                              OUTRIGHT DEFIANCE OF TRADITIONAL RIGHTS AND CULTURAL

                              PRACTICES OF HAWAIIAN NATIONALS

REGARDING:         DISRESPECTFULLY REMOVING IDENTIFIED HAWAIIAN NATIONAL

                             HUMAN REMAINS, IWIAWALOA, FROM GRAVESITES AT HALEAUAU,

                             LIHUE, ISLAND OF O’AHU, KO HAWAII PAE AINA, H.I. ON MAY 14, 2010,

                             APRIL 27, 2011 AND THROUGH TO THE PRESENT

                             LAWFUL NOTICE OF OBLIGATORY RESPONSIBILITY: REQUEST FOR

                             CLARIFICATION

This is to inform your organization, yourself and staff, of your failure to perform in accordance with

your United States law.

From the onset, exposure, scattering and damages of our family’s iwiawaloa on May 14, 2010

to present, your organization has failed and continues to ignore our requirement to reveal and

affirm your claim of clear, unbroken ownership to our burial grounds in question, of which your

claim to own and/or control as PROPERTY OF THE UNITED STATES GOVERNMENT.

As Hawaiian Nationals, we have never subscribed nor acquiesced to your Native American

Graves Protection and Repatriation Act (NAGPRA) which was created for American Indians, not

foreign Hawaiian National Citizens on their own foreign national land. You misrepresent the truth

and attempt to deceive when you use foreign United States law on Hawaiian National soil, which

soil has never transferred to United States “exclusive territorial jurisdiction” . As the United States

Commander on Hawaiian National soil, you are well aware and knowledgeable of these facts of

law.

Lawful Notice of Obligatory Responsibility: Request for clarification.

To the United States Army Garrison-Hawaii, Commanding:

1. Please provide in writing your claim of “exclusive territorial jurisdiction” over Hawaiian land and

    Nationals which claim of jurisdiction has not been revealed or proven. Jurisdiction over the

    land (in rem) and in personum (Private Citizen) must be proven in writing, not just

    assumed, not just stated, and not just claimed without proof and written evidence of

    law. Jurisdiction when challenged, as in this instant, must be responded to IN

    WRITING AND PROVEN, AS REQUIRED BY UNITED STATES LAW.

2. Regarding: International Humanitarian Law – Treaties and Documents

    Please confirm or deny Convention (IV) relative to the Protection of Civilian Persons in Time of

    War. Geneva 12 August 1949, i.e., Article 42, 43, and 56 as either lawfully applying or not

    lawfully applying in this situation. Noticed: Universal Declaration of Human Rights Article 18.

Theretofore, Colonel Mulbury in receipt of Certified Mail 7009 2250 0000 3331 3549 dated May

03, 2011and your recognition of Native Hawaiian claimants of cultural affiliation will not extinguish

Hawaiian National STATE OF HAWAII recognized lineal descendants, supra, to our iwiawaloa

buried in the land at Haleauau, Lihue, Island of O’ahu, Ko Hawaii Pae Aina, H.I. Noticed: Office of

the Attorney General, The Hawaiian Islands, H.I. January 08, 2011 Certified Mail 7009 0820 0000

3563 2883 and Certified Mail 7009 0820 0000 3563 2906 sent United States Postal Service to the

above named parties.
