  • The intent of the laws of the Hawaiian Kingdom was to perpetuate the indigenous Hawaiian people and their culture. This is why for me it is so important that our people Go Back Home to the Hawaiian Kingdom. Everything for the perpetuation of our people and our culture is there. Forget about the "Many Different Models of Nationhood for our people." Queen Liliuokalani and our ancestors gave their lives for the future of our people. So that one day our people would wake up to the truth and Go Home to the Hawaiian Kingdom. There will never be any Justice for our people under the American system. United States has had over 115 years to correct the wrongs done to our people ever since it envaded and occupied our nation the Hawaiian Kingdom thru an Act of War on January 16, 1893. An "Act of War" against our nation that was no threat to the Unied States. As the Hawaiian Kingdom did not have a Military Force or any type of Weapons of Massive Destructions. Justice Delayed is Justice Denied.
    • it all comes down to cheifs and peoples, when the queen stepped down the cheifs and people continued on. check out the kuhio council .the un charter 1946
  • I am biased when it comes to title. Irrelevant of what some people claim... some title was transferred without OUR consent. The Royal Patents are still in tact. Though some people will try to discredit their validity nowadays when it comes to title in the HAOLE World there must be 1) Acceptance and 2) Delivery but an inherent problem is that we never consented to transfer title. This is key but some people try to distract us with trivialities.

With all due respect to Governor Lingle she normally tries to do the right thing like helping me rescue an oiwi baby who was born with ice in his system but in the case of so-called "ceded" lands which were never ceded a key which I think Chief Justice Moon knows that title was never transferred by us with our consent. That is why they have some major problems now because they already know that many title have encumbrances which scares people who are property owners in Hawai'i but in my experience most property owners whom I know are not greedy. They WANT to do the right thing and not do people wrong.

However in this case greed as well as power are in the picture so some people who do not want to lose their porfolio or parts of their portfolio will make any kine. The truth is though that many title in Hawai'i have encumbrances.

No it is not oiwi-s' fault.
    We did nothing wrong.

In that way Mahealani Ventura Oliver is right in that some banks and mortgage companies put liens on property knowing that some oiwi would lose it. By the way full disclosure is required these days so while some people have a problem with her technically she is right. Sorry to disappoint those people who believe the local media B.S. but she is onto something which they don't want us to focus on. Even then some people talk bad about her and not just in the media. Some even try to make a criminal out of her but surprise surprise she is doing the right thing.

Even some title companies give title insurance for some land KNOWING they have encumbrances. It is a matter of doing the right thing.

IMHO oiwi should continue to fight for what is rightfully theirs. Do not listen to the media. Do not listen to some of our so-called leaders who lack knowledge in title or in some cases they know about title yet transfer title without our consent anyway knowing that is not what WE want.

More importantly remember that there are SOME people out there who will run us over, try to degrade us, try to de-humanize us, and/or disrespect us because they value the land more than they value our lives. Some people will even talk bad about and/or TRY to discredit and/or try to criminalize some oiwi who KNOW about Royal Patents and how they work in relation to land and title because they fear losing money and/or their appreciable assets and yes... land is an appreciable asset which can bring out the WORSE in some people going so far as them lying in order to make a profit. IMHO be very careful about the source of information and ask yourself WHY they are saying what they are saying. Also ask yourself if and what is their motive.

    Just my mana'o.

    Aloha, L
    • Great response, Lana. When I spoke to Mahealani a few years back, that's exactly what she was doing. I'm wondering now if they are not confusing her with Mahealani Asing Kahau and the Iolani Palace incident. They are two different people. What land owners forget is that they don't have allodial title and the U.S. government has claimed that. This is why we pay land taxes to the State/Fed. Especially in Hawai'i, these governing entities do not have superior title/allodial title thus fee simple, leasehold ultimately belong to the one that holds allodial/superior title. It is believed God holds the Supreme title to all lands which was vested in the monarchs of the world and the original peoples of the land.
      • Aloha Tane,
I think there is perhaps no legal standing for the Americans on the issue of the Royal Patents. I believe they are quite aware of this and this is why the courts have been throwing them out summarily. The State has used tactics such as holding briefs past the date of filing and contacting the other side to come in to request summary dismissal without our knowledge. THEY KNOW they could lose on merit and so does Mahealani. The idea is to get to court and use the law which favors us.
I see most of the State court rulings on what I call the "Inconvenience clause". It is inconvenient for the state to rule in our favor, not because we are not correct in the law, no ka mea they would loose all that was taken illegally (Which is everything). Can we expect the court to rule on it own legitimacy?
My real question is can an impartial arbiter of justice be found, somewhere?

        Mahalo Kai
        • You're correct! This is why they have been fighting the Hawaiian rights and titles so vigorously in THEIR courts to subdue our challenges. They are running scared more than before because we're educating ourselves and become more vocal in contesting their jurisdiction and assaults against us. Occupation is not a pretty picture for them and de-occupation is a devastation to their image, morale, and exposes their shame and dishonor throughout the world. Eventually, they will have to do the right thing and ultimately de-occupy our country and it's coming to a head the more Hawai'i nationals realize the fraud. We have one of the longest running belligerent occupation in the world. It is coming to light through all our efforts to expose the crime.
      • Aloha e Tane.

I have read a few people describe Mahealani Ventura Oliver as a scammer, traitor, etc... but I know alot about title and despite the local media in Hawai'i she is doing the right thing and is on to something so key yet they try to talk bad about her as though she dunno what she doing. I work with land and title every day and I can say that NO she is NOT a scammer. DESPITE THE LOCAL B.S. MEDIA especially writers in the Honolulu Advertiser like Peter Boylan who wrote this B.S. article:

        http://www.honoluluadvertiser.com/article/20081118/NEWS01/811180356...

As a writer he knows that people THRIVE on controversy. Instead of reporting the TRUTH they tend to report DRAMA to sell papers and/or ad space. Sorry to disappoint the pseudo-intellectuals but she is RIGHT. I have a close friend who work on high profile cases who tells me that reporters, "journalists," etc these days report B.S. to stir up drama. They do NOT report the truth anymore but then look at the papers that are folding. Ironic isn't it? LOL

Mahealani Ventura Oliver has experience with title and title research. One can safely deduce that she knows that some title in Hawai'i have encumbrances. Unfortunately some people trust the local B.S. media over some of our OWN people LIKE HER who are trying to HELP us instead of hurt us but I give props to her. More oiwi SHOULD challenge TITLE INSTEAD OF CHALLENGING HER LOL

When people imply that she is and/or say that she is shady it only shows to me that they believe the B.S. local media in Hawai'i. For the time being property owners are in a Catch 22: Do they continue to pay or do they risk losing their land? It depends on the individual but for ME I continue to pay property taxes on property that I have title to and many oiwi choose to continue to. I would not fault them because they are doing what THEY have to do and they risk losing their title irrelevant of what others think about it.

For the time being I strongly urge other oiwi to continue to pay property taxes only because as much as some things in the Haole World can hurt us... some things can also HELP us. In this way they KNOW that by paying property taxes we will NOT give up... which IMHO is key.

Whatever other oiwi believe though... I hope they do NOT believe ANYTHING in the local mainstream Hawai'i media. They are largely BIASED AGAINST OIWI, INACCURATE, and fail to FULLY disclose that land is an appreciable asset and that is the main reason why they fail in JOURNALISTIC INTEGRITY. I take Mahealani Ventura Oliver's mana'o and actions over the local B.S. Hawai'i media which tries to portray oiwi as though we are scammers when we are not. There is NOTHING wrong with fighting for what is rightfully *ours* as in Royal Patents. Even then even if they discuss Royal Patents and inaccurately claim that they do not exist then oiwi STILL can claim that we never transferred title without our/our kupuna-s consent. Instead of berating Mahealani Ventura Oliver who is DOING THE RIGHT THING we should be berating the THIEVES who transferred title and/or TRY to transfer title without our WRITTEN consent!

BTW anything dealing with land must be written. Obviously some of us/our kupuna did NOT sign. In any case we need to SUPPORT people like Mahealani Ventura Oliver who ALREADY KNOWS THIS and knows what she is doing instead of TRYING TO DISCOURAGE HER and/or calling her NASTY NAMES. Obviously I fully support her and what she is doing. Unfortunately some people accuse her of being a thief instead of going after the REAL thieves who took and/or are taking what does NOT belong to them.

        Aloha, L
        • I'm convinced now that he is talking about a different Mahealani and errantly used her name. I was perplexed when he referenced her as one of those that named themselves ali'i and Queen of Hawai'i. I have never heard that from Mahealani Ventura-Oliver. As I said when I last spoke to her several years ago, she was busy fighting to get clarity of title in the courts and not about starting a nation but conducting title search through the Kingdom's documents that have superior titles to U.S. clouded titles.

Randolph Hearsh and Pulitzer were the ones that started yellow journalism from the period of "Remember the Maine!" Spanish - American War. That technique and strategy is often used and more so today than before. The journalists, today, will find it offensive to accuse them of using that tactic in their reporting. I had one outraged when I accused journalists of using yellow journalism that she refused to print my letter in the newspaper and told me so. Sheesh! I was being diplomatic and general about it, yet she still took offense of it. LOL... I guess I peeled the banana too neatly!
          • Sorry Tane but to me it looked like he talked bad about her here:

"I mean, from Mahealani Oliver, who leases lands to kanaka's for $500.00 a month for 20 yrs to lands that are not even hers and fraudently creating a cult like mortgage scam, to Akahi Nui, breaking into the palace trying to chain himself to the throne (and one of his minions also punched a wahine trying to get into the palace), to Mahealani Asing calling up the nations with treaties with Hawaii cancelling them and locking up the Palace grounds, Charlie Maxwell selling out his own people for the almighty dollar working and consulting for Dowling, even our own Kupuna Council who have received monetary stipends to push thru for the development of Wailea 670....too many to list! How can I or anyone not see this as hurting our attempts for independence?"

            http://www.maoliworld.com/forum/topics/the-end-of-the-kanaka-maoli?...

As usual the local B.S. media tries to portray her as though she is a scammer. Sorry to disappoint those people who actually believe the B.S. Hawai'i media but she knows what she is doing when it comes to some title in Hawai'i still having encumbrances. Some people want to try to discredit her though because it is a threat to their status quo.

            Aloha, L
            • That journalist stated many errors and disinformation in his article. Yes, Mahealani is a threat to the State's land control. Royal patent has superior title which the state does not want anyone to know. The state has already been forced to recognize kuleana land rights despite the myriad of land reforms many which are vacuous attempts at stealing.
