KAHEA CALLS FOR PLDC REPEAL

One of Hawaii’s environmental groups is calling for the repeal of the Public Land Development Corporation.


KAHEA: The Hawaiian-Environmental Alliance has issued a press release saying that the new development arm of the Hawaii Department of Land and Natural Resources, “should be repealed because it promotes the sale and improper use of public lands, including ceded lands.”


Issued by Jon Osorio, a KAHEA board member and well-known UH professor of Hawaiian Studies, the statement continues -


"It improperly exempts the state from many of the important laws that are meant to be a way for the state to carry out its public trust duty to protect our precious resources. We believe there are no rules that can “fix” the PLDC to restore protections to our public trust resources and ceded lands. The PLDC simply must be repealed."

On page 129 of the US Senate Appropriations Committee FY13 Interior Subcommittee Bill Draft, between “Livestock Grazing Administration” and “Use of American Iron, Steel and Manufactured Goods”, US Senator Dan Inouye has slipped in his latest scheme to hide the US federal Akaka bill hoping no one will notice. 

The Subcommittee Bill Draft was released Wednesday, September 26, 2012. 

Senator John Kyl (R-AZ), a long time opponent of the Akaka bill, immediately announced a ‘hold’ on the Appropriations bill until the language is removed. 

Under Senate rules a ‘hold’ blocks further consideration of a bill.

Kyl, who is retiring this year, has prevented consideration of the Akaka Bill several times in years past.

The public response to the PLDC has been powerful, smart, and effective. We received many messages in support of KAHEA Board member, Jon Kamakawiwo‘ole Osorio’s email and testimony demanding the repeal of the PLDC.



Many of you told us you’re contacting your legislators to demand a repeal. You responded by pointing to petitions specifically calling for a repeal of Act 55, sharing your own testimonies against PLDC, and the PLDC’s potential implications for public trust lands, Hawaiian self-determination, and potentially dire implications for particular projects like Big Wind on Lāna‘i.

Please keep it up! Contact TODAY public officials like your legislators, OHA trustees, the governor, and others with an obligation to protect our public lands. This will be increasingly important as the legislative session nears. Tell them why a repeal is the only way to correct the huge misstep that is the PLDC.

Many of you asked – how could PLDC have happened? This is a tough question with few satisfactory answers, here’s a summary from Environment-Hawai‘i’s July 2011 issue:

Act 55 originated from Senate Bill 1555 from 2011, introduced by state senator Donovan Dela Cruz, and which seemed to stem from an innocuous intent: “Public lands in certain areas may serve the State and its people better if managed and developed into suitable recreational and leisure centers where the public can congregate and where visitors to our State can go as part of their holiday experience[.]” Initially, and as presented by William Ailā, the only PLDC projects specified had to do with allowing commercial vessels in public harbors at Ala Wai and Ke’ehi lagoon – and those provisions were removed after boating communities in those areas protested.

Ten state house representatives (Karen Awana, Dela Au Belatti, Tom Brower, Fay Hanohano, Jo Jordan, Chris Lee, Sylvia Luke, Scott Saiki, and Jessica Wooley) and one senator (Les Ihara) voted against the SB1555, which anyway passed through both the state house and senate. And, despite a fruitless last minute attempt to stop Governor Abercrombie from signing SB1555 into law; he did – on May 20, 2011. The wider public got wind of Act 55 after Richard Lim, director of the Department of Business, Economic Development, and Tourism, made remarks to the Hawai`i Economic Association about parks and other state lands spoke to the Hawai`i Economic Association made remarks about parks and other state lands that have been taken over by “undesirable elements,” the “vicious maintenance costs” of vandalism, and specifically targeted groups that contested the Hawai‘i Superferry’s exemption from environmental laws; “Ten surfers and a couple of well-heeled NIMBYs can wipe out economic development in the state[.]” Lim then described his hopes for “public private partnerships” – hopes that Ian Lind connected to Act 55 and wrote about in his blog on June 22, 2011 and Arnie Saiki connected to the then-imminent APEC meetings on his weblog as well.

Ko Hawai'i Pae 'Aina me Irelani 'Akau.

                         There are some striking parallels between the Ku'e Anti-Annexation Petitions of 1897-1898 and the Ulster Covenant of 1912. The Ulster Covenant was signed by men and the Declaration by women, designed to prevent Home Rule in Ireland over 471,000 signatures were lodged. The first signatory was Sir Edward Carson who was born in Harcourt Street, Dublin some eight miles from Killiney where H.R.H. Princess Ka'iulani stayed at the Davies summer home. The celebrations this past weekend surrounding the centenary of the Ulster Covenant are outlined here:

Close to 20 months of work removing more than 600 burials from unmarked graves at Kawaiaha`o Church came to a halt Friday after an appellate court ordered a stop to excavation work for a multipurpose building that has upset many Native Hawaiians and even some members of Hawaii's oldest church.

 

A three-member panel of Hawai`i's Intermediate Court of Appeals granted an injunction sought by Hawaiian cultural specialist Dana Naone Hall, barring any work at the Hono­lulu church that could result in disinterment of more human remains.

 

It is the second time that construction has been frozen on the $17.5 million project, which began in January 2009.

 

The panel issued its injunction in view of last month's Hawai`i Supreme Court ruling that held the State Historic Preservation Division should have required an archaeological survey for remains all along the city's planned 20-mile rail route before construction began.

 

Hall argued in her lawsuit that Kawaiaha`o Church should have conducted an archaeological survey.

 

The three judges indicated that they likely agree. "We conclude that Hall has shown a substantial likelihood of success on the merits," the injunction order said.

 

The judges also wrote that there is a substantial likelihood they will conclude that SHPD violated its rules by approving the multipurpose center project without requiring an archaeological survey.

 

It is unknown how many burials remain on the project site....

 

David Kimo Frankel, a Native Hawaiian Legal Corp. attorney representing Hall and a separate plaintiff in the rail case, said he intends to ask the court that human remains, or iwi, be returned to their prior resting place and that nothing be built on top of them....

Hawai`i is not a part of the United States.

The truth is the current government, the “state of Hawai`i,” is a corporate construct of the United States that resulted from a series of unlawful acts stemming from the 1893 unlawful takeover of the recognized, peaceful, civil government of the Hawaiian Kingdom.

The government of the United States has twice officially acknowledged (in 1893 and again in 1993) that its participation in the takeover of a friendly, neutral nation was an unprovoked unlawful act of aggression.
Suppose someone stole your car, forged documents and sold it to someone else. Does that new “owner” own the car? Suppose the new “owner” gave it to someone else. Does that new “owner” own the car?

Now suppose the original thief confesses to the crime of how he unlawfully obtained (stole) the car. Who owns the car now? Is it the person most recently in possession of the car, or you, the person from whom it was initially stolen?

Of course, according to common sense and common law, the answer is - you. Since you never gave your consent, the title of the car never lawfully changed hands to anyone else.

You are still the lawful owner.

Little-known Facts About Hawaii

 We know that the Turpie Resolution (1894) warned other nations and U.S. Officials from intervention of the conflict between the Kingdom of Hawaii and the U.S.A. as an act unfriendly towards the U.S.A.  The Turpie Resolution also proclaimed that the citizens of Hawaii had the right to choose their form of government; thus the Ku'e Petitions of 1897 answered to that issue.  This is the reason why the treaty of annexation failed a second time.  As a result, the U.S. implemented the unlawful Newlands Resolution to annex the Kingdom of Hawaii via the unsanctioned and illegitimate Republic of Hawaii.

The Akaka Bill fosters the U.S. theocratic WASP racist doctrines of Manifest Destiny which demands that the Native Hawaiian subjects of the Kingdom of Hawaii which has international recognition as an independent sovereign neutral nation to subjugate itself to the plenary authority of the dishonorable U.S.A.  The U.S. Congressional hearing held on O'ahu in 2000 saw over 98% of the native Hawaiians and others that rejected the proposed bill.  The voice of the Hawaiian subjects once again was ignored.  this reuslted in Akaka to solicit the Hawaiian civic social club to become political in advancing this bill and to push the doctrines of Manifest Destiny.

The U.S. always deemed Hawaii as an expendable outpost to protect the west coast of the U.S. and to establish naval power, dominance, and control in the Pacific.  The little-known fact that Alaska is a more direct and closer route to the Phillipines than Hawaii was never discussed. 

KKK Dragon Master, U.S. Senator David Morgan's agenda was to displace all the negros/blacks out of the continental U.S. to the Hawaiian Islands. 

The customary practice in Hawaii was that they would bury their loved ones on their property/their lo'i where they lived and lawai'a where they lived.  During battles, it was more feasible to bury the dead where they fell whether they were warriors or collateral village people.  It was the reknown warriors and ali'i that were taken to hidden burial caves or family caves to be interred to protect their iwi and the mana it possessed.  We know many of them were displaced by the greedy haole melika who wanted the land.  The iwi were left where they were buried.  This little-known knowledge today, is overlooked as to why the iwi is scattered throughout the 'aina.  The U.S. land reformations unlawfully took the allodial lands from the legitimate owners of the lands and their heirs; thus creating another layer of legal and cultural issues.

The state Office of Hawaiian Affairs is questioning the age of human burials — to date, more than 600 sets of remains — removed by Kawaiaha‘o Church in preparation for building a $17.5 million multipurpose center.


The state agency advocating for Native Hawaiians sent a letter this week to the state Department of Land and Natural Resources requesting detailed information about the burials to show whether they are all Christian burials, as the church contends, or whether some predate the church and should be protected by Hawaii’s historic burial law.


Kawaiaha‘o was established in 1842 to become Hawaii’s first church, and it has been allowed to disinter an unlimited number of human remains, or iwi kupuna, under an exemption to the burial law that gives special protections to traditional Hawaiian burials.


The exemption applies to known and actively maintained cemeteries, and was approved by DLNR and upheld by a Circuit Court judge.


But OHA questions whether the church is digging up burials that predate Kawaiaha‘o’s existence, especially given the “exceedingly large” number of remains, which includes 605 burials and thousands of individual bones as of Sept. 9.


“Since the historical record indicates that the area contained burial sites prior to the establishment of Kawaiaha‘o Church, questions of this nature are warranted,” OHA said in its letter dated Sept. 17.


OHA  is asking DLNR to obtain details about the burials such as their depth, position, orientation, whether they are in a coffin and whether artifacts are present. Other details that could help date burials such as the presence of remains of animals, plants and ref­use in proximity to burials are also being sought.


Kawaiaha‘o is required to notify DLNR’s State Historic Preservation Division of burial findings weekly, but the reports typically state only when and how many burials were removed.

West Hawai`i Today - September 18, 2012

 

Overwhelming testimony supporting a resolution asking the state to abolish the Public Land Development Corp. preceded the Hawai`i County Council’s Planning Committee’s unanimous favorable vote on the measure Tuesday morning.


Donald Wessels, testifying in Hilo, said the PLDC is usurping the counties’ authority.


“The Public Land Development Corp. is legalized theft,” Wessels said. “Send a message to the state that you, the elected representatives of the County of Hawai`i will not sit still while the State of Hawai`i gives away your authority.”


Other testifiers questioned the governor’s and legislators’ motives in approving the measures creating the PLDC. One testifier noted only Puna Rep. Faye Hanohano, among all of Hawai`i Island’s legislators, opposed the measures.


“What really concerns me is the non-transparency of the thing,” Patricia Shaner Knudsen said in Kona. “We won’t see the public hearings perhaps we should. This is a very, very important issue for the state, for the island in particular....”

Honolulu Civil Beat - September 19, 2012

Governor Neil Abercrombie blasted critics of the Public Land Development Corporation in a story in the Honolulu Star-Advertiser on Monday.

Abercrombie dismissed critics in the environmental, Native Hawaiian and labor communities — including many who want the corporation abolished because of a potential threat to the environment — as the “usual suspects” who used public hearings this summer on the corporation’s draft administrative rules to create “conspiratorial hysteria.”

Now, PLDC opponents are fighting back.

Jonathan Osorio, a professor of Hawaiian Studies at the University of Hawai`i at Manoa, has responded to the governor’s comments in a Community Voice’s piece published by Civil Beat - A Kanaka Maoli’s Objection to the PLDC.

He writes, in part - 

"Now I will be passionate. The Crown and Government lands of the Kingdom belong to the descendants of the citizens of the Hawaiian Monarchy. If the Governor and the Legislature want to manage our lands more effectively for the benefit of every resident in Hawai`i while we sort out our legal disagreements, I support that. But exempting a government agency or a private company exempt from law is not effective management, and all of your finger pointing, Governor Abercrombie, will not make it so."

Robert Harris, executive director of the Hawaii Sierra Club, told Civil Beat that he found the governor’s comments disappointing.

“Ten years ago, I think Neil would have been one of the primary advocates for making sure the public’s voice is heard. And now the shoe seems to be on the other foot.”
