The United States claims it possesses the Hawaiian Islands. But the facts show that at no time did lawful title to the Hawaiian Islands actually transfer from the Hawaiian Kingdom to the US either directly or indirectly.

The thieves who stole the Hawaiian Kingdom “car” fenced it to the US, who has been driving it around as its own.


The takeover of the Hawaiian Kingdom violated the Hawaiian Constitution, the US Constitution and the Law of Nations.

According to the governing principles embodied in those documents, the only lawful means to peacefully change a government is by the consent of the people.

There was no consent of the people for the 1893 takeover, nor for the 1893 Provisional Government for Hawai`i, nor for the 1894 formation of the Republic of Hawai`i, nor for the 1898 Annexation to the US, which was not even legitimate according to US law.

And finally, the 1959 vote conferring “statehood” to Hawai`i was based upon the previous illegitimate acts and did not conform to the criteria or procedures required by international law under the United Nations Charter.

The “statehood” plebiscite constituted fraud and thus, “the state of Hawai`i” is an unlawful entity - a fake state.

There's no need to create a new government when a perfectly good and lawful one — the Hawaiian Kingdom — continues to exist.

Although it has been greatly impaired by unlawful suppression and layers of fraud, the sovereignty of the Hawaiian Kingdom was never lawfully extinguished.

Therefore, there is no justification to contrive a new government to replace the Hawaiian Kingdom unless the people, the lawful subjects/citizens, called Hawaiian Nationals, decide they want to alter or change their government.

No one other than Hawaiian Nationals can make that determination — not the US government or foreign US citizens residing in Hawai`i, or the fake State of Hawai`i, the Office of Hawaiian Affairs, or the Akaka Bill’s proposed phony Native Hawaiian Governing Entity.

Because the Hawaiian Kingdom is in continuity, there is no lawful way to alter or replace that existing government except through the processes provided in the existing lawful constitution of the Hawaiian Kingdom.

Prior to the Hawaiian Kingdom being taken over by insurgents during the illegal US invasion in 1893, Hawai`i had already been functioning for decades as a nation-state under one of the best constitutions in the world.

The United States’ prolonged occupation does not change the fact that the constitutional government of the Hawaiian Kingdom, the one in place from 1840 to 1893, is still the one and only lawful and indisputable government for the Hawaiian Islands.

The United States is a usurper, and has no lawful jurisdiction in Hawai`i.


Since the Hawaiian Kingdom was never extinguished, its constitution, laws, statutes and policies are still intact.

WHAT DOES HAWAI`IʻS MOTTO REALLY MEAN?

Most people in Hawai`i have heard of or are familiar with the state motto, "Ua mau ke ea o ka `āina i ka pono." Today, many translate it as "the life of the land is perpetuated in righteousness."


But how many truly know its meaning or origin? As Americans celebrate their independence from Britain, a deeper look at this commonly used phrase provides invaluable insight into the differences between the American and Hawaiian understandings of independence and sovereignty.


On July 31, 1843, after the nation of Hawai`i regained its independence from Britain through stealth diplomacy, King Kamehameha III, Kauikeaouli, said to his people, "Ua mau ke ea o ka `āina i ka pono." So in that context, ea did not mean "life"; it meant "sovereignty." That's why July 31 is known and celebrated as "Sovereignty Restoration Day."


But Kauikeaouli was not referring merely to individual, personal sovereignty. It was sovereignty of the `āina, of which we the people are a part.


`Aina carries significant meaning and encompasses much more than just "land." Translated as "that which feeds," `āina captures a relationship people had and have with this land, ka pae `āina o Hawai`i.


For example, after the illegal overthrow of Queen Liliu`okalani, loyalists to the queen and patriots of the Hawaiian Kingdom called each other aloha `āina. On Sept. 6, 1897, James Kaulia, president of the Hui Aloha `Aina, said to the maka`āinana gathered - "Do not be afraid, be steadfast in aloha for your land and be united in thought. Protest forever the annexation of Hawai`i until the very last aloha `āina!"


To Hawaiians of 1843 and of today, freedom and independence are not about individual "unalienable" rights vested in "all men" by the Creator.


Independence of the individual was permanently woven into the fabric of `āina, our relationship to our lands, resources, and to our one hānau, the sands of our birth.


This concept of sovereignty and `āina developed over 2,000 years of living in these islands and supporting, cultivating and living on the land — to ensure that together they could feed a people, a lāhui, in one of the most physically isolated places on Earth. It is continued in part in our "traditional and customary" practices we continue to fight for, engage in, and protect today.

Some people in Hawai`i hear the word sovereignty and independence and immediately fear exclusion. Perhaps they are envisioning a Honolulu Tea Party, complete with natives throwing prized belongings off of Matson containers, or haole being sent to the continent like so many defeated and dejected redcoat soldiers.

These are unfortunate, misplaced reactions to a very sophisticated sense and state of being that has been marginalized through a western paradigm which misses the mark.

Indeed, the Hawaiian belief that life, independence and governance are intertwined within `āina stands in stark contrast to the stated ideals that support America's independence, wherein the rights of "Life, Liberty and the pursuit of Happiness" are secured by "Governments … instituted among Men, deriving their just powers from the consent of the governed."


Understanding sovereignty on our terms, not America's, is to understand that sovereignty is not based on independence for some individuals at the expense of others. It is sovereignty for our `āina, which includes land, people, and the reciprocal relationships between them that in turn gives us life, liberty, and true happiness.


So, "ua mau ke ea o ka `āina i ka pono." Ua mau — it has been continued, perpetuated. Ke ea — the sovereignty, independence. O ka `āina — our lands, our people, our resources and the traditions and practices that enable us to feed each other. I ka pono — in justice. In righting a wrong.


We are still waiting. The `āina is still waiting …

Tomorrow is La Ho`iho`i Ea - Sovereignty Restoration day in Hawai`i.

It was a wrong made right after five months - the restoration of the Hawaiian Kingdom when forced under British rule in 1843.


In the early 1840s, during the reign of King Kamehameha III, English consul Richard Charlton made outrageous land claims against the Hawaiian people to provoke a British takeover.

At his request, a British war cruiser arrived on Feb. 10, 1843, under the command of Lord George Paulet, who demanded special lands and rights from the king for British subjects.

In order to avoid bloodshed, Kamehameha III ceded his kingdom to Paulet under protest and appealed to Queen Victoria for redress.

British fleet commander Adm. Richard Thomas, enforcing his country's policy that the laws and customs of native governments be treated with courtesy and respect, sailed from Mexico to Hawai`i to remedy the trouble.

On July 31, 1843, Thomas ordered the Hawaiian flag raised and the kingdom restored at a ceremony at Kulaokahu`a - which today is known as Thomas Square named after him.

Kamehameha III proclaimed a 10-day holiday, and throughout his reign, July 31 was celebrated as La Ho'iho'i Ea or Sovereignty Restoration Day.

He also proclaimed the now famous motto, "Ua mau ke ea o ka `aina i ka pono," which means, "The sovereignty of the land is maintained by right behavior."

DOES THE HAWAIIAN KINGDOM STILL EXIST?

Yes, the lawful, sovereign entity, the Hawaiian Kingdom, does still exist.

There are only two ways a nation can be extinguished - either through conquest - involving the military defeat and subjugation of its people, along with the physical seizure of its territory by the victor; or by consent - the un-coerced, free-will choice of its people to surrender and merge their nation’s sovereignty to another.

Even the unconditional surrender of Japan and Germany after World War II, did not extinguish their sovereignty.

They became occupied states but still retained their national identity. They were still Japan and Germany and the occupying forces administered and enforced the laws of Japan and Germany respectively.

Despite the incorporation of the Eastern European states into the Soviet Union after World War II did not extinguish their sovereignty.

Despite complete domination by the USSR during the “cold war,” when the Soviet Union collapsed in the early 1990s states like Lithuania, Estonia, Latvia, Czechoslovakia reemerged as sovereign and independent countries in continuity.


In the case of Hawai`i, after the illegal seizure and annexation, the status of the Hawaiian people (referring to nationals, not aboriginals) remained inviolate.

Neither a vote or plebiscite was ever conducted to gain the consent of the Hawaiian people to dissolve their country, the Hawaiian Kingdom. At no time did the Hawaiian Kingdom or Hawaiian nationals surrender their sovereignty or consent to a merger with the US.

On the contrary, there was fiercely vociferous opposition to the initial seizure and both efforts at annexation, as evidenced by the massive petitions and the prodigious protests in the press.


The Hawaiian Kingdom continues to exist. It did not expire. It survives even having been buried alive for over a century under the layers of US deception and fraud.

4TH OF JULY THEFT OF HAWAI`I'S INDEPENDENCE

With Bible on hand, pistols in their pockets and troops at the ready, men gathered on the steps of `Iolani Palace on July 4th, 1894. Invoking the name of American liberty, they dismantled the liberty of the people of the Hawaiian nation.

Two separate camps divided Hawai`i's political environment. One, a small minority, held the power of government through the landing of the US military. The second, Hawaiian loyalists, supported their Hawaiian Queen Lili`uokalani.

The first camp wanted annexation of Hawai`i to the US, part of a larger plan to open their sugar to US markets. They sided with American expansionists like John Stevens, US Minister to Hawai`i.

The Hawaiian citizens, according to US special investigator James Blount, were almost to the man, in opposition to annexation.

US troops landed on January 16, 1893, and supported a self-proclaimed “provisional government” the next day.

A hurriedly drafted annexation treaty was sent to the US Senate in February for ratification under Harrison’s administration.

But Grover Cleveland, inaugurated President in March, sent Blount to investigate this Hawaiian affair. Given Blount’s report, Cleveland railed against US conspiracy and withdrew the treaty in December.

Sanford Dole, President of the "provisional" government, was criticized for the PG’s lack of legitimacy. He assembled a convention of 37 delegates, 19 appointed by him, the remainder elected by those who disavowed loyalty to Lili`uokalani and swore allegiance to the provisional government.

Using as their backdrop, the US Independence day celebration, Dole’s group assembled at `Iolani Palace at 8:00 AM, July 4, 1894.

With guns tucked out of public sight, William O. Smith, one of the early conspirators of the group acted as master of ceremony.

Dispensing with the opening prayer, apparently skittish over the proceedings taking place, Smith introduced Dole. Dole, looking down upon their members, proclaimed “the Republic of Hawai`i as the sovereign authority over and throughout the Hawaiian Islands.”

He went on, “And I declare the Constitution framed and adopted by the Constitutional Convention of 1894 to be the constitution and the supreme law of the Republic of Hawai`i, and by virtue of this constitution I now assume the office and authority of president thereof.”

The constitution declared all Lili`uokalani’s government’s lands, waters and citizens as those of the Republic.

While framing their activities around the American principle that the right of governance can be only achieved thru the consent of the governed, the Republic of Hawai`i was declared in just the opposite manner.

No ratification or any consent was given the Republic by Hawaiians.


Hawaiian nationals never consented to any change.

Maui News - April 2, 2011

WAILUKU - Maui County Council members gave unanimous support Friday for a move in the state Legislature to convene a panel to probe two executive agreements related to the 1893 overthrow of the Hawaiian monarchy.


Council Member Elle Cochran, who initiated county support of state House Concurrent Resolution 107, said the council action does not commit it to a position on the matter but does support the intent to gather more information.


The resolution was introduced in the state Legislature by state Rep. Mele Carroll, who represents residents of East Maui, Molokai and Lanai. It would establish "a joint legislative committee to investigate the status of executive agreements known as the Lili`uokalani Assignment and the Agreement of Restoration."


According to the resolution, one document provided for Queen Lili`uokalani, under protest, to temporarily yield her authority to the government of the United States to avoid bloodshed. A second document, or agreement, provided that Lili`uokalani would provide amnesty to those who overthrew her government.


The resolution says that "President Cleveland and his successors in office have violated these agreements by not administering Hawaiian Kingdom law and not restoring the Hawaiian Kingdom government."


State House members approved the resolution Thursday.

The issue in the Kingdom of Tonga is not over Hawaiian Kingdom passports, rather it is over Hawaiian Kingdom visas.

A visa is official permission from the receiving country allowing a visitor to enter the country and stay for a proscribed period of time.

The visa is usually verified by a stamp placed in the visitor’s own passport. It is the visa stamp, and the unauthorized selling of visa stamps (not passports) that is at the crux of the controversy in Tonga.


A passport is issued to a citizen of a country to allow him to travel to other countries, some of which require visas as well as the passport. The Hawaiian Kingdom passport is only issued to Hawaiian Kingdom nationals (citizens). It is not for returning home to the Hawaiian Kingdom, it is for entry into foreign countries.

The passport validates the bearer as a Hawaiian Kingdom national traveling under the protection of international treaties and laws. It is meant to function just like other passports being carried by other nationals.


Specifically, the controversy in Tonga is that someone is selling Hawaiian Kingdom visas as a means to enter the United States.

The visas are being offered by the Ministry of Foreign Affairs of the Hawaiian Kingdom initially to certain subjects (diplomats and royalty) of the Kingdom of Tonga to enter the Hawaiian Kingdom.

First, the government of the Hawaiian Kingdom gave no one in Hawaii or in Tonga authorization to sell visas. This initial visas issued by the Hawaiian Kingdom are free of charge.

Second, the Hawaiian Kingdom does not claim that these visas can be used for entry into the United States of America. A visa issued by the Hawaiian Kingdom only allows a person to enter the Hawaiian Kingdom, and no other foreign country such as the United States.

By issuing documentation for those who enter as visitors, the government of the Hawaiian Kingdom endeavors to assert its right to control its borders, that have been so seriously breached by a century of illegal aliens (mostly Americans) entering and taking up residence in the Hawaiian Kingdom.

That's how Hawai`i became unlawfully annexed, and ultimately a fake state.

Pacific Islands Report - May 24, 2011

The Ministry of Foreign Affairs of the Hawaiian Kingdom deeply regrets the recent confusion and controversy caused by the Hawaiian Kingdom visas in the Kingdom of Tonga referenced in the Pacific Islands Report story of May 24, 2011.


The Hawaiian Kingdom visas are genuine and authorized by the Hawaiian Kingdom government in keeping with international law. However, the government of the Hawaiian Kingdom disavows any involvement in the scheme referenced in the Taimi story.


First, the Hawaiian Kingdom does not sell visas. Second, the Hawaiian Kingdom does not claim that these visas can be used for entry into the United States of America. A visa issued by the Hawaiian Kingdom is free of charge, and only allows a person to enter the Hawaiian Kingdom, and no other foreign country such as the United States.


By issuing documentation for those within its borders and those who enter as visitors, the government of the Hawaiian Kingdom endeavors to address the problem of so many aliens illegally entering and taking up residence in the Hawaiian Kingdom.


The Hawaiian Kingdom is a sovereign, independent kingdom in continuity since at least 1810. However, currently the territory of the Hawaiian Kingdom has been under prolonged occupation by the United States (since 1898).


This confusion over visas arises because the United States government, after admitting in essence that it wrongfully occupies Hawai`i, still refuses to vacate Hawai`i and continues to violate international law by maintaining its superimposed rulership over Hawai`i.

Thus, in the Hawaiian Islands there exist two concurrent jurisdictions: one lawful (the Hawaiian Kingdom); and one not lawful (USA.)


The US Embassy in Suva claims the Hawaiian Kingdom visa is not valid for entry into the US. The embassy is correct! But we never said our visas were US visas. We are saying our visa is valid for entry into the Hawaiian Kingdom. Apparently it is the US embassy that doesn’t understand the difference.


We contend that in reality, it is the United States that is engaged in trafficking and profiteering in visas by forcing Tongans and other South Pacific islanders to bear the high costs to travel to the US embassy in Suva, Fiji to apply for US visas (which may or may not be forthcoming).

We also point out that it is the United States government who is insisting on using our country as an entry point into the US, without our permission; and it is the United States government who is brazenly acting as the bully toll-gate-keeper refusing entry to those wishing to enter the Hawaiian Kingdom.

There's no need to create a new government when a perfectly good and lawful one — the Hawaiian Kingdom — continues to exist.

Although it has been greatly impaired by unlawful suppression and layers of fraud, the sovereignty of the Hawaiian Kingdom was never lawfully extinguished.

Therefore, there is no justification to contrive a new government to replace the Hawaiian Kingdom unless the people, the lawful subjects/citizens, called Hawaiian Nationals, decide they want to alter or change their government.

No one other than Hawaiian Nationals can make that determination — not the US government or foreign US citizens residing in Hawai`i, or the fake State of Hawai`i, the Office of Hawaiian Affairs, or the Akaka Bill’s proposed phony Native Hawaiian Governing Entity.

Because the Hawaiian Kingdom is in continuity, there is no lawful way to alter or replace that existing government except through the processes provided in the existing lawful constitution of the Hawaiian Kingdom.

Prior to the Hawaiian Kingdom being taken over by insurgents during the illegal US invasion in 1893, Hawai`i had already been functioning for decades as a nation-state under one of the best constitutions in the world.

The United States’ prolonged occupation does not change the fact that the constitutional government of the Hawaiian Kingdom, the one in place from 1840 to 1893, is still the one and only lawful and indisputable government for the Hawaiian Islands.

The United States is a usurper, and has no lawful jurisdiction in Hawai`i.


Since the Hawaiian Kingdom was never extinguished, its constitution, laws, statutes and policies are still intact.

WHAT DO HAWAI`I NATIONALS WANT ?

"The most common sense thing is for total independence.

We were a progressive modern nation of our time and recognized as a friendly, neutral nation within the Family of Nations, the predecessor of the League of Nations and the United Nations.

We had a democratic form of government, a constitutional monarchy with a bicameral legislative assembly.

The works and legacies of our monarchs are legendary and noteworthy.

Today under the illegally occupied American system, we are concerned about our lands, culture, people and lifestyle which has been under attack for over a hundred years.

The Kingdom of Hawai`i is not only Native Hawaiians but subjects of non-Hawaiian blood who were legitimate subjects of the Kingdom.

This racial argument is an American thing and not Hawaiian.

So our concerns are well within our scope to protect all subjects of the Kingdom.

We do expect reparations and restitution from the US for the injurious damages to our nation, land and people.

The US government is well aware of this and is attempting a piecemeal settlement through the Akaka bill.

If the tables were turned around; which would you do? I'm sure it wouldn't be a hard decision.

Remember, Hawaiians never hated America.

We were never afraid that another country would take us over; we had over twenty-four treaties with various countries but the US is the only country that broke their treaties with us."

FAKE STATE AKAKA BILL FULL OF HOLES

The Hawai`i fake state Akaka bill, SB.1520 does not address the real issue of the theft of the Hawaiian nation and the injuries that stem from that.


It also has numerous inaccuracies, inconsistencies and plain mistakes making it impossible to imagine how this could seriously provide any remedy.

These flaws stem from a portrayal of history that leave out crucial information about who has title and jurisdiction.

The “findings” section of the bill leaves a gaping 27-year historical hole (from 1893-
1920) apparently to avoid mentioning the illegal processes used by the United States to capture the Hawaiian Islands.

The “findings” jump from 1893 with the Hawaiian Kingdom operating as a fully recognized treaty nation, to the Hawaiian Homes Commission Act of 1920 where the term “Native Hawaiian” enters the legal lexicon defined as a person having 50% of more aboriginal blood. What happened in between?

It boils down to this - You cannot “cede” lands you do not own. You cannot transfer
jurisdiction you do not have. Therefore, the “state of Hawai`i,” having no lawful lands or jurisdiction, cannot go forward with this Akaka-like, “Native Hawaiian (or First Nation) government Reorganization” scheme proposed by SB1520.

Even if the state of Hawai`i was lawful and it did possess “ceded” lands, it does not have the constitutional authority (either US or state) to carve off a section of itself and spin it off as an autonomous governing body.

No matter how you clone it, S.1520 is bad law.
