An Open Letter to the Office of Hawaiian Affairs Trustees

Aloha mai e Trustees Collette Machado, Peter Apo, Oswald Stender,
Haunani Apoliona, Rowena Akana, Robert Lindsey, Donald Cataluna, John
Waihee, and Ulu Lindsey,

Mahalo a nui loa for taking the step as the Trustees of the OHA to
hold Kawaiaha'o Church accountable for their actions in their hewa
treatment of the iwi kupuna buried in the shadow of the church.

I appreciate the letters that were written to Frank Pestana, and
copied to Kawaiaha’o Church officials stating your position regarding
the disrespectful treatment of our iwi kupuna and addressing the one
million dollar grant from the OHA trust given to the church.

As a lineal descendant of iwi kupuna buried at Kawaiaha'o Church I am
grateful for these letters and I thank you on behalf of my ‘ohana and
the hundreds of iwi kupuna who have been desecrated at Kawaiaha’o
Church.

While I have always said this issue is not about money, it would be
irresponsible of me as a lineal descendant of iwi kupuna buried at
Kawaiaha’o and a beneficiary of the Office of Hawaiian Affairs trust
if I did not remind you as OHA trustees that the one million dollars
given to Kawaiaha'o Church was used to pay for the pre-construction of
a structure that requires the excavation and desecration of more than
300 of our iwi kupuna. 300 and counting.

This is the issue. Over 300 of our iwi kupuna in the shadow of the
alii church have been excavated with the assistance of monies from the
Office of Hawaiian Affairs trust.

As trustees that it is your fiduciary duty to hold the church
responsible for the it’s
NON-COMPLIANCE of the terms of the grant in which the church agreed
to. It is the fiduciary duty of OHA to make every attempt to retrieve
these funds.

It is my expectation as a beneficiary that anyone who has been given
OHA monies and who has signed a contract with the Office of Hawaiian
Affairs will be held to the highest standards and ethics in fulfilling
their contractual agreement. It is also my expectation as a
beneficiary that the trustees of the Office of Hawaiian Affairs be
diligent in their responsibilities to the trust and its beneficiaries
and that OHA would hold itself to the highest standards and ethics in
ensuring those agreements are met on a timely basis.

Allowing the church to simply walk away without repaying these monies
would be irresponsible and in my view a breach of fiduciary
responsibility to the beneficiaries of the OHA trust.

Never forget! Our iwi kupuna are beneficiaries of the OHA trust just
as much as those who live today. Our iwi kupuna deserve the highest
respect and protection from those who would harm them and OHA has a
responsibility to ensure the highest protections are in place.
Funding a project that requires the excavation of our iwi kupuna is
something that OHA monies should NEVER be used for. This is exactly
what has happened at Kawaiaha’o Church.

Holding Kawaiaha'o Church responsible includes getting the one million
dollars returned and put back into the trust. It includes at the very
least, an attempt to get these monies returned, with an official
notice to the church that it is required to repay the one million
dollars to the OHA trust because Kawaiaha’o Church did not live up to
its own agreement. Holding the church accountable also includes
barring the church from applying or receiving any future funding from
OHA until this one million dollar debt is repaid.

OHA has fiduciary responsibility is to hold anyone who receives monies
and does not comply with terms they agreed to. These monies should
have never allowed to be released to Kawaiaha’o when OHA found out
that our iwi kupuna were being excavated and desecrated as part of
pre-construction.

Where was the oversight for this grant? Is OHA complicit in allowing
this one million dollar grant to go unaccounted for? I sincerely hope
this is not the case.

I am requesting as a beneficiary of the OHA trust that OHA make every
effort to get those monies returned now that it has been made crystal
clear that the excavation of over 300 iwi kupuna at Kawaiaha’o Church
is a pre-requisite to the construction of the Multi Purpose Center for
which they received a one million dollar grant.

It is the right thing to do and it is the responsible thing to do.

I am requesting on behalf of my kupuna who are buried at Kawaiha'o and
on behalf of all the iwi kupuna who were laid to rest there that OHA
officially notify Kawaiaha’o Church of their obligation to repay the
one million dollar debt to the OHA trust. I am also requesting
Kawaiaha’o Church not be allowed to receive any OHA funds for a
minimum of five years and not be eligible to receive any future
funding until the one million dollars is repaid.

This is your fiduciary responsibility to our iwi kupuna and to all the
beneficiaries of the trust. It is your kuleana to ensure the proper
use of any funding from the OHA trust is used as it has been agreed to
and that any funding from OHA is NEVER used in any way, shape or form
to excavate, desecrate or harm our iwi kupuna.

It was my understanding that OHA was going to release a press
statement regarding the stand they have taken on what Kawaiaha'o has
done with our iwi kupuna and the grant monies.

To date, I have not seen anything in the media.

It is vital to let the Hawaiian community and the public at large know
that OHA has taken this important position for our iwi kupuna. There
are many concerned family and community members who are horrified at
what is happening at the church.

We all need to know that OHA is doing something pono about this hewa.

We as oiwi, as lineal descendants of our cherished kupuna, need to
ensure this hewa NEVER happens again.

You as trustees of the Office of Hawaiian Affairs need to hold
yourselves to the highest standard and ethics in protecting and caring
for our iwi kupuna.

Rise up. Do the right thing simply because it is the right thing to do.

I look forward seeing OHA's statement in all of the major media soon
as well as a statement in the next issue of the Ka Wai Ola o OHA.

I look forward to your reply at your earliest convenience.

DID THE US STEAL HAWAI`I?











The United States claims it possesses the Hawaiian Islands. But the facts show that at no time did lawful title to the Hawaiian Islands actually transfer from the Hawaiian Kingdom to the US either directly or indirectly.


The thieves who stole the Hawaiian Kingdom “car” fenced it to the US, who has been driving it around as its own.


The takeover of the Hawaiian Kingdom violated the Hawaiian Constitution, the US Constitution and the Law of Nations.

According to the governing principles embodied in those documents, the only lawful means to peacefully change a government is by the consent of the people.

There was no consent of the people for the 1893 takeover, nor for the 1893 Provisional Government for Hawai`i, nor for the 1894 formation of the Republic of Hawai`i, nor for the 1898 Annexation to the US, which was not even legitimate according to US law.

And finally, the 1959 vote conferring “statehood” to Hawai`i was based upon the previous illegitimate acts and did not conform to the criteria or procedures required by international law under the United Nations Charter.

Demonstrators Say Kawaiaha`o Should Stop Disinterments

Honolulu Star-Advertiser - February 15, 2012

Nearly 40 demonstrators, some in skeleton costumes, protested the rising number of Native Hawaiian burial disinterments at Kawaiaha`o Church outside the historic institution known as “the Westminster Abbey of the Pacific.”

The group, mostly University of Hawai`i students, held signs and chanted in Hawaiian to voice their objections to the removal of iwi kūpuna, or ancestral remains, being carried out by Honolulu’s oldest church to make way for a $17.5 million multipurpose building.

More than 238 burials have been removed from the site with state permission.

Most disinterments have occurred since November, rising the ire of Native Hawaiians who say cultural tradition calls for them to protect their ancestors’ remains from disturbance even if they were buried in a Christian cemetery at a church established in 1842.

A  Star-Advertiser story has disclosed the disinterment count through Jan. 21 reported to state officials by an archaeologist hired by the church.

The church declines to disclose such figures. A more up-to-date count hasn’t been available from the State Historic Preservation Division, but 14 burials a week have been unearthed on average over the past few months.


Protesters displayed more than a dozen signs with names of families with burials at Kawaiaha`o - Pilali, Ka`ahea, Adams, Shaw, Kapena, Kakelaka, Kuaea, Kanaumu, Godfrey, Buckle — to raise awareness about who might have relatives being disturbed.

The group also carried signs urging the church to cease disinterments. “Stop Digging Kawaiaha`o,” read one. “There’s life in the bones,” read another.

Some signs were more cutting, such as one in the shape of a coffin with the words “GRAVE RAIDERS” intersected on a cross.

“We are here to stand for who we are as a people,” said Zurishaddai “Z” ‘Aki, 25, one of several members of the UH student group Makawalu who donned skeleton masks to emphasize the connection to their cause.

“We came out today to show we’re not forgetting about our kūpuna,” said Punahele Kealanahele-Querubin, 21, a senior in UH’s Hawaiian Studies program. “We still carry the values that we have had for hundreds of years. To give up those values is giving yourself up as a Hawaiian. It’s just hewa (wrong). Just hewa.”

ALTHOUGH EVERYBODY BUT TIME WARNER WANTED IT DEAD – HB2874 LIVES!

House Finance Blows Off Your Testimony, Backs Time Warner Freeze of Public Access TV

KAHULUI, HI – With Testimony running 100 – 1 against House Bill 2874 which would freeze Community Television funding on all islands for five years  – the House Finance Committee voted unanimously to PASS the bill with amendments. The language of these amendments are not yet available. Significantly, even though the hearing on this measure was not announced until 9:30PM on Friday night for a Monday morning meeting, scores of people showed up to testify passionately in opposition and hundreds more written testimonies like yours were received by the committee also in opposition.

In terms of helping broadband development as it purports to do, this bill does none of that In fact it does the exact opposite by weakening the PEGs and biting off its nose to spite is face. ( See testimony of Akaku President/CEO Jay April below)

Even though otherwise funded DOE was the intended beneficiary of a totally undefined plan that would steal PEG monies to buy laptops for schools, they didn’t even bother to show up. This is a bill nobody wanted with Hawaii Public Television and DCCA also weighing in against it. Nobody, that is, except for cable giant, OceanicTime Warner.

The sole testimony IN FAVOR of this bill was submitted by TIME WARNER whose spokesperson clearly misrepresented the facts of how public access TV is funded  in oral comments before the committee. Evidently, Time Warner’s testimony is worth more than any 100 of you. But you can’t read it because none of it has been posted on the House of Representatives website.

Time Warner is required by state and federal law to fund Community Television as RENT for using our public rights of way. Since when does the rent payer get to dictate the terms of how the rent money is spent? But this is exactly what happened.

Akaku would like to thank you for your support in defeating this bill and we ask you to stay tuned as we track its progress when it crosses over to the Senate where you will have another chance to register your opposition.

Testimony of Jay April, President and CEO Akaku: Maui Community Television
Member HCR 358 Legislative Task Force in STRONG OPPOSITION TO
HB2874 RELATING TO BROADBAND

On behalf of the people of Maui, we strongly OPPOSE House Bill 2874 Relating
to Broadband because we can demonstrate that it's likely effect will be to limit
broadband adoption and education, not enhance it.

Protection of cable access funding of Public, Educational and Government
Access is important to broadband education and is an essential component of
bringing Hawaii into the forefront of the digital age. Our ability to communicate
effectively with each other will only succeed if the fullest range of local community
communications needs such as access to bandwidth, tools, skills and ideas on a
fast, open, affordable internet are met for all residents at reasonable cost. Media
literacy, digital education and access to spectrum are the underpinnings of
broadband development. PEG access centers already in place, are providing
cost effective resources and tools to accomplish these goals and bring digital
literacy to all of our people. They are perfectly positioned to have an immediate
positive impact on Hawaiiʼs broadband future. This it why it makes perfect sense
to increase funding for PEG for use in broadband adoption and education, not
freeze funding as is contemplated in this bill.

This is particularly important because Akaku has been an early adopter of real
world broadband applications. Akaku was the first media organization in Hawaii
to use the internet to stream video in the late nineties and in 2007 was once
again the first to multicast and simulcast, via radio, television and the web, events
of public importance to the entire state. Akaku was the first in Hawaii to integrate
live TV broadcasts with "skype" technology and currently provides Maui County
Government free streaming services and Maui Nui residents with one of the most
innovative broadband training programs in the nation - a programs that could be
at risk if HB2874 should ever become law. This bill if it passes will, by cutting off
its nose to spite its face, negatively impact an existing, highly functional engine
for broadband adoption by Hawaii residents.

Akaku is currently using broadband technology and curricula that are light years
ahead of anything public schools are doing including deploying state of the art
equipment and software that outperforms anything a laptop can do. This
broadband adoption effort is open to all youth in Maui County from ages 10 -25
and extends well beyond the confines of any classroom.

Not only that, we are at the verge of exporting this progressive learning model to
our educational partners statewide and are actively investigating the possibility of
creating broadband infrastructure build-outs for rural areas that will be superior to
anything offered by Time Warner Cable or anybody else. House Bill 2874, by
robbing Peter to pay Paul, will help defeat these efforts by taking resources and
growth away from the real broadband innovators and trainers, Hawaii's PEG
Access centers. HB2874 will put these much needed funds into an undefined,
black hole of underperforming state education coffers. Despite the dedication and
excellence demonstrated every day in the classroom by Hawaii's teachers, due to
bureaucratic and other priorities, it is hard to justify how a few laptops will have
the ability to transform the present system into a high performance new media
engine no matter how hard they try. And the proof is in the pudding. It needs to
be pointed out that for several years now, our public schools have received
millions and millions of dollars of cable franchise PEG funds from Akaku and from
Olelo with few, if any measurable results and little or no accountability for these funds.

If House members are really interested in creating a real world model to increase
broadband adoption and meet the lofty goals outlined in the Hawaii Broadband
Initiative, it might consider an amendment to direct the DCCA to raise the current
franchise fee assessment to 5% and to increase, not limit, funding to island PEG
entities for purposes of broadband education.

FREE HAWAI`I - BEYOND "THE DESCENDANTS"

Congratulations to The Descendants for being nominated for five Academy Awards and providing a fleeting glimpse to a part of Hawai`i’s story that is manifesting today in the Hawaiian independence movement.

Besides having to come to terms with his closest personal relationships, Matt King, played by George Clooney, is also forced to make a decision as the executor of a large family land trust on the island of Kaua`i.

In the end he decides not to approve a lucrative resort development on his family’s land, citing a deeper trust obligation to the lands. But left unsaid is the time-bomb about to explode in Hawai`i — the increasing problem of clouded land titles traceable to the illegal usurpation of the Hawaiian Kingdom in 1893.


Did You Know That Hawaii Is NOT A “State” Of The United States?

The claim that Hawai`i is a “state” of the United States of America is false. The truth is, the US flagrantly violated a slew of international laws to take over the Hawaiian Kingdom and annex it to the US— against the will of the people of Hawai`i.

In fact, the Hawaiian people never gave the sovereignty of their nation to the US or any other foreign power. So even though the US has been imposing its rule over Hawai`i for more than a century, according to international law, the US claim to Hawai`i is illegal and fraudulent.

By law the Hawaiian Kingdom is still a sovereign, independent nation in continuity, and the “State of Hawai`i” is a puppet government installed by the US to cover up the fraud.


In spite of vigorous century-plus propaganda and indoctrination, the cover up is quickly disintegrating and the movement to restore Hawai`i’s independence is growing and steadily advancing.

Despite the 119 years of foreign occupation, in 1994, we the people — the surviving descendants of the Hawaiian Kingdom — began the process of peacefully reclaiming our nationality and restoring our country’s rightful standing as a sovereign, independent, neutral country.

Loyal Hawaiian nationals have been working through peaceful and friendly means — with Aloha — to FREE HAWAII. We are getting close!


As more people learn our story, the stronger the call for justice becomes, with legal challenges, education, demonstrations and other peaceful acts of resistance exposing the illegal occupation. Hawaiian Kingdom nationals attempting to live under the laws of their own country are routinely persecuted and prosecuted by the police and agents of the US and State of Hawai`i.

The US court systems have inflicted financial ruin, vilification, personal abuse, incarceration and even physical torture upon Hawaiian nationals treated as political prisoners.


Being a Hawaiian national is not easy, yet those who pursue independence continue to do so with the expectation that in the end, justice will prevail and freedom will return to our island nation.

Did You Know That President Obama Can Free Hawai`i With The Stroke Of A Pen?


After concluding an official investigation, US President Grover Cleveland, in an address to the US Congress, admitted that the United States’ actions in assisting the takeover of the Hawaiian Kingdom was patently illegal, constituting “an act of war” against a friendly nation, an egregious violation of international law.

Queen Lili`uokalani had skillfully used diplomacy and international law to safeguard the sovereign rights of her kingdom and her people.

In good faith, President Cleveland and Queen Lili`uokalani, as heads of their respective countries, negotiated an Executive Agreement in which the US pledged to restore the lawful government of the Hawaiian Kingdom. That pledge has yet to be fulfilled.


The responsibility and authority to honor the Executive Agreement rests squarely on the shoulders of the President of the United States.

Even though Cleveland and 18 of his successors failed to execute that commitment, the obligation is nonetheless incumbent upon the president to administer. All he has to do is order it done.

With the stroke of his pen, President “Yes, we can!” Barack Obama can actually FREE HAWAI`I. How providential it is that he was born in Hawai`i!


It is hoped that the American people will soon come to realize the truth about what occurred in Hawai`i and will help us encourage President Obama to act justly and honorably to release our beloved Hawaii from its hundred-plus-year bondage.
