Environmental attorney hired to fight Honolulu rail

HONOLULU (HawaiiNewsNow) - Rail opponents have added to their arsenal hiring an attorney who helped write national environmental laws.
Cliff Slater, the leader of HonoluluTraffic.com, announced he has retained attorney Nicholas Yost. Yost worked on the President's Council on Environmental Quality and has represented Native Americans and environmentalists.
Yost claims there are various legal deficiencies with the rail's environmental impact statement and the record of decision, namely that the project doesn't avoid historical sites, it didn't adequately study alternatives and it has a skewed economic plan.
Yost also claims the entire project must be studied at once not in segments saying only the first 20 miles of track were reviewed, but the three additional spurs to Waikiki, UH Manoa and East Kapolei were left out.
Former Governor Ben Cayetano and State Senator Sam Slom are also plaintiffs in the case.
They plan to file the lawsuit in the next three to four weeks.
