On June 4th, we will be at a Kauai/Niihau Island Burial Council meeting to refute another Burial Treatment Plan (BTP), the 10th revision, that will allow a developer/speculator to build a luxury home on 7 burials and surrounded by 23 other known burials (we are sure therer is more) located on Kauai's north shore in Naue.
The construction was halted by us since June 2008 but has resumed on May 11th.
The last BTP was rejected by our Burial Council, we are hoping that they will reject this one, too.

Jim Powell does not work for McMahon, he works for Scientific Consultants and Mike Dega, who did the BTP. Jim Powell did not take ovah anything to do with Keoni Alvarez or the videos he did of us at Naue.
It is Brescia's lawyers that want to confiscate his videos so he went to ACLU and they are defending him on the "Media Shield Law" that was just passed last year. No I have not heard when the case will be in court.

Sorry for not keeping up on Maoliworld and all my friends. I pray all is well with you and your ohana.
We were in court again since I last reported on the Naue burials. We were once again denied a TRO to stop construction.
Don't know if you folks saw the article about it in the Hnl Adv. My personal opinion about this whole farce is...justice is not home...there is no justice for cultural and religious rights in their court room. I was in the wrong jurisdiction. The judge has the koko but it is so diluted by western law that its gone. We need a jurisdiction that recognizes my jurisdiction to have the freedom to protect, respect and honor the bones of my ancestors.
Next court date not til Oct. 2010. But we not just sitting around waiting....we are going to continue to fight. We may need to do some demonstrations, show some outrage, do some investigative work, take SHPD and Nancy McMahon to court for crimes committed against our na iwi, etc., etc, etc.
Mahalo for all your continued support. Speaking of support...we need to raise funds for our Defense Fund. Anything and everything helps. I don't like asking but I think you folks, all my friends on Maoliworld...will understand.

The latest update is that there still is no approved burial plan in spite of the fact that when the Planning Commission allowed the permits to build, they had conditions, one of which stated that no building permit be issued until SHPD and the Burial Council have a complete and final burial plan. To this day, there is no approved plan.
The developer hired Mike Dega, archaeologist of Scientific Consultation Services, Inc. (SCS), heard of him? Between he and Nancy McMahon, they have tried their best to underhandedly push the plan through since last year...two days before we were to discuss burial plan # 10, which they said was the final one, they turned up with a #11! Conniving bunch of liars and deceivers! On June 4th, our burial council unanimously deferred the plan with the recommendation that to preserve in place means NOT building above the bones and allowing access for cultural practitioners to visit and honor the na iwi. Now the burden falls on the developer to go back to the Planning Commission to explain why he is continuing to build in spite of the conditions the PC attached to the permits, one of which stated that no building can occur until final approval of a burial plan.
I have tried several times to get on the PC agenda to bring this matter to the forefront for discussion and twice I got the brush off from them.
Our attorney at NHLC is now filing a court order to stop the construction based on the failure of SHPD to expedite the laws on burials. So far the court has not responded with a date....meanwhile I will continue to pursue getting an audience with the Planning Commission to act upon their conditions. That's where it stands right now.
As for Hanalei Fergerstrom...his case has been dismissed due to Brescia's lawyers failure to serve him properly....he represented himself and won his case.

I am tired of this idiots that keep poping up and doing nothing but digging graves for the future generations to come. You can tell them I said that too! I stopped believing in the local Burial Treatment Plan, when Nagpra screwed over the Malama group. We have too many hands in the pot. After Halawa, the International burial overseers came to work on some project in Honolulu, they were hired by the contractors. We had a council meeting with the director of the Board of Water Supply, the point is they admitted digging out bones and continued the construction. The Burial Council (kaka's)were called in and a vault was built at Kapiolani Park, near the entrance for the iwi. On this last protest, the burials were snubbed.
Across, Straub clinic, the Burial Council wanted to negotiate for a condo unit at that time with Pan American. This happened awhile back in the late 70s or early 80s. The Burial Council wanted to negotiate this endeavor for in exchange for condo units. The building was to be built over the graves with concret columns around the perimeter, ugh!!! I just cannot believe what I'm reading. Shit!!!
