AKAKA BILL REINTRODUCED IN SENATE AND HOUSE

"It's time to gird the malo!" E-mail, Fax, Write letters to, or phone all those in congress that we native Hawaiians are opposed to the Akaka Bill as written. We've had no hearings since it was first brought to Hawai'i and presented to the peoplewhen it was first introduced. It didn't sit well with us back then and it still doesn't. They've amended it many times and still ignored the majority of the people who preferred independence rather than made into an American tribe. I wrote to Akaka about my objections and he wrote back that he ssat with some Hawaiians (elite American-Hawaiians) and revised it according to their input. We've ask for another hearing for the people and this time to hold hearings on the neighbor islands so all can give their input about this bill. Still they ignored us. Akaka refused saying that he spoke to certain Hawaiians and that adjustments have been made. Still other congress people and the pentagon were concerned with their issues and more ammendments were made to facilitate them. Still no input from the Hawaiian people because they didn't like what they heard from us. This reminds me of the Blount Report vs. the Morgan report. They didn't like what the Blount Report stated and the Morgan Report absolved them from any crime. That's how The Turpie Resolution and the Newlands Resolution passed; because the Morgan Report said what they wanted to hear. They ultimately ignored the Ku'e Petitions because it wasn't what they wanted to hear. The Organic Act of 1900, the Statehood Act was created to cover up their crimes and insure what they wanted; always ignoring what the Hawaiians wanted. Now comes the Akaka Bill to have what they want and still ignoring what the Hawaiians want. Where does this all end? We have descendants of 15.6% non-kanaka Maoli that have been erased from the citizenry recognized in the 1890 census and 84.4% kanaka Maoli designated to be a tribe of the USA. The U.S. wants all of us to give up our Hawaiian Kingdom citizenship, rights and privileges to become citizens and native American wards/ dependants of the U.S.A. A nation within a nation is another word for voluntary occupation. They worry about secession but how can we ceded when we never ceded. All their dellusionary acts are internal or domestic U.S. laws which have no lawful jurisdiction over Hawai'i. We still are a sovereign, independent state; the same as the U.S.A. Why would we give that up to be a dependent state under the U.S.A. They can't demote our status because they say so. There was never a Treaty of Annexation executed through the Newlands Resolution nor the Organic Act that followed. The Statehood Act is another fraud when processed by they U.S.A. Inherent sovereignty is a U.S. created word used to fit the Native Americans and want to include that for the native Hawaiians. We have national sovereignty rights. U.S. American sovereignty is misplaced in Hawai'i as we already have our own recognized sovereignty. Why be eager to give it away which the Akaka Bill attempts to do as in an illusion? We need everyone to communicate our refusal of the Akaka Bill and that we will not participate in it; what we intend is to have the U.S.A. de-occupy our country once and for all. Akaka (D-Hawaii) today introduced The Native Hawaiian Government Reorganization Act of 2009 with Senator Daniel K. Inouye (D-Hawaii) as an original cosponsor. Congressman Neil Abercrombie (D-Hawaii) introduced a companion bill in the U.S. House of Representatives with Congresswoman Mazie Hirono (D-Hawaii) cosponsoring. The text of the bill introduced today is identical to the bill passed by the House in 2000. The bill would begin a process to form a Native Hawaiian government that could negotiate with the state and federal government on behalf of Hawaii's indigenous people. Any agreements would require implementing legislation by the state or federal government; no jurisdiction would be changed without approval. The bill would provide parity in federal policies that empower other indigenous peoples, American Indians and Alaska Natives, to participate in a government-to-government relationship with the United States. In his floor statement today, Senator Akaka said: "Building on the constitutionally sound and deliberate efforts of Congress and the State of Hawaii, it is necessary that Native Hawaiians be able to reorganize a government and enter into discussions with the federal and state governments. My bill would ensure there is a structured process by which Native Hawaiians and the people of Hawaii can come together, resolve such complicated issues, and move forward together as a state." Senator Inouye said: "This is a good bill and it is long overdue. The Hawaii Congressional Delegation will do its utmost to successfully pass this measure." Congressman Abercrombie said: "The legislation we are introducing today is important, not only to Native Hawaiians, but to everyone in Hawaii. It provides a process to address longstanding issues facing Hawaii's indigenous peoples and the State of Hawaii. In addressing these matters, we have begun a process of healing, a process of reconciliation not only between the United States and the Native people of Hawaii, but within the State." Congresswoman Hirono said: "It is a matter of decency-of human and civil rights-for the Congress to provide for a process of self-determination for an indigenous, native people. The House has twice voted to support federal recognition for Native Hawaiians, and I look forward to working with the Hawaii delegation on passing the bill again and having our Hawaii-born President Obama sign it into law." Commonly known as the "Akaka Bill," the Native Hawaiian Government Reorganization Act enjoys bipartisan support. In Hawaii, the bill is strongly supported by Governor Linda Lingle, and the State legislature has passed three resolutions in support of federal recognition for Native Hawaiians. In 2007, Hawaii State Attorney General Mark Bennett testified in strong support of the legislation before the Senate Indian Affairs Committee. Nationally, organizations such as the American Bar Association, Japanese American Citizen League, and the National Indian Education Association have passed resolutions in support. The largest national Indian organization, National Congress of American Indians, and the largest organization representing the Native people of Alaska, the Alaska Federation of Natives, have consistently expressed their strong support. While Congress has traditionally treated Native Hawaiians in a manner similar to American Indians and Alaska Natives, the federal policy of self-governance and self-determination has not been formally extended to Native Hawaiians. Upon enactment the bill itself does not extend federal recognition - it authorizes the process for federal recognition. Opponents to the bill have sought to spread misinformation about the legislation. It is important to clarify that: The bill does NOT allow Hawaii to secede from the United States. The bill does NOT allow private lands to be taken. The bill does NOT authorize gaming in Hawaii. The bill does NOT create a reservation in Hawaii. The Native Hawaiian Government Reorganization Act does three things: It establishes the Office of Native Hawaiian Relations in the Department of the Interior to serve as a liaison between Native Hawaiians and the United States. It establishes the Native Hawaiian Interagency Task Force to be composed of federal officials from agencies which administer Native Hawaiian programs, intended to increase coordination between the Native Hawaiians and the federal government. It provides a process of reorganization of the Native Hawaiian government for the purpose of a federally recognized government-to-government relationship with the United States. This inclusive, democratic negotiations process represents both Native Hawaiians and non-Native Hawaiians. Negotiations between the recognized Native Hawaiian government, the United States, and the state of Hawaii will address issues such as criminal and civil jurisdiction, historical grievances, and jurisdiction and control of natural resources, lands, and assets. There are many checks and balances in this process and any agreements reached will require implementing legislation on the state and federal levels. While the bill provides structure, it also provides the Native Hawaiian community with the flexibility to truly reorganize its government. "This process is important for all people of Hawaii, so we can finally resolve the longstanding issues resulting from the overthrow of the Kingdom of Hawaii and move forward together to provide a better future for the children of Hawaii. We have an established record of the United States' commitment to reconciliation with Native Hawaiians. This legislation is a necessary next step to build upon that foundation and honor that commitment," Senator Akaka added.     To me the Akaka Bill is not the Native Hawaiian Government Reorganization Act. It's really the Native Hawaiian LAND Reorganization Act.

    They try to call it the "Akaka Bill" and the "Native Hawaiian Government Reorganization Act" to try to deceive but if *you* dig deeper it is all about the title and thus about the land. They know EXACTLY what they are doing!

    As a professional in land and in title, this is totally unacceptable to me what DEMOCRATS have created!!! And would not be tolerated if and when other people's property rights were violated. Since we are Hawaiian by nationality somehow this is "tolerated" by some people. Aue!!!

    Hawaiians whom I know have NEVER signed to transfer their title per the statute of frauds which requires that all transactions dealing with real property MUST BE IN WRITING.

    Obviously some people are conveniently trying to forget about the STATUTE OF FRAUDS because they are frauds! Aue aue aue!

    May the Republicans save us from this hell since they are the ones who are adamantly opposed to the "Akaka Bill" while the Democrats created this bill. (They want it to pass! Damn thieves!)

    FWIW once WE lose our land... WE lose our roots! So aue to those Democrats who condone violating the property rights of HAWAIIANS is all I can say!

    • Okay, lets share. Nah, just a chuckle to help us relax from AKAKA BILL STRESS! Yes, we can do our part, we need all po'e wo wake up and smell the coffee that is brewing. Damn thieves is right. Nothing new or ld, same old CRAP!

      I recall a comment made by a friend a few days back, "oh still the same, going take long time." Her comment may be in tact, but the fact is that we are doing something about it. I want my children to know who fought for their lives - all po'e, not just some. We marched for the love of our queen. Arewe going to give the U.S. the satisfaction that they won or even Linda Lingle. What has she done that is PONO? FRAUD to sell ceded land not even ceded to U.S. Keanu Sai's video was outlined ceded lands and Hawaii's impact of being ilegally occupied by U.S. who LIngle is trying to sell lands not even theirs. Got a SLIPPAH!
  • For the adventurous ones, you could go to these media folks; some may be outdated. But you can tell of our stance and urge people to write to their congressperson to vote against the Akaka Bill to create Hawaiians into tribal native Americans. This should get your juices flowing. Probably opeds and letters to the editor, etc. You might have to glean through this to find an appropriate one to write to. The more people aware, the more action it produces.

    Have them help us, native Hawaiians to stop the Akaka Bill. We want hearing on all islands and receive the final proposed bill to decide on it or contest it. The Congress need to hear from us and as it stands we DON"T want the bill especially as it is written. We don't support it and say NO.
