A good ruling for the Kingdom

Aloha Ka Kou. These opinions take a little bit to figure out, but the gist is that no finding against claimants were part of this opinion. The door is open and the State still has to rule on the injunction again. The SCOTUS can only rule on Federal questions and they only effect American citizens and their assets. Here's the most interesting part: Hawaiian Law? "But we have no authority to decide ques-tions of Hawaiian law or to provide redress for past wrongs except as provided for by federal law."     Hi e Kai but with all due respect even though they stated

    "The judgment of the Supreme Court of Hawai'i is reversed, and the case is remanded for further proceedings not inconsistent with this opinion."

    it is still not a good ruling for us considering that they have no jurisdiction so have no say yet commented on things that do not concern them so I posit to you... how is that good. It is none of their business.

    I notice that the local papers are spinning it to try to sway public opinion in order to try to advocate that conversion is somehow "okay." Thus trying to brainwash some of us to actually believe that some Hawaiians are not legal heirs when they are. Looking back... growing up in Hawai'i it still amazes me that they are still trying to brainwash us. However I hope that other oiwi take the time to read the 15 pages themselves instead of relying on other peoples interpretation of it.

      It all depends on what you want from the opinion. We want a legal way in to assert the Kingdom's claim to the Crown lands. They could have found [as the State wanted] Perfect Title for the State and quash all legal claims. In fact they left the door open for the Kingdom. we will bring the question of title and we present that the Republic did not cede anything or Newlands have any weight. They say they have no jurisdiction over "Hawaiian Law"? Do they mean Kingdom law or Hawaiian law based in the kingdom or just State law. But they didn't say State law and would have that if that was what they meant!

      • This is where I disagree with people like my cousin retired judge Paul DeSilva.

        He thinks that this issue and the "Akaka" Bill should face the test of constitutionality. His paradigm is America and American laws.

        I have a very high respect for the law (both American and Hawaiian) but I diverge from that mana'o that our concerns face the test of constitutionality according to America. I believe in the TOTAL independence of the U.S. and the Hawaiian Kingdom. This includes but is not limited to the U.S. Supreme Court so to me it does not matter what they meant by "Hawaiian law" on page 15 of 15.

        It is none of their business and they have NO jurisdiction so I do not care how THEY define it or what THEY mean by it. The world does not revolve around the U.S. and yes I still maintain my American citizenship... but the world does NOT revolve around America.

          The Independent Hawaiian Kingdom can enter the SCOTUS and assert its rights. The court has a place in this process, but is not the end of the story. Of course the court has an interest in the outcome and we face that bias there. You don't care? They have guns, they Kanakas with guns that arrest us, Kala mai me it's late here, I can not do justice to the argument. I will convince you tomorrow.

          The US must end their military occupation of Hawaii!

            I am well aware of weaponry that America has and while it seems as though you want them to de-occupy I diverge there solely because of our keiki, mo'opuna, and kupuna. If and when they leave our kupuna WILL be collateral damage and as much as some people want the U.S. military to leave I hope they have weapons that can DEFEND our keiki, mo'opuna, and KUPUNA because the JSF can and WILL kill them instantly.

            What I meant above was that the world does NOT revolve around America. I do not care if it passes the test of constitutionality of AMERICA so obviously do not care what the mana'o is of the judges while one of my cousins who is a retired judge thinks that it SHOULD pass the test of constitutionality. However as much as some people want to believe in the justice in our system for the last 105 years or so the American system has been NOTHING but unjust so no! I do not care what the top judges of the U.S. think because to date they STILL do not respect our kupuna some of whom SIGNED the Ku'e Anti-Annexation petition and who did NOT sign to transfer their title to ANYONE so kala mai but NO... I do NOT care what these judges think.

            However I DO care what the decision would be in an INTERNATIONAL court. Even then it still would not be FAIR to Hawaiians because to me whatever America touches... it taints but if I had a choice between intra-national or INTER national then I would choose an INTERnational court. Even then to me a more important court is the court of public opinion which IMHO is MUCH more powerful.
  • I read the judgement over and over, there is so much knowledge that needs to get out to our people about the TRUTH and how everything that goes on around us is FALSE. The more people that get the FACTS the BETTER it is. ENOUGH with the BRAINWASHING of our PEOPLE!

    That ruling only tells me that the FEDS got there shit all mixed up, cause now they do not want to interfere on "Hawaiian Law" when they were the ones who handed the ceded (stolen) lands to the illegally occupied State.
