DID THE US STEAL HAWAI`I?

The United States claims it possesses the Hawaiian Islands. But the facts show that at no time did lawful title to the Hawaiian Islands actually transfer from the Hawaiian Kingdom to the US either directly or indirectly.

The thieves who stole the Hawaiian Kingdom “car” fenced it to the US, who has been driving it around as its own.


The takeover of the Hawaiian Kingdom violated the Hawaiian Constitution, the US Constitution and the Law of Nations.

According to the governing principles embodied in those documents, the only lawful means to peacefully change a government is by the consent of the people.

There was no consent of the people for the 1893 takeover, nor for the 1893 Provisional Government for Hawai`i, nor for the 1894 formation of the Republic of Hawai`i, nor for the 1898 Annexation to the US, which was not even legitimate according to US law.

And finally, the 1959 vote conferring “statehood” to Hawai`i was based upon the previous illegitimate acts and did not conform to the criteria or procedures required by international law under the United Nations Charter.

The “statehood” plebiscite constituted fraud and thus, “the state of Hawai`i” is an unlawful entity - a fake state.

WERE HAWAIIANS THE ONLY ONES WRONGED?

The forceful takeover of the Hawaiian Kingdom in 1893, adversely affected a country’s government, its lands and its citizens, not only the members of a single ethnic group.

It was the Hawaiian Kingdom — a nation — that was taken, not the aboriginal people — the kanaka maoli (what the US and the State of Hawai`i insist on calling, “Native Hawaiians.”)

Yes, kanaka maoli were harmed by the loss of their nation, but so were many non-aboriginal subject/citizens of the Hawaiian Kingdom: Asians, Caucasian, Polynesians and so forth.

This is a crucial point. When a nation is stolen, all the citizens of that nation are deprived of their country, not only the aboriginal people.


Both occupying governments, the US Federal and its puppet, the fake state of Hawai`i either assert or presume in their laws and policies, that the takeover of 1893 affected only “Native Hawaiians.”

By purposefully limiting their culpability to “Native Hawaiians,” the US carefully conceals the true scope of the problem, presenting it as a domestic, localized, racially defined problem, rather than the violation of the unalienable rights of the citizens of a recognized sovereign foreign nation.

OUTRAGE OVER HAWAI`I FAKE STATE "AKAKA BILL"

I find this proposed state Akaka bill, HB 1627 redundant, disingenuous, irrelevant and unnecessary. There are self-contradictions in its wording and a proposal for the state to create a pseudo-government is perplexing, to say the least, when statements claim the Kingdom of Hawaii still exists albeit under the U.S. belligerent occupation.

To usurp the Hawaiian Kingdom by creating a tribal goverrning entity to replace it, is repugnant to the international laws, US contstitutional laws, Hawaiian Kingdom laws and moral rights of its citizens.

This contentious Bill HB 1627 is a waste of time for the legislature and unnecessary expense to the taxpayer when it rubberstamps the failed federal Bill that this bill duplicates. We Hawai`i patriots do not subscribe to the racist U.S. WASP Manifest Destiny doctrines that this bill supports.

Many of us oppose this HB 1627 and urge you to do the same.

ISN'T HAWAI`I PART OF THE U.S.?

Hawai`i is not a part of the United States.

The truth is the current government, the “state of Hawai`i,” is a corporate construct of the United States that resulted from a series of unlawful acts stemming from the 1893 unlawful takeover of the recognized, peaceful, civil government of the Hawaiian Kingdom.

The government of the United States has twice officially acknowledged (in 1893 and again in 1993) that its participation in the takeover of a friendly, neutral nation was an unprovoked unlawful act of aggression.

Suppose someone stole your car, forged documents and sold it to someone else. Does that new “owner” own the car? Suppose the new “owner” gave it to someone else. Does that new “owner” own the car?

Now suppose the original thief confesses to the crime of how he unlawfully obtained (stole) the car. Who owns the car now? Is it the person most recently in possession of the car, or you, the person from whom it was initially stolen?

Of course, according to common sense and common law, the answer is - you. Since you never gave your consent, the title of the car never lawfully changed hands to anyone else.

You are still the lawful owner.

OFICE OF HAWAIIAN AFFAIRS LAND PLAN NOT LEGAL

Maui News - January 30, 2011

The Office of Hawaiian Affairs is "prepared to accept lands in lieu of cash to settle the long-festering ceded-lands issue."


The ceded lands were stolen without compensation and fraudulently conveyed without title from the thief (the republic of Hawai`i) to its collaborator (the United States).


The state of Hawai`i received stolen lands from the US government.

OHA aspires to acquire part of that stolen property to settle funding issues with the state. These funds would be spent attempting to subjugate the Hawaiian people as corporate fictions indigenous to the United States.


OHA and the state have no authority to negotiate away unrelinquished claims to lands they don't own. The unrelinquished claims are those of kanaka maoli, native Hawaiian, as a sovereign people over their national lands.


By unlawfully negotiating away the claims of kanaka maoli to their sovereign lands in exchange for part of those stolen lands, OHA would be in collusion with the US and the state of Hawai`i by creating an agreement between two or more persons to defraud a person of his rights by the forms of laws.


The land legacy of the state of Hawai`i and the United States in Hawaii is one of theft, fraud and genocide by triage. Finalizing the theft of Hawaii kingdom lands will not better the conditions of Native Hawaiians.


With no Akaka Bill, and federal recognition unlikely, what could be better than the potential promise of land to entice Native Hawaiians to join OHA's tribe?

HAWAI`I AT CROSSROADS - NEEDS INDEPENDENCE

Native Hawaiians moving forward with their government is an issue that needs widespread community discussion. I support a sovereign Hawai`i, but not based on race. The overthrown Kingdom of Hawai`i was not based on race, and I’m glad the federal government didn’t pass the Akaka Bill.


How can someone else allow you to be sovereign? Either you’re in charge of your own destiny or you are not. Did early settlers in America wait for Britain to pass a law to give them independence? No—they themselves declared independence from Britain.


Hawai`i is at a major crossroads right now—our infrastructure is aging, our landfills are overflowing and our resources are dwindling. We need to declare independence from Mainland practices that are not benefiting us and bargain with access to our land as a most isolated place on the planet. We are islanders who need to realize we cannot continue to live with a continental mentality....


...Leaders of Hawai‘i, please lead us to a future where we who actually live here determine our own fate and treasure our ancestral abilities to live in balance with the land and ocean....

Hawai`i had treaties with 25 world nations and had 96 legates and consuls throughout the world, including in the US.


But US covert and overt activities led to the 1893 invasion of the Hawaiian Kingdom and the US immediately recognized those who overthrew the kingdom without the people's knowledge.

Using that backing, they created the bogus "Republic of Hawai`i" against the people's wishes.

All legal attempts to annex Hawai`i to the US failed because the citizens of the Hawaiian Nation then overwhelmingly protested and sent their anti-annexation petitions to Washington, DC.

In covering up the hoax, Congress was forced to pass the Newlands Resolution declaring that the majority wished for the annexation of Hawai`i without a lawful treaty.

That's how Hawai`i became unlawfully annexed, and ultimately a fake state.

THEFT & FRAUD IN HAWAI`I

Whenit comes to Hawai`i Kingdom sovereignty issues, the courts are like a mule with blinders. They are only allowed to see as far as what is legal under the state and federal constitutions. What is blocked from view is the "lawfulness" of the state of Hawai`i and its constitution.


Anyactions (the Organic Act and Statehood Act) which are subsequent to an act of fraud (the Newlands Resolution) have no more lawful authority then the initial act of fraud.

For instance, if your car isstolen, the theft isn't made legal by altering the title and doing a paint job before selling it. The fact remains, the car is stolen.


Congressoverstepped its lawful authority when it attempted to annex the Hawaiian Kingdom against the will of its people and government through the Newlands Resolution.

The theft of the Hawaiian Kingdom and alteration of the title was violation of international law.


The Organic Act (a new paint job coloring the title) was as unlawful as the initial theft. The Statehood Act(selling the car with unlawful title to the "state" of Hawai`i) did not make the initial theft lawful. It was simply one act of fraud piled upon two others.


As the Akaka Billattempts to gain forgiveness for the previous piles of fraud, the pile from the mule just gets deeper. It doesn't change the nature of the pile.


How does one force the mule to remove the blinders and see that the emperor has no clothes?

Native Hawaiians, other Hawai`i residents and visitors gathered to celebrate Queen Liliuokalani's birthday yesterday with hula, mele and prayer on the grounds of `Iolani Palace.


Among others, the girls of Halau La Onohi Mai Haehae, dressed in lavender and white, performed hula and sang songs commemorating the queen, a composer herself of poetry and music, including "Aloha `Oe."

But a number of attendees solemnly walked through roughly 1,500 names handwritten on white placards that lined the lawn of `Iolani Palace yesterday, searching for ancestors who may have signed the 1897 petition against the annexation of Hawai`i to the United States.

The 1,500 names represent just a few of the more than 21,000 who signed the petition against annexation of Hawai`i in 1897.

The petition was retrieved from the U.S. National Archives to Hawai`i in 1997 by Noenoe Silva.


"It's significant because there was a segment of the population that believed annexation was wrong," said Kerry Yen, 56, of Mililani.

Yen was looking for his great-great-grandmother on his father's side, Jane Buckle Clark, who served as a lady-in-waiting to the queen and was imprisoned with her at `Iolani Palace for at least one night. "She was in prison up there," he said, pointing to the palace.

Pomaikai Kinney, 71, said he discovered the first of three relatives' names among the thousands of signatures when a copy of the petition opened up to the page containing R. Kinney, whom he believed to be his great-great granduncle Raymond Kinney.

"My legs just wobbled," he said. "The name was just looking at me."


"What is significant to me is that William A. Kinney tried the queen for treason, so when I saw this book, I said, 'Well at least not all the Kinneys went against the queen.'"

"A lot of people don't know what this meant," he said.

He pointed out that many of the names are not only Hawaiians, but also non-Hawaiians.

About 600 names were first displayed on Presidents Day this year at McKinley High School. Then 1,100 names were displayed at `Iolani Palace on Kamehameha Day, June 12. On July 31, a third display was set up for Sovereignty Day.

A small group, with the aid of U.S. military, overthrew the Hawaiian kingdom in 1893 during the reign of Queen Lili`uokalani.

The petition was later delivered to the U.S. Senate in 1897, while Lili`uokalani was in Washington.


Luwella Leonardi, 62, of Waimanalo said her ancestor, Alexander Auld, was part of a Hawaii delegation that hand-delivered the petition to Washington, D.C.


Leonardi has been participating in the queen's birthday celebrations since 1992, when she, as a University of Hawai`i student, would sit with other students at the corner of the palace under the queen's bedroom and "sing to her all night."

She said her grandmother, Tutu Keleileki, was a seamstress for the queen, and that the queen would stop at their home in Maunawili where she would bathe at a swimming hole.

Leonardi took part in writing the names on the placards, saying, "We were emotional just writing the names," adding, "we could just imagine" what they were feeling as they signed the petition...

Opponentsof the Akaka Bill were happy the measure died when the Senate adjournedlast week, but supporters remain hopeful Congress will eventually pass ameasure that grants federal recognition for native Hawaiians...


...Leon Siu, minister of foreign affairs for an entity calling itself the Hawaiian Kingdom, said he is pleased the bill died.


"Itis a totally inadequate remedy for the wrongs committed against theHawaiian people and taking of the Hawaiian nation. ... If the bill hadpassed, it would have immersed us further in the U.S. system."


Hesaid the real remedy is to "extricate ourselves from the U.S. systemand to restore the sovereignty and independence of the Hawaiian nation."

HAWAIIANS STRUGGLE TO OVERCOME LONG SAD HISTORY

...The deterioration of a once-proud and strong race of people began with the arrival of Captain James Cook in 1778 and continues to this day.

With the arrival of James Cook more than 200 years ago, the genocide of a race began. From a population of between 600,000 to 800,000 in 1778, by the 1850s (in less than 75 years), the population of Hawaiians was reduced to approximately 50,000 people. Thus the "put down" of Hawaiians began.


By 1822, in less than 45 years, upon the arrival of the missionaries, the "put down" of our religion, language, culture, system of governance, and land tenure began. And by 1848, in less than 26 years, with the so-called "Great Mahele of 1848," began the alienation of ownership of lands of the kingdom to non-Hawaiians.

Then in 1854, in less than six years, upon the adoption of the "Bayonet Constitution" by the new republic, Hawaiians were effectively denied the vote in this new democracy. Through the subsequent passage of various pieces of legislation by this new democratic government, lands belonging to Hawaiians and their alii were gradually being stripped away.


By 1893, in less than 30 years, the hunger for land and money by the colonists, the Hawaiian kingdom and independent nation of people with treaties with the great countries of the world, including the United States, was overthrown by the new republic and thus accelerated the "put down" of Hawaiians.

The annexation of Hawai`i by the United States in 1898 was the "icing on the cake...."

WHAT DO HAWAI`I NATIONALS WANT ?








What They Say About Their Country & The US -


"The most common sense thing is for total independence.

We were a progressive modern nation of our time and recognized as a friendly, neutral nation within the Family of Nations, the predecessor of the League of Nations and the United Nations.

We had a democratic form of government, a constitutional monarchy with a bicameral legislative assembly.

The works and legacies of our monarchs are legendary and noteworthy.

Today under the illegally occupied American system, we are concerned about our lands, culture, people and lifestyle which has been under attack for over a hundred years.

The Kingdom of Hawai`i is not only Native Hawaiians but subjects of non-Hawaiian blood who were legitimate subjects of the Kingdom.

This racial argument is an American thing and not Hawaiian.

So our concerns are well within our scope to protect all subjects of the Kingdom.

We do expect reparations and restitution from the US for the injurious damages to our nation, land and people.

The US government is well aware of this and is attempting a piecemeal settlement through the Akaka bill.

If the tables were turned around; which would you do? I'm sure it wouldn't be a hard decision.

Remember, Hawaiians never hated America.

We were never afraid that another country would take us over; we had over twenty-four treaties with various countries but the US is the only country that broke their treaties with us."

In the process of offering independence to its territories, the US needs to admit to its 1959 deception and allow a fresh chance for Hawai`i to exercise self-determination.


Without much fanfare, the U.S. has been conducting educational campaigns in the “US territories” of American Samoa, Guam, Puerto Rico and the US Virgin Islands, to inform the people about the options they have with regard to the future governance of their territories. Among the options being offered is independence.


Is this opportunity being offered to Hawai`i also? Apparently no. So why not?...

SCHOLARLY LAW JOURNAL PANS AKAKA BILL











The Asian-Pacific Law & Policy Journal, published by the William S. Richardson School of Law at the University of Hawai`i has just published a new analysis of the Akaka Bill.


Here's an excerpt from their conclusion -


"The Akaka bill is novel in that it is the first Congressional attempt to federally recognize a non-Indian entity, and to do so in a fashion inconsistent with the political history of the former governing entity it is ostensibly recognizing.

Under a different view, the Akaka bill is novel in that it endeavors to federally recognize a government to collectively represent an entire ethnic group based upon shared indigeneity, rather than political history. But political history, not indegeneity, begets federal recognition.

As a result the Akaka bill faces invalidation because its political-historical inconsistencies – most of all with regard to who is Hawaiian – raise a number of cognizable legal issues potentially fatal to the bill...."
