STATE OF EMERGENCY... !The legislature if trying to merge a bill which would do two things. Pls watch 'Ehu's video and it will explain it better than I could. They have cancelled these meetings twice...and usually when they are trying to push something this EVIL...they do it late at night...behind closed doors. As much as we probably can do nothing about that OTHER than to protest outside of OHA's OFFICE or at the Capitol....the ONE thing we all can do easily is to voice our opposition. Full Audit!     Dear Senator Hee and Senator Mercado-Kim,

    I stand OPPOSED to HB 900 and SB 995.

    Here’s why - The Office of Hawaiian Affairs (OHA) has NOT -


    Completed a full audit with the State Auditor, as mandated by law and requested by the 2008 Legislature.
    Fulfilled their trust responsibilities and fiduciary duties to Hawaiian beneficiaries, as OHA lacks accountability and transparency.
    Consulted with Hawaiian beneficiaries, pertaining to the above matters, as requested by beneficiaries during the 2008 Legislature.


    Therefore, I request and strongly urge -




    That all matters pertaining to any and all request by OHA for General Funds and “ceded lands” settlements be DECLINED.
    That the 2009 Legislature send a strong message on behalf of the beneficiaries intended to be served by OHA and demand the following to occur -


    a. OHA must allow full access to the State Auditor, so a comprehensive audit can be produced prior to 2010. Upon completion, OHA will fund a complete and inclusive statewide process of beneficiary consultation pertaining to the distribution and dissemination of the final audit, in which beneficiaries will be empowered to submit their concerns and recommendations that shall be implemented by OHA.
    b. OHA will implement a complete and inclusive statewide process of beneficiary consultation pertaining to future OHA budgets, prior to any legislative budget request.
    c. OHA will implement a complete and inclusive statewide process of beneficiary consultation pertaining any and all matters pertaining to the Ceded Lands (i.e. Ceded Land Settlement), prior to submitting any legislative request on this matter.
    d. OHA will work with the State in completing a full and complete inventory of all Ceded Lands, in which OHA is to provide 50% of the funding for such an endeavor.
    e. OHA will work with State to determine all gross revenues from all Ceded Lands, including all 5(a) lands that have been excluded in past records.
    f. Require that any and all OHA Administration resign who are found to be negligent due to their breach of fiduciary and trust duties.

    This testimony in OPPOSITION is OPPOSITION to the lack of leadership, transparency, and accountability at OHA and is no reflection upon the beneficiary programs implemented by NHLC, NPN, and Alu Like. It is strongly urged that the Legislature fund these programs directly or through another State Office.
