In todays paper Star Advertiser "Judges cite "Kill Haole Day', written by Ken Kobayashi it brought back a heap of memories.

When I read "Chief Appeals Judge Alex Kozinski and Appeals Judge Stephen Reinhardt wrote strongly worded dissents, referring to "Kill Haole Day" at Hawaii's schools and arguing the four would be endangered in a "racially charged environment." That tells me something is ill and false. Federal Judges lied in a Federal Court by referencing the wrong incident!

The Judges could not have come from ‘Kill Haole Day’, because a case was never filed against the students at Kailua High School that came up with that attitude.  That attitude happened after I graduated from Kailua High School, and at that time the Vietnam War was hot as ever, and the Civil Rights movement was happening.  Up until these two populace protests, Kailua Staff was miss treating non white students.  I know because I was there and I experienced and how the staff segregated us with a pink paper.  It didn't matter what race you were, Kailua High School Staff decide to pink those of us that had an address not in their Kailua District.  Our curriculum for non haole consisted of non writing and non math classes.  Dummying down the dark races kept us away from colleges.

I never understood their reasoning as to why SAT scores needed to be high and we would bring their scores down.  That meant the best colleges would not accept Kailua High School Students.  I never understood that type of reasoning.  But the 'best colleges' was a race to the top issue for Kailua High School Staff.  Thus the element of schools in the judge’s minds.

But, one must do a little bit history 'thinking process' and connect the dots.  Before, I raise the consciousness; I have to say that I disagree to the validity of the author.  And I don't have time to read the book to site from text.  The book I am talking about is "Race, Rape, and Clarence Darrow's Spectacular Last Case --Honor Killing" by David E. Stannard.  I have no respect to restrictive writing, shall I say fictional history.  Joseph Kahahawai and the people of Maunawili-Kailua deserved quality academic research for the book was factually convenient to meet the United States grinding racism and labor of slavery, however, negligent in the real truth about the treatment of Joseph Kahahawai's murder.  I will never understand why Professor Stannard grayed the facts and lied about 'white' ritual.  Missionaries removed penises from Ki'i's and displayed their desecrations in Hawaii Art Museums.  Oglala tribal people had their people murdered and penis removed by their enemies.  I just don't understand why!

My heart sank when I read what the Federal Judges said.  Here is a text excerpt authored by Professor Stannard.  "Darrow's restraint in cross-examination at first puzzled the press.  Then with a rush of unanimity, reporters decided that it was part of an overall master plan.  It was only matter of time, the Hearst news service reported, before “the wily leader in many spectacular defensive court fights will seize upon testimony...to free the four Americans."

And when Paul Alston attorney said, "...called the dissents "factually wrong and just off-based,"  It just reminded me of this "All the attorneys for the prosecution, and those for the defense, as well as the judge, knew that legally my clients were guilty of murder."  This is exactly my sentiments, who in the hell is committing the intended injury to all the people of Hawaii?

The case that the Judges were citing was the Massie Case and the same town Kailua.

  • Mahalo,

That's what I was trying to say that he was acting in reverse, however, a judge needs to cite a case and Clarence Darrow was a broke lawyer. He came to Hawaii because he won a case for African Americans, but his reputation was nile in his neck of the woods, so he was offered this job knowing that no matter what he was going to win because of his patriotic oath, the military, and the rich and able to pay Massie's mother in law in Hawaii Nei.

    ugh!
  • I'm glad you posted about this. I responded there stating that the judge is accusing us of being racist when him mentioning "Kill a Haole Day" is racist in and of itself.
