrats’ election disaster in November, and now the lame-duck session.  As it turned out, the Akaka bill’s window of opportunity from a year ago had closed. Akaka/Inouye’s cocky tinkering of the bill in December of 2009 was a self-inflicted injury that proved to be fatal.  The blunder was Akaka-Inouye’s Humpty-Dumpty.  As much as they tried, they couldn’t put it together again. Mahalo nui to the 11-year-long vigilant and staunch resistance of Hawaii independence activists…true patriots, who with meager material resources but a lot of mana and heart, refused to accept Akaka’s sell-out, Native-American-tribe ‘solution’ to settle the crimes of treason against and piracy of our sovereign, independent nation. That means, even if by some miracle they were able to get Akaka passed in the US Senate in the next week, there is no time before the end of the year for the US House to reconcile it to their version and vote on it.But hold your horses! We just found out today that ol’ “earmarks” Inouye has put provisions for a “Native Hawaiian Study” (a.k.a. Akaka) into the ominous Omnibus Bill, which could be voted on this week.It seems, dead-ducks or dead-horses matter not to Inouye. The Akaka Bill died last Thursday evening in Washington, DC.

With the withdrawal in the US Senate of the Omnibus spending bill that day, Dan Inouye lost his last chance in this lame duck US Congress to keep it alive as an earmark “study” he had craftily snuck and buried deep in the Omnibus legislation.

Starting in January the republicans will control the US House of Representatives until at least 2013.

There will be no chance therefore that the US Congress will pass an Akaka bill.

Moreover, earmarks are now going the way of the dinosaur. Tricks that have allowed Dan Inouye to bend the rules in the US Congress for years are now considered political suicide and vanishing.

He knows this and is moving on, preparing other ways trying to achieve what the Akaka bill would have done, but with different methods.

Inouye Blasts Senators For Shelving Spending Bill


US Senator Daniel Inouye has chided his Senate colleagues for shelving an omnibus spending measure which contained an Akaka bill earmark hidden deep inside in favor of a short-term resolution keeping US federal expenditures at current levels.

In a US Senate floor speech yesterday, the Democratic chairman of the Appropriations Committee noted that Republicans who helped craft the 1,900-page bill ended up opposing it.

He said the measure was huge because it contains spending provisions that normally are in 12 separate bills.

He claimed US voters in November were not sending a message to eliminate earmarks.

VICTORY! - AKAKA BILL NOW DEAD!

Omnibus Spending Bill Pulled

The Omnibus Spending bill, which contained the Akaka bill earmark, is now dead.

The Akaka bill would have turned native Hawaiians into a US indian tribe, legitimized the illegal US takeover of the sovereign Hawaiian Kingdom over a century ago and sealed the theft by the US of Hawaiian lands.

US Senate majority leader Harry Reid pulled the bill completely from consideration last evening after thousands of people angrily called Capitol Hill from all across the US as well as Hawai`i and complained about the numerous earmarks in this fatally flawed bill.

The Inouye native Hawaiian Governing Entity earmark, as well as the Akaka bill itself is now dead and gone.

It might now begin to dawn on Inouye and Akaka not to mess with the people who love their land…

AKAKA BILL STUDY SNUCK INTO OMNIBUS SPENDING BILL

US Senator Daniel Inouye has snuck into the Omnibus spending bill an appropriation for study of native Hawaiian recognition.

The appropriation is related to his support for the Akaka bill, otherwise known as the Native Hawaiian Government Reorganization Act.


Opponents of the Akaka Bill and government transparency advocates are concerned that the study provides no vehicle for public involvement, testimony or legal analysis and instead appears to simply be a working group — conducted in secret, with no particular beginning or end.


One Congressional source remarked, “If Inouye wants it to be a meaningful study, then it needs to be structured in a way that truly grapples with the legal, policy, and cultural questions in an organized fashion.

"Perhaps he does not really want that and instead is just tossing this study into the bill as an admission of defeat. If he wants it to work, then this isn’t the best way of doing it.”

HAWAIIAN KINGDOM SUES U.S. OVER ILLEGAL OVERTHROW
