starbulletin.com > Business > State Agency Opposes Full Maui Stream Diversion By Allison Schaefers POSTED: 01:30 a.m. HST, Dec 17, 2009 The state Division of Aquatic Resources and the Native Hawaiian Legal Corp. argued yesterday against a staff recommendation from the state Commission on Water Resource Management to maintain most of East Maui's stream diversions. Commission staff recommended keeping diversions at 18 out of 19 East Maui streams, which have been used for more than 100 years to provide water for sugar plantations on the Central Maui plains. However, the Division of Aquatic Resources recommended restoration for eight streams. The Native Hawaiian Legal Corp. asked commissioners to do more research before favoring the state's only remaining sugar plantation, Hawaiian Commercial & Sugar Co. "They recommended not to do any water restoration except at Makipipi stream," said Camille Kalama, an attorney for the Native Hawaiian Legal Corp., which represents the interests of Na Moku Aupuni o Koolau Hui, a group of East Maui families and farms who compete with agricultural businesses for water. Clients who live near other Maui streams -- Waikamoi, Alo, Wahinepee, Puohokamoa, Haipuaena, Punalau-Kolea, Honomanu, Nuaailua, Ohia, West Wailuaiki, East Wailuaiki, Kopiliula, Puakaa, Waiohue, Paakea, Waiaaka, Kapaula and Hanawi -- have been harmed by the diversions, Kalama said. The commission, which listened to more than seven hours of testimony, plans to meet today for delilberations and a decision.

  • The taro farmers always had the riparian rights to the water. Their use should not be hindered. That's the law the alleged State of Hawai'i has ignored. Another reason why the U.S. has to de-occupy Hawai'i.

    • As a youth, we'd go sledding or surfing on the snow. There wasn't any entrance fee and the State rangers monitored the summit. The paniolos would go riding within the crater and use small caves to protect them from the weather. My grand-uncle Louis Fernandez and his cousin Kapohakimohewa wrote Kilakila Haleakala while up their horseback-riding within the crater. We also have a family burial cave located about half-way down the bottomless pit. The entrance was miles away in the Kaupo makai area. There is a lot of history of my family there and stories of the time while I grew up. To see what they have done there is a crime. One more reason why the U.S. has to de-occupy our country.

    water is an issue on Maui Nui
    as you can see our maui streams is with in our Ahupua'a's
    look how many ohana's is affected by the diversions of this illegal
    county and state.

    it's like Haleakala, we have spoken aggressively against their telescopes
    and still the ears of the illegal, turn away and manage to find more illegal ways to make it
    legal in their illegal system.

    but we not giving up
    we already gotten one stream back
    we look forward to see more back handed back to us
    even Lingle shocked everybody yesterday
    and more surprises will be granted back to us
    i know it will happen in my generation, changes will be on our side

    now we need to make the next generation
    to be ready to take charge and lead our Hawaii Kingdom Government...........................~da princess~
