'American Whistleblower Tour' Announced
First Stop of Nationwide Tour Slated for University of Nebraska-Lincoln
Stop Will Feature Prominent Whistleblowers, Pulitzer Prize-Winning Journalist
 
(Washington, DC) -- The Government Accountability Project (GAP) is excited to announce a national tour dedicated to raising awareness of whistleblowing. The kick-off event for the American Whistleblower Tour: Essential Voices for Accountability will take place later this month, September 27, at the University of Nebraska-Lincoln.
 
The Tour is a dynamic campaign aimed at educating the public – particularly America's university students – about the phenomenon and practice of whistleblowing. The 2011-12 Tour is the first of at least seven Tour stops that GAP plans for the current academic year.

The focal point of each Tour stop is a panel featuring high profile whistleblowers discussing their experiences. The stop in Nebraska will also feature a Pulitzer-prize winning journalist. Participants for this stop include:
 
·         National Security Agency (NSA) whistleblower Tom Drake: The case of Tom Drake made national headlines this past summer, and the prosecution of him by the Department of Justice (DOJ) continues to receive widespread coverage. Drake attempted to expose massive NSA mismanagement and the agency’s use of a data collection program that was more costly, more threatening to American citizens’ privacy rights, and less effective than a readily-available alternative. For his actions, Drake was arrested during a raid on his house, subsequently charged under the Espionage Act, and faced 35 years in prison. The case against him collapsed in June, when he pled guilty to exceeding authorized use of a government computer – a misdemeanor. The DOJ dropped all 10 felony counts against him, and the judge excoriated Department lawyers for their conduct.

·         Securities & Exchange Commission (SEC) whistleblower Gary Aguirre: In 2006, Gary Aguirre rocked the financial world by alleging wrongdoing by SEC officials for their failure to not allow a proper investigation to proceed, possibly due to political connections. Aguirre is a former SEC lawyer who was dismissed by the agency following his attempt to subpoena John Mack – a prominent financial figure who later became the CEO of Morgan Stanley – in an insider trading investigation of Pequot Capital Management, one of the country’s former leading hedge funds. Aguirre’s story sparked outrage, a Congressional investigation, and (eventual) vindication by the U.S. Senate. Aguirre has been featured in major media reports over the past months, as he now represents a prominent SEC whistleblower who disclosed that the agency has been "systematically destroying records of its preliminary investigations" once such cases were closed.

·         Department of Justice (DOJ) whistleblower Jesselyn Radack: Radack is a former ethics adviser to the Department of Justice who disclosed that the FBI committed an ethics violation in its interrogation of "American Taliban" John Walker Lindh without an attorney present, that the DOJ attempted to suppress that information, and that former Attorney General John Ashcroft made an incorrect public statement about Lindh. The Lindh case was the first major terrorism prosecution after 9/11. Since her ordeal, Radack has been a champion of whistleblowers, recently serving as counsel on whistleblower issues to Tom Drake. She serves as GAP National Security & Human Rights Director.

·         Kansas City Star investigative reporter Mike McGraw: Mike McGraw is a Pulitzer-Prize winning special projects desk reporter for The Kansas City Star. McGraw has covered a wide range of issues, including organized labor, meatpacking, the federal judiciary, NASA, occupational safety and health issues, building collapses, food safety, housing issues and art world fraud. He is a former member of the board of Investigative Reporters and Editors and a contributor to IRE's The Reporter's Handbook. McGraw has taught investigative reporting at the Missouri School of Journalism and the University of Kansas, and has worked with several whistleblowers on his stories.
 
Other coordinated activities around this tour stop include classroom presentations by whistleblowers and journalists, and a whistleblower-themed film festival.
 
"Whistleblowing is a difficult undertaking, and the public should know that," stated GAP President Louis Clark, who will emcee the upcoming event. "But it is essential for accountability, and democracy, at all levels. Whistleblowers routinely risk their own professional lives to save the actual lives of others. At GAP, we believe that whistleblowers are necessary, need protections, and should be honored for their courage. That's what the American Whistleblower Tour is all about."
 
Goals of the Tour include raising awareness about the vital role whistleblowing has in our democracy, preparing America's youth for ethical decision-making, countering negative connotations associated with whistleblowing, connecting prospective whistleblowers to available resources, and encouraging academic studies of whistleblowing.
 
Impetus
 
In February 2010, GAP teamed up with film production company Participant Media and the Manhattan venue Paley Center for the Media to produce the definitive television presentation on whistleblowing - Anyone Can Whistle: The Essential Role of the Whistleblower in American Society
 
. The event, watched online live by thousands, was the first-ever special explaining and celebrating the role of whistleblowers in our culture. Hosted by Juan Williams (then of NPR), and featuring whistleblower heroes such as Daniel Ellsberg, Frank Serpico, Coleen Rowley and others, the program examined the six stages of the typical whistleblowing experience, celebrated the courage of whistleblowers, and decried the lack of adequate legal protections.
 
More importantly, the presentation educated the public on the practice of whistleblowing. Through the American Whistleblower Tour, we hope to expand upon the goals and the energy that emerged from this past event.

Steve Olafson of Reuters is reporting that the Cherokee Nation is refusing to cooperate with the U.S. government, which warned that the results of the Sept. 24 Cherokee election for principal chief will not be recognized by the U.S. government if the ousted members, known to some as "Cherokee Freedmen," are not allowed to vote.

After the Civil War, in which the Cherokees fought for the South, a treaty was signed in 1866 guaranteeing tribal citizenship for the freed slaves. The U.S. government said that the 1866 treaty between the Cherokee tribe and the U.S. government guaranteed that the slaves were tribal citizens, whether or not they had a Cherokee blood relation.

African Americans lost their Cherokee citizenship last month when the Cherokee Supreme Court voted to support the right of tribal members to change the tribe's constitution on citizenship matters. The change meant that Cherokee Freedmen who could not prove they have a Cherokee blood relation were no longer citizens, making them ineligible to vote in tribal elections or receive benefits. 

"The Cherokee Nation will not be governed by the BIA," Joe Crittenden, the tribe's acting principal chief, said in a statement responding to the U.S. Bureau of Indian Affairs. Crittenden, who leads the tribe until a new principal chief is elected, went on to complain about unnamed congressmen meddling in the tribe's self-governance.

There would be no meddling if the Cherokee Nation were not copying what white Americans did to slaves by denying them citizenship after they were freed, thereby preventing them from fully participating in this nation. The Cherokees, who should know better and do better, we might add, are now doing the same thing. Blacks were slaves and guaranteed Cherokee Nation tribal citizenship after they were freed -- period. To change the rules now is incredible, not to mention racist.

It is ridiculously sad that the same racist ideology that drove white Americans to attempt to extinguish the native population is being invoked to ban blacks from voting in the Cherokee Nation. Now the tribe doesn't want to listen to the government. They had no problem listening when they were fighting with the Confederates so that they could keep their slaves. It sounds like Paulo Freire's Pedagogy of the Oppressed should be required reading for the so-called leaders of the Cherokee Nation.

Rush–Bagot Agreement, (1817), exchange of notes between Richard Rush, acting U.S. secretary of state, and Charles Bagot, British minister to the United States, that provided for the limitation of naval forces on the Great Lakes in the wake of the War of 1812. Each country was allowed no more than one vessel on Lake Champlain, one on Lake Ontario, and two on the upper lakes. Each vessel was restricted to a maximum weight of 100 tons and one 18-pound cannon. The agreement was ratified unanimously by the Senate in 1818. With some modifications, it has remained in force to the present day and has formed the basis of peaceful border relations between the United States and Canada.

 

What Did the Rus-Bagot Treaty do?

Britain and America negotiators agreed to a major disarmament pact. It was for a boundary between America and Canada. In time the agreement was extended to place limits on border fortifications as well. It strictly limited naval armament on the Great Lakes. The Rush-Bagot Agreement was negotiated by Acting United States Secretary of State Richard Rush and the British Minister to Washington Sir Charles Bagot.

The Convention respecting fisheries, boundary and the restoration of slaves between the United States of America and the United Kingdom of Great Britain and Ireland, also known as the London Convention, Anglo-American Convention of 1818, Convention of 1818, or simply the Treaty of 1818, was a treaty signed in 1818 between the United States and the United Kingdom. It resolved standing boundary issues between the two nations, and allowed for joint occupation and settlement of the Oregon Country, known to the British and in Canadian history as the Columbia District of the Hudson's Bay Company, and including the southern portion of its sister for district New Caledonia.

The treaty marked the last permanent major territorial loss of Continental United States, the northern most tip of the territory of Louisiana above the 49th parallel north, known as the Milk River in present day southern Alberta. Britain ceded all of Rupert's Land south of the 49th parallel and west to the Rocky Mountains, including the Red River Colony.

The treaty name is variously cited as Convention respecting fisheries, boundary, and the restoration of slaves,[1] Convention of Commerce (Fisheries, Boundary and the Restoration of Slaves),[2] and Convention of Commerce between His Majesty and the United States of America.[3][4]

  • Article I secured fishing rights along Newfoundland and Labrador for the U.S.
  • Article II set the boundary between British North America and the United States along "a line drawn from the most northwestern point of the Lake of the Woods, [due south, then] along the 49th parallel of north latitude..." to the "Stony Mountains"[3] (now known as the Rocky Mountains). Britain ceded the part of Rupert's Land and Red River Colony south of the 49th parallel. This settled a boundary dispute caused by ignorance of actual geography in the boundary agreed to in the 1783 Treaty of Paris that ended the American Revolutionary War. That earlier treaty had placed the boundary between the United States and British possessions to the north along a line going westward from the Lake of the Woods to the Mississippi River. The parties failed to realize that the river did not extend that far north, so such a line would never meet the river. The new treaty also created the anomalous Northwest Angle, the small section of the present state of Minnesota that is the only part of the United States outside Alaska north of the 49th parallel.
  • Article III provided for joint control of land in the Oregon Country for ten years. Both could claim land and both were guaranteed free navigation throughout.
  • Article IV confirmed the Anglo-American Convention of 1815, which regulated commerce between the two parties, for an additional ten years.
  • Article V agreed to refer differences over a U.S. claim arising from the Treaty of Ghent, which ended the War of 1812, to "some Friendly Sovereign or State to be named for that purpose". The U.S. claim was for return of, or compensation for, slaves that were in British territory or on British naval vessels when the treaty was signed. The Treaty of Ghent article in question was about handing over property, and the U.S. claimed that these slaves were the property of U.S. citizens.[3]
  • Article VI established that ratification would occur within at most six months of signing the treaty.

The treaty was negotiated for the U.S. by Albert Gallatin, ambassador to France, and Richard Rush, minister to the UK; and for the UK by Frederick John Robinson, Treasurer of the Royal Navy and member of the privy council, and Henry Goulburn, an undersecretary of state.[4] The treaty was signed on October 20, 1818. Ratifications were exchanged on January 30, 1819.[1] The Convention of 1818, along with the Rush-Bagot Treaty of 1817, marked the beginning of improved relations between the British Empire and its former colonies, and paved the way for more positive relations between the U.S. and Canada, notwithstanding that repelling U.S. invasion was a defence priority in Canada until the Second World War.

Despite the relatively friendly nature of the agreement, it nevertheless resulted in a fierce struggle for control of the Oregon Country in the following two decades. The British-chartered Hudson's Bay Company, having previously established a trading network centered on Fort Vancouver on the lower Columbia River, with other forts in what is now eastern Washington and Idaho as well as on the Oregon Coast and in Puget Sound, undertook a harsh campaign to restrict encroachment by U.S. fur traders to the area. By the 1830s, with pressure in the U.S. mounting to annex the region outright, the company undertook a deliberate policy to exterminate all fur-bearing animals from the Oregon Country, in order to both maximize its remaining profit and to delay the arrival of U.S. mountain men and settlers. The policy of discouraging settlement was undercut to some degree by the actions of John McLoughlin, Chief Factor of the Hudson's Bay Company at Fort Vancouver, who regularly provided relief and welcome to U.S. immigrants who had arrived at the post over the Oregon Trail.

By the middle 1840s, the tide of U.S. immigration, as well as a U.S. political movement to claim the entire territory, led to a renegotiation of the agreement. The Oregon Treaty in 1846 permanently established the 49th parallel as the boundary between the United States and British North America to the Pacific Ocean.

On October 6, we will have been fighting in Afghanistan for 10 years! If you, like me, think our endless occupations of Afghanistan and Iraq are wrong, then join me in DC

When I volunteered to be part of the team that reopened the U.S. Embassy in Afghanistan in December 2001, I believed the U.S. actions in Afghanistan were justified. But I later realized that the presence of U.S. troops was only fueling the cycle of violence. And when President Bush decided to invade Iraq on the basis of what I knew were lies, I resigned from the State Department after 16 years of service.

It was with a heavy heart that I watched the Bush administration commit torture and completely ignore the Geneva Conventions and the Constitution. I am delighted that CODEPINK continues to call for accountability for those war criminals. Whether interrupting speaking engagements

 
across the country, pressuring the Justice Department to take action or moving Cheney's book into the Crime Section
 
, we can take action.

The State of Georgia has scheduled Troy Davis’ execution for Sept. 21.


Millions of U.S. and global activists are engaged in a massive effort to stop this legal lynching. They are signing petitions, organizing rallies and meetings, and contacting elected officials and other influential individuals. A Twitter account at hash tag Too Much Doubt is rapidly informing millions more.


Every avenue is being pursued to mobilize public opinion to influence the Georgia Pardons and Parole Board — which meets on Sept. 19 — to grant Davis clemency.


The governor-appointed five-member board has the authority to stop the execution. Although the board has previously denied Davis clemency, three new members have not heard all the details of his case.

One important detail that shouldn't have been missed is the fact that 7 out of 9 of the witnesses have recanted their testimony claiming police coercion made them identify Davis. And, given that there was no physical or forensic evidence presented implicating Davis, the witness testimony alone condemned him to death.


On Sept. 15, organizational representatives and community members delivered hundreds of thousands of petitions to the board’s offices.

Sept. 16 has been declared the International Day of Solidarity with Troy Davis. Protests will take place across the United States — in Boston, New York City, Philadelphia, Providence, Los Angeles and elsewhere — and abroad.

"This is nothing less than the legal lynching of yet another Black man by a system that is hell bent on racist and class terror against all working and poor people and especially people of color, especially during an economic crisis. But we're not alone, millions have emailed and signed petitions on Troy's behalf and actions all over the country and beyond are being planned," said John Parker of the International Action Center.

Reading his words, I thought of Troy Davis, who is scheduled to be executed in Georgia next Wednesday despite serious doubts about his guilt. Eynulla's letter inspires me to continue standing up for unjustly imprisoned individuals around the world, and I hope it does the same for you. I will never forget you, to the end of my life

Dear amelia,

First they beat my head with steel rods, and I nearly died.

They arrested me. Fined me. Harassed me. Charged me with absurd and inconceivable accusations.

My editor-in-chief, Elmar Huseynov, was assassinated.

I am a journalist who challenged my government, and paid a terrible price for it. Four years of my life were stolen.

In prison, I was between life and death. Life in a torture chamber became pointless, ceased its normal rhythms. Violence obliterated all signs of vitality.

    One important detail that shouldn't have been missed is the fact that 7 out of 9 of the witnesses have recanted their testimony claiming police coercion made them identify Davis. And, given that there was no physical or forensic evidence presented implicating Davis, the witness testimony alone condemned him to death.


    On Sept. 15, organizational representatives and community members delivered hundreds of thousands of petitions to the board’s offices.

    Sept. 16 has been declared the International Day of Solidarity with Troy Davis. Protests will take place across the United States — in Boston, New York City, Philadelphia, Providence, Los Angeles and elsewhere — and abroad.

    "This is nothing less than the legal lynching of yet another Black man by a system that is hell bent on racist and class terror against all working and poor people and especially people of color, especially during an economic crisis. But we're not alone, millions have emailed and signed petitions on Troy's behalf and actions all over the country and beyond are being planned," said John Parker of the International Action Center.

    Steve Olafson of Reuters is reporting that the Cherokee Nation is refusing to cooperate with the U.S. government, which warned that the results of the Sept. 24 Cherokee election for principal chief will not be recognized by the U.S. government if the ousted members, known to some as "Cherokee Freedmen," are not allowed to vote.

    After the Civil War, in which the Cherokees fought for the South, a treaty was signed in 1866 guaranteeing tribal citizenship for the freed slaves. The U.S. government said that the 1866 treaty between the Cherokee tribe and the U.S. government guaranteed that the slaves were tribal citizens, whether or not they had a Cherokee blood relation.

    African Americans lost their Cherokee citizenship last month when the Cherokee Supreme Court voted to support the right of tribal members to change the tribe's constitution on citizenship matters. The change meant that Cherokee Freedmen who could not prove they have a Cherokee blood relation were no longer citizens, making them ineligible to vote in tribal elections or receive benefits. 

    "The Cherokee Nation will not be governed by the BIA," Joe Crittenden, the tribe's acting principal chief, said in a statement responding to the U.S. Bureau of Indian Affairs. Crittenden, who leads the tribe until a new principal chief is elected, went on to complain about unnamed congressmen meddling in the tribe's self-governance.

    There would be no meddling if the Cherokee Nation were not copying what white Americans did to slaves by denying them citizenship after they were freed, thereby preventing them from fully participating in this nation. The Cherokees, who should know better and do better, we might add, are now doing the same thing. Blacks were slaves and guaranteed Cherokee Nation tribal citizenship after they were freed -- period. To change the rules now is incredible, not to mention racist.

    It is ridiculously sad that the same racist ideology that drove white Americans to attempt to extinguish the native population is being invoked to ban blacks from voting in the Cherokee Nation. Now the tribe doesn't want to listen to the government. They had no problem listening when they were fighting with the Confederates so that they could keep their slaves. It sounds like Paulo Freire's Pedagogy of the Oppressed should be required reading for the so-called leaders of the Cherokee Nation.

    Rush–Bagot Agreement, (1817), exchange of notes between Richard Rush, acting U.S. secretary of state, and Charles Bagot, British minister to the United States, that provided for the limitation of naval forces on the Great Lakes in the wake of the War of 1812. Each country was allowed no more than one vessel on Lake Champlain, one on Lake Ontario, and two on the upper lakes. Each vessel was restricted to a maximum weight of 100 tons and one 18-pound cannon. The agreement was ratified unanimously by the Senate in 1818. With some modifications, it has remained in force to the present day and has formed the basis of peaceful border relations between the United States and Canada.

In time the agreement was extended to place limits on border fortifications as well. It strictly limited naval armament on the Great Lakes.     The Convention respecting fisheries, boundary and the restoration of slaves between the United States of America and the United Kingdom of Great Britain and Ireland, also known as the London Convention, Anglo-American Convention of 1818, Convention of 1818, or simply the Treaty of 1818, was a treaty signed in 1818 between the United States and the United Kingdom. It resolved standing boundary issues between the two nations, and allowed for joint occupation and settlement of the Oregon Country, known to the British and in Canadian history as the Columbia District of the Hudson's Bay Company, and including the southern portion of its sister for district New Caledonia.

    The treaty marked the last permanent major territorial loss of Continental United States, the northern most tip of the territory of Louisiana above the 49th parallel north, known as the Milk River in present day southern Alberta. Britain ceded all of Rupert's Land south of the 49th parallel and west to the Rocky Mountains, including the Red River Colony.

    The treaty name is variously cited as Convention respecting fisheries, boundary, and the restoration of slaves,[1] Convention of Commerce (Fisheries, Boundary and the Restoration of Slaves),[2] and Convention of Commerce between His Majesty and the United States of America.[3][4]

    • Article I secured fishing rights along Newfoundland and Labrador for the U.S.
    • Article II set the boundary between British North America and the United States along "a line drawn from the most northwestern point of the Lake of the Woods, [due south, then] along the 49th parallel of north latitude..." to the "Stony Mountains"[3] (now known as the Rocky Mountains). Britain ceded the part of Rupert's Land and Red River Colony south of the 49th parallel. This settled a boundary dispute caused by ignorance of actual geography in the boundary agreed to in the 1783 Treaty of Paris that ended the American Revolutionary War. That earlier treaty had placed the boundary between the United States and British possessions to the north along a line going westward from the Lake of the Woods to the Mississippi River. The parties failed to realize that the river did not extend that far north, so such a line would never meet the river. The new treaty also created the anomalous Northwest Angle, the small section of the present state of Minnesota that is the only part of the United States outside Alaska north of the 49th parallel.
    • Article III provided for joint control of land in the Oregon Country for ten years. Both could claim land and both were guaranteed free navigation throughout.
    • Article IV confirmed the Anglo-American Convention of 1815, which regulated commerce between the two parties, for an additional ten years.
    • Article V agreed to refer differences over a U.S. claim arising from the Treaty of Ghent, which ended the War of 1812, to "some Friendly Sovereign or State to be named for that purpose". The U.S. claim was for return of, or compensation for, slaves that were in British territory or on British naval vessels when the treaty was signed. The Treaty of Ghent article in question was about handing over property, and the U.S. claimed that these slaves were the property of U.S. citizens.[3]
    • Article VI established that ratification would occur within at most six months of signing the treaty.

    The treaty was negotiated for the U.S. by Albert Gallatin, ambassador to France, and Richard Rush, minister to the UK; and for the UK by Frederick John Robinson, Treasurer of the Royal Navy and member of the privy council, and Henry Goulburn, an undersecretary of state.[4] The treaty was signed on October 20, 1818. Ratifications were exchanged on January 30, 1819.[1] The Convention of 1818, along with the Rush-Bagot Treaty of 1817, marked the beginning of improved relations between the British Empire and its former colonies, and paved the way for more positive relations between the U.S. and Canada, notwithstanding that repelling U.S. invasion was a defence priority in Canada until the Second World War.

    Despite the relatively friendly nature of the agreement, it nevertheless resulted in a fierce struggle for control of the Oregon Country in the following two decades. The British-chartered Hudson's Bay Company, having previously established a trading network centered on Fort Vancouver on the lower Columbia River, with other forts in what is now eastern Washington and Idaho as well as on the Oregon Coast and in Puget Sound, undertook a harsh campaign to restrict encroachment by U.S. fur traders to the area. By the 1830s, with pressure in the U.S. mounting to annex the region outright, the company undertook a deliberate policy to exterminate all fur-bearing animals from the Oregon Country, in order to both maximize its remaining profit and to delay the arrival of U.S. mountain men and settlers. The policy of discouraging settlement was undercut to some degree by the actions of John McLoughlin, Chief Factor of the Hudson's Bay Company at Fort Vancouver, who regularly provided relief and welcome to U.S. immigrants who had arrived at the post over the Oregon Trail.

    By the middle 1840s, the tide of U.S. immigration, as well as a U.S. political movement to claim the entire territory, led to a renegotiation of the agreement. The Oregon Treaty in 1846 permanently established the 49th parallel as the boundary between the United States and British North America to the Pacific Ocean.
