LIFE UNDER THE AKAKA BILL

INDIANS ASK APPEALS COURT FOR JUSTICEWASHINGTON, May 11 - A federal appeals court was told today that it should offer 500,000 Native Americans some form of "rough justice" as a result of the federal government's acknowledged mismanagement of their trust accounts.Attorney Dennis M. Gingold, who represents the Indians in a 13-year-old class action lawsuit, said justice for the Native American trust account beneficiaries cannot be complete because so many records of what happened to their trust lands and funds are missing.That means some form of "rough justice" is required, Gingold said, adding that any resolution of the case must be fair."If not, we'll all be here another 13 years," Gingold told a three-judge panel for the U.S. Court of Appeals for the District of Columbia.Government lawyers said they want the case declared at an end and the Indians given nothing at all.Full Details Here - http://www.indiantrust.com

  • Patricia Zell drafted the first bill for Inouye then later left his employ and she and her husband opened up their law office and become the sole attorneys for the Akaka Bill for the senators, their only and large account to keep them in operation. Go figure!

    We know for certain that the U.S. cannot produce a lawful treaty of annexation since it was rejected due to a lack of 2/3rds vote by U.S. congress and therefore not ratified; thus the Newlands RESOLUTION is unlawful, null and void. According to the Turpie RESOLUTION of 1894, there is a part of it which states that "That right of it belongs wholly to the people of the Hawaiian people to establish and maintain their own form of government and domestic polity..." and in 1897 the people spoke (98% of them against annexation) through the Memorial and Ku'e Petitions, along with the Queen's protest which is the reason why the treaty was rejected for not having the 2/3 vote to ratify the treaty of annexation. Opponents to the Newlands Resolution characterized it as an effort to annex Hawai'i by joint resolution after the defeat of the treaty as a deliberate attempt to do unlawfully that which can't be done lawfully.

    The U.S. continuously violates the laws of belligerent occupation and neutrality of the Hawaiian Kingdom. Smoke and mirrors to obfuscate the facts and true status of Hawai'i nationals are employed by the U.S. and their minions, even within the Hawaiian community of which majority of them are in OHA that are pushing the Akaka Bill. It's a divide and conquer technique and involves the Stockholme Syndrome to further confuse the community and na iwi. Manifest Destiny is still alive and well as they enforce the Akaka Bill to corral the Hawai'i nationals to become tribal indians of the U.S. Maka'ala for the semantics they use to further confuse people. The Akaka Bill IS hewa and so is the peace treaty of 1871 for the native Americans; add to this Congress' plenary authority and subjection of the Dept. of Interior. Our beef is with the State Department and not the Interior to settle our grievances. The Kingdom of Hawai'i still exists; so why would OHA want to set up a faux-governing entity to usurp the power and jurisdiction of the kingdom and its territory and deal directly with its "mother", the U.S.A. Our nation is peer to the US and not a subject under it.

    Why give the u.s.a. THE WHOLE PIE when there are still Hawai'i nationals alive and well, living in their own country lawfully?
  • The U.S. is good at repeating thy self. Similar to what occurred to our own po'e, the AKAKA is HEWA! There is no justice from the original writer of this bill. The bill prevents Hawaiians from becoming self sufficient.
  • For 50 Years the State of Hawaii has violated its Trust Obligations to Native Hawaiians. For 116 Years the Federal Government of the United States has violated its own constitutional laws in its dealing wtih the Native Hawaiians and their homeland, the Hawaiian Kingdom government.
