HOUSE REPEALS PLDC - SENDS BILL TO SENATE

As expected, the Hawaii House of Representatives passed House Bill 1133 repealing the Public Land Development Corporation.


The vote was unanimous.


Rep. Cindy Evans, who oversaw a five-hour hearing on HB 1133 and other PLDC-related bills Saturday, said public opposition to the PLDC was overwhelming.


“Clearly, the way it was structured, the public came to a point of understanding that the authority we gave the corporation bypassed county plans and zoning laws,” she said. “The public felt it had no say in what was going to happen in their community.”


Noting that the bill that set up the PLDC was changed significantly with little notice during the legislative process two years ago, Rep. Cynthia Thielen described the repeal of Act 55 as “a victory for the people of Hawaii.”


Several lawmakers called the public reaction to the PLDC “a teachable moment.”


HB 1133 now goes to the Senate for consideration, where senators have been tinkering with their own version of PLDC-related bills. Read Civil Beat’s recent coverage of the legislation.

DEVELOPING OUR PUBLIC LAND$

Quiet enactment of a law that the Abercrombie administration backs to create state-and-private partnerships for development projects has now erupted in vocal questioning, adamant protests and even calls for repeal.

 

These concerns over the Public Land Development Corp.'s powers, its intent and jurisdiction, are prompting state lawmakers to reconsider their support heading into the next Legislature.

 

Some who voted for the proposal are prepared to support its repeal in the 2013 session, while others contend that the opposition has resulted from misinformation about the new PLDC agency, created by the Legislature in 2011. 

 

Gov. Neil Abercrombie has rejected the criticism on that basis, but opposition persists. A repeal would require two-thirds of each legislative chamber.

 

The law creating PLDC says it "shall be exempt from all statutes, ordinances, charter provisions, and rules of any government agency relating to special improvement district assessments or requirements: land use, zoning, and construction standards for subdivisions, development and improvement of land; and the construction, improvement and sale of homes."

 

State Rep. John Mizuno, who voted for the bill, now says he will vote for the law's repeal because it "eliminates the ability of the public as well as many government environmental and building review agencies to have the objective oversight to ensure proper protections and safety for area residents and the environment, prior to a developer starting a project in our state."

 

The agency's five-member board, comprised of three selected by the governor and two by the Legislature, "will be allowed to exempt any project from many land use, environmental and even building permits," Mizuno says....

WHY HAWAIIAN ANCESTRAL BONES MATTER

We can’t begin to tell you exactly why our kūpuna (ancestors) believed a person’s mana was held in their iwi (bones), but we can certainly share with you some of the values we were raised with - those same values that were passed down to us, through our culture, by our ancestors.


Far from speculation, we trust (we have faith) in the wisdom of those who came before us. Nānā i ke kumu (look to the source). We accept that they knew many things that we simply don’t. It’s just common sense that the generations before, always have something to teach the generations after. As technologically advanced as we are today, we just can’t dispute the fact that our ancestors had a much better understanding of the world. After all, just look at the difference. The natural world, under their care, flourished. And yet, we struggle, today, to keep human devastation of the natural world from destroying ourselves.


Perhaps that’s one of the many reasons why our kūpuna believed a person’s mana lived on within their bones – because they fully understood our connection to `Āina, the natural world. They understood that we are a part of `Āina; that we are not an invasive species capitalizing on everything around us, but rather, we are just another organism, with a specific purpose, in this greater eco-system.


When a person ua hala (passed), their bones remained. Those bones were often returned to the soil, and in time, they would become a part of the earth, providing nutrients to the plants and animals that would sustain the living. And they, like us, would live on in this way.


The most obvious reason we have, for the importance of iwi, is the aloha, the immeasurable love we have for our family and friends. Their iwi is a part of them. It is them. They are the reason we are here. And though we may have never met them or seen them, we will always love them. We will never forget our ancestors. And in our own time, we can hope that our descendants will know that, like our ancestors before us, our thoughts and aloha are forever for them.


Our kūpuna are our foundation. They keep us rooted to these lands and their iwi serve as physical evidence to that claim. To our forgetful minds, the iwi remind us of the lives of our ancestors with no less importance than a cherished picture, a treasured keepsake, or a family heirloom that serves to affirm, to all future generations, where it was, that they came from.


For these reasons and more, our kūpuna taught us, mai kaula`i wale i ka iwi o nā kūpuna. To never dry out, in the sun, the bones of your ancestors. That wisdom is understood both literally and figuratively; for openly sharing your mo‘okū`auhau (genealogy) is just as awful as digging up the bones of your kūpuna.


To remove our connection, the bones of our ancestors, from these lands is tantamount to murder – genocide. People of Hawai`i, please keep in mind, Kānaka Maoli are warriors – we fiercely protect `Āina and `ohana. When our loved ones are threatened, we fight back. I’m sure most, if not all, can relate to that.


With Kawaiaha`o Church digging up 600+ kūpuna for their new multi-million dollar building, there is an obvious dispute with regard to burial beliefs. So let’s keep things simple. Before the church, there was a heiau, where many Kānaka Maoli rested. These Kānaka Maoli are being dug up. So no matter what your current burial beliefs are, the people who are being dug up, believed that their mana is in their bones. Respect their beliefs.


Hawai`i is changing. The verdant land our kūpuna once knew is being buried under concrete and asphalt. Many, including Neil Abercrombie, have made the assumption that Kānaka Maoli are opposed to “progress,” labeling us as the “usual suspects.” But too often is the word, “progress” used to identify unsustainable development, rampant urbanization, environmental destruction, finite resource depletion, and the desecration of our ancestors.


Neil, I am a Kanaka Maoli, and my definition of progress is different than yours. Progress, to me, is the capacity to endure and the perpetuity of life. Progress, to me, is the government spending money on people, not corporations. Growing food not a low estimate $5.3 billion rail. Progress to me is covering every home in Hawai`i with solar panels and micro wind turbines so we can eliminate that electric bill, without having you build over forests with geothermal power plants or covering over islands like Molokai and Lāna‘i with wind turbines to power O`ahu via undersea cables. Progress, to me, is passing laws to protect the environment, instead of laws enabling exemptions in sweetheart deals (Act 55, PLDC). Progress, to me, is caring for Hawai`i’s houseless and listening to people who know a lot about being progressive. This is the knowledge of kūpuna Hawai`i, and these are just a few reasons why, kūpuna mean everything to us. Nānā i ke kumu. Ola nā iwi.

Our government is a democracy founded on the rule of law. No one is above the law — not the president, not the governor, not our legislators. No one.

Yet Hawai`i's laws have been violated many times. Little by little, citizen rights have eroded, citizen views no longer considered.

We have passively watched as our elected officials moved from defying the law as a seldom-done thing to an accepted procedure. This has to stop.

We have laws providing for emergency exemptions that define in explicit detail what conditions constitute these emergencies.

Both former Gov. Linda Lingle and Gov. Neil Abercrombie have ignored these laws. Both have used them for purposes that do not meet the requirements of the law — and got away with it.

It is depressing, heartbreaking and incomprehensible that our elected officials and we, the people, find this acceptable.

And now we have Act 55, which creates the Public Land Development Corp., which is far, far above and beyond the law. Act 55 gives to PLDC all decision-making power over disposal of our land — public and sometimes contiguous private — exempting them from all laws, restrictions, zoning, etc., without limit.

It effectively eliminates citizens' right to participate in decisions that control our lives and our future.

PLDC can go through all the usual format — hearings, public testimony, etc., pretend to listen — and then go ahead and do as it had decided beforehand.

Abercrombie, or any governor, does not own the public lands. The PLDC does not own the public lands; you cannot give away something that is not yours. Public land belongs to all the people. Each generation is caretaker of these lands, to preserve for future generations as previous generations have cared for them for us.

The Land Use Commission was created to be the people's watchdog, but long ago became the agent for greedy and thoughtless men. They hold public hearings and go through all the motions. The people can speak, but don't get listened to. The "go ahead" signals to Koa Ridge and Ho‘opili are the final straw. Act 55 must be repealed.

O`ahu has long been overpopulated. We long ago depleted our resources for caring for the people who are already here. These resources include water, safety, health care, education, social services and space, among many others.

We do not need more people, houses, hotels, restaurants, communities or concrete-covered land. Soon the roads and rail will be irrelevant anyway. We'll get in our cars and drive wherever we want, in any direction we please on the concrete-covered plain. So what do we do?

Stop building houses. Quit enticing more and more people to come here.

No matter what we do, we will always have a housing shortage. The people who most need a house can't afford one. Wealthy people buy them as second homes or investments, using land desperately needed for other purposes.

No matter what we do, we will always have homeless people. We can't eliminate this problem. They, too, arrive seeking to enjoy the comforts, care and all the advantages of paradise.

So what do we do?

We use the buildings and houses already available to serve our own needy people and our own already-homeless.

All over Oahu, we have awful roads, decrepit houses and buildings, unkempt parks, disintegrating infrastructures — the list goes on and on.

Let's use our unemployed, Hawai`i-owned contractors and developers to do restoration, maintenance, replacement — whatever is required — instead of more houses. If necessary they can retrain.

We need to rethink, or give up, the outdated idea of a second city. Over the past 40 years we've already built enough communities. We already have a population large enough to be that city. This idea was fatally wounded by building the suburbs before the core.

Repeal Act 55. Return Hawai`i to its citizens.
