Lawyers' Group Supports Akaka Bill In Letter To Senators

Hawaii Sen. Daniel Akaka says the American Bar Association has sent a letter to every U.S. senator urging support of the Native Hawaiian Government Reorganization Act.

The Hawaii Democrat said Friday that the letter sent this week outlines the bill's constitutionality and its precedent within U.S. law.

He said it also details benefits of the U.S. providing parity to Native Hawaiians as indigenous people.

Akaka, the bill's sponsor, said the letter helps address mischaracterizations and brings attention to the importance of the bill.

Akaka said he remains optimistic the Senate will be able to consider the bill this year.

Hawaiians are the last indigenous people in the U.S. who haven't been granted federal recognition.

  • LOL Yeah because they stand to make millions if land thus titles and royal patents are reorganized with the Akaka Bill.

    My cousin who is a retired judge (which is more than these attorneys can say) thinks that the Akaka Bill will NOT stand the test of the U.S. Supreme Court.

    They are getting desperate. Fortunately there will be a changing of the guard in November when Republicans are set to take control over the House and the Senate. They have struck it down twice before. They will probably do it again LOL

      There is no question in my mind if the AKaKa BILL ever becomes law, it was be challenged and taken to the test of the U.S. Supreme Court. Where it will be declared to be in violation of the U.S. Constitution. This is why I really don't worry that much over the AKaKa BILL.
      They are getting desperate because every day more and more people home here are beginning to understand the Truth about the FAKE STATE. I don't even like attaching the word Hawaii to the statement of FAKE STATE.
      At the University of Hawaii on Sept 25 we had a very good gathering at the Aha Kanaka Kuokoa event. There are those home here who are moving on with the issue of Independence.

    The "indigenous" word means that the people ARE NOTHING, OWN NOTHING, and HAVE NOTHING.

    The "indigenous" term is a label that no one should place claim to..........

    We are aboriginal Hawaiians as documented by Queen Liliuokalani, and kanaka maoli as documented in the CENSUS records - see the 1890 CENSUS.

    "Hawaiians" word became recognized as the description of all no thanks to the Rice vs. Cayetano case.

        As we become overwhelmed by the propaganda of Independence and Civil Rights, may I draw your attention to "un" in the abbreviation of United Nations, UN.

        Webster proclaims, the prefix "un" that is added to adjectives and adverbs, meaning "not" ; denoting the absence of a quality or state as in unusable, uncalled-for, uneducated, unfailing, unofficial and unhappiness.

        Worst yet it also can mean, the reverse of, with an implication of approval or disapproval or with some other special connotation.

        Also described as, the reversal or cancellation of an action, deprivation or separation.

        Purported, the United Nations began with the concerns of Civil Rights until they became UN. But their track record indicates it is not a thoroughbred in the race of humanity.

        It seems the UN is a depository of sanctions that never are implemented, like a "pacifier" to a crying baby. Comparatively, I see it very similar to Courts of International Law.

But we will remember, mai poina ia'o, those who made it possible for us to have the thought of freedom.

        Ever since the ratification ot the UN Charter in 1946, there have been many who have been opposed to the US/UN relationship and have produced all kinds of conspiracy theories that highlight the UN's relationship with communism. Many rabble-rousing Congressmen besides Senator Joe McCarthy went the distance to accuse Secretaries of State Hull, Stettinius, Acheson and Dulles as being communist. This conspiracy stemmed from Congressional fears that the State Dept.-- the other branch of government, the Executive-- was wielding too much power and that the Senator's powers for passing laws should not be dictated by an international body, but rather by their own democratic constituency.

        These were primarily "America First" groups, and they found Congressional support from people like Senator Bricker and the Senate Minority leader Senator Knowland, who in the early 50s-- drafted the Bricker Amendment. The purpose of this amendment was to amend Article 2, Section 2 of the Constitution, otherwise know as the "Treaty Clause."

        The Bricker amendment, like gout, keeps coming back, and right-wing/libertarian groups continue to resuscitate it. There is no shortage of xenophobic people who thinks that no one has the right to stand in the way of America's pursuit for progress and happiness, no matter what the expense.

        The ironic thing about the US/UN relationship in regard to this, is that the US has benefited greatly as a result of the UN, and there is tremendous historical disconnect from those who think that the UN is somehow standing in the way of "freedom", "democracy." and good ol' fashion American opportunity.

        The real criticism should be that the UN is often paralyzed when advocating for policy that is in direct conflict with US interests, and that the UN is not strong enough to stand up against US economic/military/environmental interests.

        Those America First advocates who are promoting this are likely the same tea-party, libertarian advocates who think that life on this planet is a game of last-man standing, and as such, we should disregard any attempt of respecting difference, diversity, and fair opportunities for all. Perhaps diplomacy should be more often than not, seen as a game of tic-tac-toe, where the real outcome is to never win or lose.

        The UN may not be perfect, but it is successful in that it is an internationally recognized institution and mechanism for the advocacy of peace, in all of its manifold complexity.
