Hawaiian Kingdom Deposits Instrument of Accession to the Jurisdiction of the International Criminal Court with the United Nations Secretary-General in New York

NEW YORK, December 10, 2012 — This afternoon the Ambassador-at-large and Agent for the acting Government of the Hawaiian Kingdom, H.E. David Keanu Sai, Ph.D., filed with the United Nations Secretary General in New York an instrument of accession acceding to the jurisdiction of the International Criminal Court (ICC). The ICC is a permanent and independent tribunal in The Hague, Netherlands, that prosecutes individuals for genocide, crimes against humanity and war crimes. The ICC only prosecutes individuals and not States.

The instrument of accession was deposited with the United Nations Secretary-General in accordance with Article 125(3) of the ICC Rome Statute, which provides, “This Statute shall be open to accession by all States. Instruments of accession shall be deposited with the Secretary-General of the United Nations.” The instrument of accession was received and acknowledged by Mrs. Bernadette Mutirende of the United Nations Treaty Section, Office of Legal Affairs, at 380 Madison Avenue, New York.

By acceeding to the ICC Rome Statute, the Hawaiian Kingdom, as a State, accepted the exercise of the ICC’s jurisdiction over war crimes committed within its territory by its own nationals as well as war crimes committed by nationals of States that are not State Parties to the ICC Rome Statute, such as the United States of America. According to Article 13 of the ICC Rome Statute, the Court may exercise its jurisdiction if a situation is referred to the ICC’s Prosecutor by the Hawaiian Kingdom who is now a State Party by accession.

The current situation in the Hawaiian Islands arises out of the prolonged and illegal occupation of the entire territory of the Hawaiian Kingdom by the United States of America since the Spanish-American War on August 12, 1898, and the failure on the part of the United States of America to establish a direct system of administering the laws of the Hawaiian Kingdom. The United States disguised its occupation of the Hawaiian Kingdom as if a treaty of cession annexed the Hawaiian Islands. There is no treaty.

On August 10, 2012 a Protest and Demand of the prolonged occupation of the Hawaiian Kingdom, being a non-Member State of the United Nations, was deposited with the President of the United Nations General Assembly pursuant to Article 35(2) of the United Nations Charter. The Protest and Demand was acknowledged and received by Mrs. Hanifa Mezoui, Ph.D., Special Coordinator, Third Committee and Civil Society, Office of the President of the Sixty-Sixth Session of the General Assembly.

Individuals of the State of Hawai‘i government who have committed a war crime have been reported to the United States Pacific Command and the United Nations Human Rights Commission in Geneva, Switzerland, for deliberately denying a fair and regular trial to Defendants, irrespective of nationality, and with the Hawaiian Kingdom’s accession to the jurisdiction of the ICC, these alleged war criminals will now come under the prosecutorial authority of the Prosecutor of the ICC.

Regarding the occupation of Hawaiian territory, the ICC is authorized under the Rome Statute to prosecute individuals for:

   war crime of destruction and appropriation of property;

   war crime of denying a fair trial;

   war crime of unlawful deportation and transfer of persons to another State;

   war crime of unlawful confinement;

   the transfer, directly or indirectly, by the Occupying Power of parts of its own civilian population into the territory it occupies;

   war crime of destroying protected objects dedicated to religion, education, art, science or charitable purposes, historic monuments;

   war crime of destroying or seizing the property of the Occupied State;

   war crime of compelling participation in military operations;

   war crime of outrages upon personal dignity;

   war crime of displacing civilians.

H.E. David Keanu Sai, Ph.D. represented the acting Government of the Hawaiian Kingdom in arbitral proceedings before the Permanent Court of Arbitration, Larsen v. Hawaiian Kingdom, (119 International Law Reports 566), at The Hague, Netherlands, and also did an interview with South-South News, a news agencey of the United Nations, regarding the prolonged occupation of the Hawaiian Kingdom.

From Her Throne at 'Iolani Palace, was She to have the power to deport any enemy of Her monarchy ??
 
Was a pirate to have an inalienable right to stay in the Islands and make trouble ? Without the POWER to protect Herself, Reinstatement made no sense at all. A government without POWER is no government at all.

Have you noticed that the "independence" that some of the Reform- ists sell is a toothless Independence ?? An "independence" loaded with all kinds of "rights"; no sign of anything at all that even vaguely resembles a "power" ! The blackbirds have the "rights"; the pirates will take care of all the "powers". This was the deal that Grover Cleveland kept offering. This is the deal that the Reform- ists keep on offering the blackbirds TODAY. For a blackbird to entertain the notion of having the "Power to Deport" is pretentious and Unjust.

Where’s the “New Day” as Promised?

Group Prods Dept. of Health to Act

on Military Radiation at Pohakuloa

     A group of 2 dozen Big island residents, many wearing Hazmat type suits, dramatically urged the State Health     Department (DOH) to stop being bystanders and become pro-active advocates of public health over the issue of Military Depleted Uranium (DU) radiation contamination at the Pohakuloa Training Area (PTA). In a protest organized by Malu ‘Aina at the Hilo DOH Environmental Health Office, citizens prodded the DOH to follow the Hawaii County Council’s action call in Resolution 639-08 to stop all live-fire and other activities that create dust until there is a clean up of the uranium contamination at PTA. There were several signs with the well known radiation symbol. Other signs read “Test For Radiation; Why Uranium in Urine?; No More Radiation; Peace thru Poison?, Time to Aloha ‘Aina; Time to Mother Earth; DU equals Dirty Bomb, Sacred Mountains under Siege.” There was even the appearance of a well known Hilo resident, playing the role of Governor Neil Abercrombie.

      Jim Albertini, of Malu ‘Aina said “DOH action is needed to investigate what’s causing uranium showing up in Big island resident’s urine. Is it uranium weapons that have been fired at PTA or something else? Three MDs and a Naturopathic doctor have patients who have tested high for uranium in urine, including levels exceeding three times the upper expected limit.” Albertini said, “it’s likely that far more uranium weapons have been used at PTA than the 700 hundred or two thousand Davy Crockett DU spotting rounds from the 1960s. Comprehensive independent testing and monitoring is needed to determine the full extent of radiation contamination at PTA and other sites throughout Hawaii. The DOH should be offering free uranium urine tests for Big Island residents, especially people who work at PTA, or travel the Saddle Rd..”

     On Wednesday, Dec. 12th, there is a meeting between the Army and the U.S. Nuclear regulatory Commission (NRC) in Maryland (why not Hawaii) to discuss a possible license for the Army to possess DU in Hawaii. The meeting is from 10AM till 1PM Hawaii time. Citizens can call in toll-free at (877) 521-2306, pass code 8766359. Public questions will be taken at the end of the meeting. The DOH should be speaking out for public health and safety concerns at that meeting.

Many of you have expressed outrage at learning recently of the now not-so-secret plans of the Sovereign Councils  Of The Hawaiian Homelands Assembly (SCHHA,) the Council For Native Hawaiian Advancement (CNHA) and the Danners to attain US federal recognition by using the executive authority of US president Barack Obama.

If successful, this sneak scheme would classify Hawaiians as a US indian tribe without your input or approval.

Many of you have responded to ask what you can do to kokua.


As you are probably aware, this coming Tuesday, December 11th is investiture day for Office Of Hawaiian Affairs Trustees. It is on that day OHA trustees will be taking a vote to elect a chairperson.


It has been the direction of the present regime to not only recently fund the Native Hawaiian Roll with another two million of your beneficiary dollars, but also support the SCHHA and the CNHA in their endeavors. Clearly OHA needs to go in a new direction.


Sources have identified Trustee Robert Lindsey as the swing vote who on Tuesday, December 11th, can make this happen.


If you are fed up with the shenanigans at OHA - the wanton spending of beneficiary monies on things like the Native Hawaiian Roll and Kana`iolowalu, their support of the SCHHA and the CNHA, as well as their determined push for a US Indian-type "Native Hawaiian governing entity," now is your chance to do something.


Both call and email Trustee Robert Lindsey today. Tell him to do the pono thing and vote for change. Tell him not to cast his vote for the present regime. Tell him not to cave in to pressure from the current regime nor believe their promises.


Tell him to vote on Tuesday, December 11th for a new Chairperson.

DOES THE HAWAIIAN KINGDOM STILL EXIST?

 










Yes, the lawful, sovereign entity, the Hawaiian Kingdom, does still exist.
 

At no time did the Hawaiian Kingdom or Hawaiian nationals surrender their sovereignty or consent to a merger with the US.
 

There are only two ways a nation can be extinguished - conquest involving the military defeat and subjugation of its people, along with the physical seizure of its territory by the victor or the un-coerced, free-will choice of its people to surrender and merge their nation’s sovereignty to another.

Even the unconditional surrender of Japan and Germany after World War II, did not extinguish their sovereignty. They became occupied states but still retained their national identity.

They were still Japan and Germany and the occupying forces administered and enforced the laws of Japan and Germany respectively.
Despite the incorporation of the Eastern European states into the Soviet Union after World War II those countries did not extinguish their sovereignty.

And despite complete domination by the USSR during the “cold war,” when the Soviet Union collapsed in the early 1990s states like Lithuania, Estonia, Latvia, Czechoslovakia reemerged as sovereign and independent countries in continuity.


In the case of Hawai`i, after the illegal seizure and takeover, the status of Hawaiian Kingdom citizens remain inviolate.

Neither a vote or plebiscite was ever conducted to gain the consent of the Hawaiian people to dissolve their country, the Hawaiian Kingdom.

On the contrary, there was fierce opposition to the initial seizure and efforts at annexation, as evidenced by the massive petitions and protests in the press.


The Hawaiian Kingdom continues to exist. It did not expire. It survives even having been buried alive for over a century under the layers of US deception and fraud.

An abuse of democracy may be ahead as certain Native Hawaiian groups consider plans to bypass the majority of Hawai`i voters on the issue of whether the state of Hawai`i should be the venue for a race-based sovereign nation.


Three of the largest Native Hawaiian advocacy organizations have announced their intention to bring together their networks on Dec. 6, 2013, at the "Your Money-Your Land-Your Self Determination" convention. The agenda will include discussion of a role for the US federal government via the Department of the Interior in the establishment of a Native Hawaiians-only nation.


The organizations convening the gathering are the Council for Native Hawaiian Advancement, the Association of Hawaiians for Homestead Lands, and the Sovereign Councils of the Hawaiian Homeland Assembly.


Recently, the failed Akaka Bill was edited to bury its most controversial provision, which passed instead in Hawai`i as Act 195 of the 2011 Hawai`i Legislature. That act established the Native Hawaiian Roll Commission, which has begun a year-long project to enroll citizens for a nation consisting exclusively of individuals with Native Hawaiian blood.


The commission was also established to disqualify any Native Hawaiian applicant who has not "maintained a significant cultural, social, or civic connection to the Native Hawaiian community and wishes to participate in the organization of the Native Hawaiian governing entity."


This process is being overseen and financed by the Office of Hawaiian Affairs, a state agency.


Although the Native Hawaiian organizations are meeting ostensibly to improve homestead access for Native Hawaiians, OHA's and their use of Act 195 as the basis for political power is very un-Hawaiian.


The race-based criteria for citizenship, established by the Hawai`i Legislature and enforced by a state agency, is a departure from the inclusive practice of the historic Kingdom of Hawai`i.


From at least the enactment of the 1840 Hawaiian Constitution through the end of the reign of the Queen Liliuokalani in 1893, citizenship was available to non-Hawaiians and to Native Hawaiians without a subjective test of "significant cultural, social or civic connection."


Were they alive today, large numbers of Japanese, Caucasians, Chinese and others who were granted Hawaiian citizenship by Queen Liliuokalani, along with some Native Hawaiians, would be barred from citizenship in the nation being enrolled by Act 195.


Hawai`i voters should be alarmed and insist upon accountability by our elected representatives in the Legislature and at OHA for two reasons.


First, Act 195 is a racist affront to democracy and human rights and, as such, is very un-Hawaiian in its violation of historic Hawaiian practice and values.


OHA's trustees need to be reminded that they were elected to defend and preserve Hawaiian values, not to oppose them.

Second, involvement of the Department of Interior is an attempt to end-run the failure of the Akaka Bill in Congress through the assertion of presidential executive authority. 

Constitutionally, major peacetime laws are to be enforced, not created, by the executive branch. Hawai`i voters should, therefore, immediately call for a repeal of Act 195.

ABERCROMBIE SUPPORTER OPPOSES PLDC

Dear Governor Abercrombie,


I am writing to voice my strong support for repeal of Act 55 for establishment of the Public Land Development Corporation. I am not remotely hysterical, and I most definitely not one of the “usual suspects,” as you characterize opponents of the PLDC. 

I have never been overtly involved in an issue like this. I have been subtly involved in some issues, for instance, I wrote and recorded the music for the “Town Hall” campaign ads in your gubernatorial race, and I wrote a series of articles for the Honolulu Weekly regarding Act 221 related legislation a number of years ago. I have never, however, been an activist by any stretch of the imagination. This issue has moved me to become actively involved.


This legislation is dangerously written and could affect life in the islands in perpetuity. The PLDC is being handed carte blanche control to develop some of the most treasured lands in Hawai`i with no mechanism of accountability and only weak, toothless avenues for public input. 

The only responsibility of the PLDC is to generate revenue, which is a tragically short-sighted purview for a group tasked to steward public resources. In reading the law, I actually find no mention of accountability regarding even how lucrative revenue generation might be. There is certainly no provision for competitive bidding or planning review. At its core, Act 55 grants absolute authority to the PLDC to streamline any activity by any developer who can convince three of five appointed officials that they have a good idea, however they want to define “good idea.”


It is this massive scope of powers over a million acres of land that is most disturbing. The authority is absolute, and the law eliminates previous checks and controls, especially for neighbor islanders who lose any real mechanism for control of their lands and resources. 

Wording of the legislation is so vague that there is no onus on the PLDC to provide anything more than cursory notifications, and there is no recourse if the PLDC acts entirely against community interests. This sets several dangerous precedents, and there is no assurance that future governors will appoint boards with any interest at heart but that of developers. Indeed, the only beneficiaries of this act seem to be developers who are given a fast-tracked route to have their way with the land.


This measure passed quickly and was drastically rewritten without public input. I do not believe that even you or the legislators have thought this through thoroughly. Hawaiian Homesteads land is included, as well as many culturally and ecologically sensitive areas. 

The 1993 apology the 103rd Congress, Joint Resolution 19 regarding the overthrow of the Hawaiian Monarchy actually casts the entire issue of state control over these lands into some question, and irresponsible decisions will provide impetus and opportunity for litigation. These are federal issues that will supersede State legislation. An interminable string of legal challenges on many fronts will be your legacy if you allow this law to stand.


I am not an alarmist. I am, however, able to read and evaluate evidence, and what I see in this Act is not in the interest of the people or `aina of Hawai`i. 

We are asked to trust that the rules, when established, will protect us, but the PLDC is already in practical negotiation with developers and has an established track record for ignoring public input. The entire law was passed with an unusual disregard for public process. My distrust is so strong that I am now reluctantly moved to become involved.


Governor Abercrombie, I have been a quiet supporter of you for many years. I now must be vocal, and it pains me that I must find my voice in opposition to you on this issue. I and many like me who have had your back and given you our votes will not stand for this abuse of public resources and trust. 

I fear that this will be your Waterloo, because it is important enough that we will not forgive or forget if you let the law go into effect. I hope you will change your position on this quickly, before too much damage is done across your constituency. This is my first letter to a public official, but it will not be my last.

Massie Case Relived?

Whatever happened to the Christopher W. Deedy murder case who shot and killed defenseless Kollin Kealii Elderts?  Have they swept it under the rug; hoping we'd forget such blatant miscarriage of justice to protect this white-American from Arlington, Virginia? 

Deedy, a Federal Security Officer for the Bureau of Diplomatic Security under the U.S. State Department was here for the infamous  and notorious APEC takeover of Hawaii.  His primary duties included mconducting criminal investigations and working on personal protection details and escorting foreign dignitaries for the unpopular APEC.

 

Christopher W. Deedy was off-duty and out drinking with his friends and ended up at a MacDonald's in Waikiki when he confronted Kollin Kealii Elderts and as they argued, Deey pulled out is gun and shot Elderts who was unarmed.  A visitor who awoke in her hotel across the way from a sound of a gunshot, then heard three more shots fired.  One of Deedy's friends planted a knife on Eldrets to make it appear that it was in self defense.  Witnesses never saw Elderts with a knife when he was shot.

 

This all becomes reminiscent of the Massie Case who were convicted of murdering an innocent young Hawaiian man, spent an hour at the Territory of Hawaii  governor's office before boarding a luxury ship back to the United States of America.  That was the extent of their prison sentence.  Again the elite powers again have let Deedy of the hook for murder and allowed him to return as a free man to Virginia to await his trial in Hawaii if it ever comes about.

 

Once again, white-man's American justice prevails!

HOW WAS HAWAI`I ILLEGALLY TAKEN OVER?

USA covert and overt activities led to the invasion of the Hawaiian Kingdom and immediately recognized its complicitor's proclamation without the people's knowledge.

Without US military intervention and USA complicity, the USA puppet Provisional Government would not have lasted for more than an hour.

Using that backing, they created the Republic of Hawai`i against the people's wishes.

All legal attempts to annex Hawai`i to the USA failed because the people overwhelmly protested and sent their Ku'e Petitions to Washington D.C.

It was ignored by the pro-annexationists and complicitors.

In covering up the hoax, Congress passed the Newlands Resolution falsly declaring the majority wished for the annexation of Hawai`i without a lawful treaty.

That's how Hawai`i became unlawfully annexed even according to US laws.
