A UN special rapporteur has called for the US to restore tribal lands, including the Black Hills of South Dakota, site of Mount Rushmore.

James Anaya announced the recommendation at the end of a 12-day tour, during which he met tribal leaders and government officials.

"The sense of loss, alienation and indignity is pervasive throughout Indian Country," Mr Anaya said.

He met with tribes in seven states on reservations and in urban areas.

The trip, Mr Anaya's first tour of Native American lands, was to determine how the United States is faring on the UN Declaration on the Rights of Indigenous Peoples.

President Barack Obama endorsed the declaration in 2010, reversing a previous US vote against it.

Mr Anaya used the Black Hills, located in South Dakota near reservations that are home to the Oglala Sioux tribes, as an example of land restoration.

"I'm talking about restoring to indigenous peoples what obviously they're entitled to and they have a legitimate claim to in a way that is not divisive but restorative," he said.

The Black Hills are public land but are considered sacred by the Sioux tribes. The area, as well as other lands, were set aside for the tribes in an 1868 treaty.

Nine years later, Congress passed a law taking the land.

The Sioux refused to accept a 1980 monetary award from the US Supreme Court, calling for the return of the Black Hills.

The reservations near the Black Hills are some of the most poverty-stricken areas in the US, with extremely high rates of unemployment and much lower than average life expectancy.

Mr Anaya cited ongoing systemic and individual racial discrimination as common themes in his discussions with community leaders.

He said ideas that native populations were gone, wanted handouts or that their culture has been reduced to casinos were "flatly wrong".

Mr Anaya will make formal recommendations in a report to be released in September.

The UN fact-finder said he had met members of the Obama administration and briefed the Senate Committee on Indian Affairs, but was unable to meet individuals members of Congress.

He said that he typically meets individual legislators during his tours of countries but said he did not know the reason why that had not happened in the US.

More than 100 years after the overthrow of the Hawaiian Kingdom government, the rights of the island's indigenous people are still at the top of the conversation.

But voters are split on whether the US government is providing enough benefits to native Hawaiians.

According to a poll survey of 1,162 registered voters1, 36 percent of respondents said the level of benefits is just right. Twenty-seven percent of voters said Hawaiians get "too many" benefits and 23 percent said "not enough." The margin of error was 2.9 percent.












The poll was conducted in mid-April and comes on the heels of the Hawaii Legislature settling a decades-old $200 million ceded land debt by deeding 25 acres of prime Kakaako real estate to the Office of Hawaiian Affairs....

Frustrated with a 10-year congressional fight to obtain federal recognition and form a nation-within-a-nation government, the Office of Hawaiian Affairs has decided to follow a path that has led several American Indian tribes to success.


OHA is not giving up on the Native Hawaiian Government Reorganization Act, known as the Akaka bill.


But faced with the reality that U.S. Sen. Daniel Akaka, for whom the bill is named, is retiring after this year and that the political environment in Washington, D.C., is as polarized as it has ever been, OHA and Hawaii's delegation having been exploring other routes.


One of those would bypass Congress altogether and seek recognition from the U.S. Department of the Interior, a process used by Native American tribes....

In the process of offering independence to its territories, the US needs to admit to its 1959 deception and allow a fresh chance for Hawai`i to exercise self-determination.


Without much fanfare, the U.S. has been conducting educational campaigns in the “US territories” of American Samoa, Guam, Puerto Rico and the US Virgin Islands, to inform the people about the options they have with regard to the future governance of their territories. Among the options being offered is independence.


Is this opportunity being offered to Hawai`i also? Apparently no. So why not?...

AKAKA BILL WILL DIVIDE HAWAIIANS

Honolulu Star-Advertiser - July 9, 2010

The amendments to the Akaka Bill are ludicrous. Under the amended version, Hawaiians have no control of their national lands or natural resources and they cannot challenge the United States for the illegal overthrow of the Kingdom of Hawai`i during 1893.


Hawaiians had better read the updated version of HR.2314 and object to U.S. Sens. Daniel Inouye and Daniel Akaka and the Office of Hawaiian Affairs making crucial decisions relative to their culture without their consent.

The bill will divide the Hawaiian community even more than it is now. It will make it more difficult to claim the crown lands, konohiki lands and the kuleana lands.

I urge Congress not to pass HR.2314 until a true vote is instigated by the Hawaiian community.

State Historic Preservation Division To Be Questioned In Public Forum On Operational Problems

Representative Lyla Berg is convening a community forum tomorrow in Honolulu to address serious ongoing concerns with the State Historic Preservation Division.

The public is strongly encouraged to attend and voice their concerns.

A highly-critical letter dated March 19, 2010, from the US Department of Interior's National Park Service to Department of Land and Natural Resources Director Laura Thielen placed the dysfunctional department on “high risk” status because of “…significant operational problems…" and "…serious deficiencies identified in audits going back as far as 2002.”
