Update on HB2874 HD1‏

Aloha,

The bill that would freeze 'Olelo Community Media's funds at 2011 levels and divert any funds collected above 2011 levels to the State's Broadband Special Fund has been scheduled to be heard by the Senate Economic Development and Technology (EDT) Committee on Friday at 1:30 pm in Room 016 at the State Capitol.
 
'Olelo continues to be OPPOSED to HB2874 HD1 and we hope that you will consider sending testimony to the EDT Committee joining us in opposition.  You can submit testimony online here.
 
This bill is defined by the Legislature as one that:

Creates the broadband special fund to support funding public school broadband and laptop initiatives. Freezes appropriations of moneys derived from cable fees at the lesser of the 2011 appropriation or the amount that a recipient would otherwise receive in the current year. Requires excess moneys to be deposited into the broadband special fund. The bill will take effect July 1, 2012, and be repealed June 30, 2017. (HB2874 HD1)
 
While 'Olelo recognizes the importance of the State's Broadband Initiative, we do not agree that the funds for broadband should come from PEG (Public, Education and Government) Access fees.  By freezing PEG fees at 2011 levels, this bill would hamper the expansion of community access media in Hawai'i' and make it difficult for PEG centers to maintain current services.

TALKING POINTS:

·         By limiting PEG (Public, Education, Government) Access funding, the state will also be limiting the free expression of local voices

·         Community participation and PEG Access programming continues to grow. Capping the funding will make it nearly impossible for community media on all islands to meet future communication needs

·         These funds come from Oceanic Time Warner’s enormous profits as rent for their use of OUR public rights-of-way/public airspace

·         The funds are DEDICATED to community media/public access media

·         Funds collected from cable subscribers for the purpose of supporting PEG Access should only be used for that purpose – community media

·         Cable subscribers should not bear the burden for creating a broadband initiative

·         This bill would stem the growth of community media that has given voice to community members who would never be heard in the mainstream media

·         This is a direct attack on democracy

SB2785 -- The cable regulatory bill -- will be heard in the House this Monday, at 9:15 AM.   
 

Over 140 testimonials in opposition were submitted to the Senate, and now it's time to keep the pressure on.  

 

Given the House rules, testimony must be submitted by Sunday morning, 9:15 AM.

 

Simply checking "in opposition" gets your voice counted, but if you want to personalize your comments, here are some possible talking points: 
  • Only high voltage line through any US Marine Sanctuary; 
  • Incredibly expensive -- cable alone is estimated to cost EVERY O'AHU RESIDENCE $6.25/month in additional HECO rates while shareholder-owned HECO is insulated from all financial risk;
  • Not a single required permit has even been confirmed, much less applied for;
  • DBEDT's Draft Notice for a Preliminary EIS was so profoundly flawed and soundly criticized that DBEDT finally admitted it would be revised to reflect Federal requirements -- and it still has not been released;
  • The cable will have profound impacts on our seabed, our Humpback Whale Sanctuary and many endangered species; our federally protected ua'u,monk seal, honu and reefs;
  • Not a single environmental or wildlife impact has been identified;
  • The communities slated to receive this cable, Lana'i and Moloka'i, do not want to become industrial parks -- extension cords -- for O'ahu;
  • Castle & Cooke and HECO should not be setting energy policy for the State of Hawaii;
  • The Statewide Association of Hawaiian Civic Clubs, along with many environmental and community organizations signed resolutions opposing Big Wind on Lana'i and Moloka'i.

Next week Thursday, March 15 and Friday, March 16, will be the last of the hearings at the Land Use Commission for the proposed Ho'opili development. Over 1,500 acres of the highest producing farmland in all of Hawai'i is on the line to be developed and lost forever. Protecting this farmland is crucial to achieving food security as we expect that what happens with this land will have a cascade effect on all future decisions to reclassify or preserve the remaining agricultural land in the state.
 
If you haven't already submitted testimony, or testified in person, this is your last call to speak up. Please recruit your family and friends. We've made it easy for you. Tell the Land Use Commission to DENY the petition to reclassify our precious agricultural land by sending an instant letter via our new policy portal.
