STATES AGENTS ON FOREIGN HAWAIIAN NATIONAL AINA IN
CONFLICT AND OUTRIGHT DEFIANCE OF CULTURAL RIGHTS AND
PRACTICES OF HAWAIIAN NATIONALS.
REGARDING: DISRESPECTFULLY REMOVING IDENTIFIED HAWAIIAN NATIONAL
HUMAN REMAINS, IWIKUPUNA, FROM GRAVESITES AT HALEAUAU,
LIHUE, ISLAND OF O’AHU, KO HAWAII PAE AINA;
OUR MEETING OF THURSDAY SEPTEMBER 23, 2010, 18:30 AT

WITH YOU AND YOUR STAFF REGARDING OUR PREVIOUSLY
NOTED JUNE 01, 2010 DISPOSITION FOR OUR FAMILY HUMAN
REMAINS, IWIKUPUNA AINA;
AND LAWFUL REQUEST FOR CLARIFICATIONS.

This is to inform your Organization, yourself and your staff, that we are disappointed at the
manner in which your staff condoned the extreme, discourteous and inappropriate conduct by not
just your female staff member who forcefully and rudely closed the door on our family member,
but that your legal counsel and staff condoning the belligerent and rude conduct of one Hawaiian
individual who was more concerned about his prideful genealogy than that of the iwi for which we
were assembled. There was absolutely no control exhibited by your staff to conduct a cordial
meeting complimentary to both we Hawaiian Nationals or the United States Military, as was
expected.
To your benefit, it is our understanding that being new to the Hawaiian Islands, you were not
properly prepared nor given adequate information regarding the established posture of ‘Aha
Kukaniloko/Koa Mana, the State of Hawaii recognized lineal descendants; our continuing and
peaceful twelve (12) year relationship explicit to Hawaiian National traditional comprehension;
seizure of, destruction and willful damage done to our National Treasures, historic monuments,
works of art and science, and our sacred ancestral burial places. To we Hawaiian Nationals, the
iwi, (bones of our family members) are a part of the land and to disturb and remove them is to
desecrate our own lives and well-being, for the life is in the land: “ua mau ke ea o ka aina i ka
pono” translated “the life of the land is perpetuated in righteousness.” Our life is in the
land and our iwi are our life.
Your Organization also failed to reveal and affirm your claim of clear land title ownership of our iwi
sites in question, which your Organization claims to own and/or control as PROPERTY OT THE
UNITED STATES GOVERNMENT. Our legal counsel has provided you a copy of a case wherein
the State of Hawaii and United States Federal Government could not prove any lawful
ownership of the land that you now claim as United States Military property.
Lawful Notice of Obligatory Responsibility: Request for clarifications.
To the United States Army Garrison-Hawaii, Commanding:
1. Please prove your claim of “exclusive territorial jurisdiction” over Hawaiian land and
Nationals which claim of jurisdiction has not been revealed or proven. Jurisdiction over
the land (in rem) and in personum (Private Citizen) must be proven in writing, not
just assumed, not just stated, and not just claimed without proof and written
evidence of law. Jurisdiction when challenged, as in this instant, must be
responded to IN WRITING AND PROVEN, AS REQUIRED BY YOUR OWN UNITED
STATES LAW.
Please review the lost Department of Land and Natural Resources (DLNR) case
(DLNR Case No. MA 09-03) documented in the United States Court for the Hawaii
District as filing (MC 09 000270 JMS BMK of 08/30/2009, et al.) proving lack of
United States jurisdiction on Hawaiian National lands, which was provided to you
and your legal counsel by our legal counsel at the September 23, 2010 meeting.
2. Regarding: International Humanitarian Law – Treaties and Documents
Please confirm or deny Convention (IV) relative to the Protection of Civilian Persons in
Time of War. Geneva 12 August 1949, i.e., Article 42, 43 and 56 as either applying or not
applying to our situation.
In closing, I request that you please consider an immediate, closed follow-up meeting with this
Spokesperson Thomas Joseph Lenchanko and our legal counsel so we may together, respectfully
develop a more knowledgeable understanding of Hawaiian National traditions, our cultural
practices and our respect for our land, its resources and our people.
As mentioned, we desire to continue our ongoing substantive consultation process, essential to
truthful and accurate communication in a peaceful and diplomatic manner complimentary to both
parties concerned.

Annelle Amaral set up an entrapment for Na Kanaka. At a meeting in Wahaiawa I asked that an international archeologist become part of the team. For I've always held the belief that earlier US Antropologist were founded upon robbery and desecrating of native people. Like mindedness and to further their evil need to just collect and be famous such as annelle Amaral does in her work for the US Armed Forces. The need to hurt children is her best work.

This is so clear and important. Last night I went to a panel discussion at PBS on sustainability, although there was a step in the right direction to at least start the 'talk'--I feel this is just catch up for their own personal purpose.
The panel was made up of urban or American thinking.
So, when Pono ran out of film ---I asked if the wet lands we had once before can return to the aina. Charles Rappun a person I have known from afar for a very long time, I believe said "no". Then, if that is the case why talk about water and sustainability.
But, ofcourse they were looking at being an American urbanights rather than a farmer on lot's of land space for most parts.
They was 'talk' on large lands but it was in general terms.
Someome connected to the 'moral' aspect of connecting to the people which came after my question:

I said, that native Hawaiian needs an exit plan from Hawaii! I quickly said that I believe this to be true because I was exposed to DDT and Agent Orange and now DU. The talk quickly change I believe at that time because they were in shock to my question. Besides, I do see the effects of these contaminats that have broken down our DNA to what it is today. Lot's of congenial defects in babies, the cancer death rates are super high etc....
it's interesting that Rappun was in the negative for these issues........
recently learned that there was a court case Rappun vs. State of Hawaii and the "kanawai laws" were part of the case........the outcome of First Circuit Case 2874 (?) is that "the Kingdom is here!"
As for Rappun, it just may be that he hasn't the genealogies to sit on the lands.........all of this needs to be verified of course........but appears he has some fears about all of this..

this farm appears to be close to the Rappuns.......... then, the Kamaka's are nearby, they are cousins and have the water rights...........the entity State of Hawaii has failed to pay for access to the Waihole Waikane water which goes over into the Ewa Plains.............the water is also flowing to aid the taro farmers, etc.

I too was surprise to hear his talk, but I shouldn't because the truth was visible long time ago after the Waihole and Waikane protest. Yup, I was their too! But no matter, not sweating the small kine stuff. Again trying to look at the bigger picture which is 'haloa'
It brings on so much past memories when no one wanted to be affiliated with Hawaiian except muscians and Samoan Football players in California.
Now the whole world wants to be Hawaiians minus the roots of Haloa--interesting huh? So now the problem rest on our shoulders--but the white man gets the surface credit by OHA's definition and all else.
As to how Haloa can feed the povety and people in need is beyond my thinking and doing in the now time.
As to why Rappun said that we cannot replace wet lands--is beyond me too! Maybe I didn't really voice clearly my question to him. Anyhow my friend from UH Matt was also on the Panel was surpise to know he married a Hawaiian girl and now have a child at st. Louis. I flunked stats twice, so I understood little of the big picture. I'm in agreement that stats is important skill to have when looking at the bigger picture.

This was taken from your posting to give it it's own process, I hope this is okay. It's important to understand what happened in the past and what is happening today. We must not give into the 'evil' that shines in Hawaii around this time since the first inception of missionaries and their descendants.
I can still hear the voice of Sam Lono at Kualoa Park beside the shoreline chanting into the night next to the graves of our Na Kupuna Iwi, as I drifted off to sleep.
There are five (5) ways that aboriginal Hawaiians/kanaka maoli can claim. All five (5) are based on genealogies, because when Kamehameha created the Monarchy government in 1810, it was based only on genealogies..........even in the Constitutional Monarchy government............the foundation/basis is genealogies, connection to the lands thru genealogies, to ancestors/ancestors iwi thru genealogies.....and considered lineal descendants:
1) rights of native tenants and not native tenant rights that some people continue to say.
2) kuleana owners, allodial titles.
3) konohiki descendants/heirs.
4) Kauikeouli/Kamehameha descendants/heirs and successors descendants/heirs.
5) True Hawaiian Government land owners remains under Kamehameha's descendants/heirs and successors descendants/heirs
Thru genealogies, everyone knows who they are, who their ancestors are, lineal descendants move to claim their ancestors iwi..........from the belligerent occupiers, PIRATES, criminal deviants, War Dogs, Warmongers, etc.
Inadvertant burials are only for U.S. American and their archaeologists who gnerally are known to be grave-robbers and totally cluelewss to the cuwstoms, and protocol of otherr cultures. When the military hired Kamoa and Leimaile as cultural advisors, they were advised of the site and the burials there. They werre also one of the ones that discovered DU XWMD there in schofield training area. Later they were dismissed by the military. Since then they have hired a new cultural team that is more to their liking who would play ball with them. Now they are acting like all this is new news and the iwi are inadvertant that they were unaware that they were there.
This shows how disingenuous they are. Annelle Amaral, who proudly states that she is an American, is part of this fraud. So much for their covenant. Military rotation predicts that everytime there is a rotation, the incoming are clueless and the situation begins at the ground level all over again.
SHPD redefines standing as culural or lineal descendants. This becomes irrelevant and once someone rrelocates into the ahupua'a, they become lineal of that area. SHPD is in a conflict of interest since they have developers included in their commission.
There is question of jurisdiction since the islands are still belligerently occupied by the unlawful U.S.A. and thus they don't have clear title to any of the lands. There is no treaty of annexation of which to validate their claims. Hawaii nationals still have their rights which they never relinquished.
